Indenture for James and Samuel Campbell
This indenture made the twenty eighth day of December in the year of our Lord one
thousand eight hundred and twenty nine between James Campbell and Eleanor his wife
of the town of Harpersfield County of Delaware and State of New York of the one part,
and Samuel Campbell of the same place of the other part. Witnesseth that the said James
Campbell and Eleanor his wife for and in consideration of the sum of one thousand
dollars money of account of the United States to the said James by the said Samuel in
hand will and truly paid at and before the ensealing and delivery of these presents the
receipt whereof is hereby acknowledged have granted bargained sold aliened released
and confirmed and by these presents do grant bargain sell alien release and confirm unto
the said Samuel in his actual possession now being and to his heirs and assigns forever all
that piece or part of a lot of land lying in the town of Harpersfield in a patent granted to
John Harper and others known and distinguished by lot number one hundred and twenty
three meaning to convey the whole lot except fourteen acres off from the South East
corner which the said Samuel has a deed from Peter Smith of together with all and
singular the privileges advantages hereditaments and appurtenances to the said premises
belonging or in anywise appertaining and the revision and revisions remainder and
remainders rents issues and profits thereof; and all the estate right title interest property
claim and demand whatsoever both in law and equity of them the said James and Eleanor
or either of them of in or to the same every or any part , or parcel thereof. To have and to
hold the above granted bargained and released premises, with the appurtenances. Unto
the said Samuel Campbell his heirs and assigns to the only proper use of the said Samuel
his heirs and assigns forever. And the said James and Eleanor there for themselves heirs
executers and administrators do by their presents covenant promise grant and agree to
and with the said Samuel his heirs and assigns in manner and following, that is to say that
they the said James and Eleanor at the time of the ensealing and delivery of their presents
were lawfully seized in their own right of in and to the said premises mentioned to be
hereby granted and released with the appurtenances as of a good sure perfect absolute and
indefinable estate of inheritance in fee simple without any condition or other matter or
thing whatsoever to alter change charge defeat or make void the same; And also that they
the said James and Eleanor have in themselves good right full power and lawful authority
to grant bargain sell release and assure the said premises hereby mentioned to be granted
and released unto and to the use of the said Samuel his heirs and assigns in manner
aforesaid; And further that the said Samuel his heirs and assigns shall and may from time
to time and at all times forever hereafter peaceably and quietly have hold occupy possess
and enjoy the said premises mentioned to be hereby granted and released, with the
appurtenances. And that free and clear and freely and clearly acquitted exonerated and
discharged of from and against all and all manner of former and other gifts bargains sales
leases mortgages dowers and titles dower judgments executions charges and
encumbrances whatsoever. And the said James and Eleanor for themselves and their
heirs all and singular the premises mentioned to be hereby granted and released and every
part and parcel thereof with the appurtenances unto the said Samuel his heirs and assigns
against all and every person and persons whomsoever lawfully claiming or to claim the
same shall and will warrant and forever defend by these presents. In witness whereof the
parties to their presents have hereunto interchangeably set their hands and seals the day
and year first above written.

On this twenty first day of April one thousand eight hundred and thirty six, personally
appeared James Campbell before me John Harper a commissioner of Deeds in and for the
County of Delaware who is known to me to be the person described in and who executed
the foregoing indenture and who acknowledged the same to be his act and deed and
having examined the said indenture and finding therein no material alterations reasons or
interventions I allow it to be recorded.
