Indenture between James Campbell & Johnson/Manning
This indenture made the second day of April in the Year of our Lord one thousand eight-hundred and eleven between
Jeromin Johnson, Robert Manning, William F. Manning and Jeramich Manning executors of the last will and testament
of James Manning deceased late of City of New York merchant of the first part and James Campbell of the town of
Harpersfield County of Delaware and State of New York Farmer of the second part witnesseth that the said parties
of the first part for and in consideration of the sum of five hundred and twelve dollars and fifty cents lawful
money of the United States of America to them in hand paid at or before the released and delivery of these presents
by the said party of the second part the receipt the receipt whereof is hereby acknowledged and the said party of
the second part his heirs executors and administrators for ever released and discharged from the same by their
presents have granted bargained sold ? conveyed and confirmed and by their presents do grant bargain sell release
convey and confirm unto the said party of the second part his heirs and assigns forever all that certain lot piece
or parcel of land situate lying and being in the township of Harpersfield in the County of Delaware and State of
New York known and distinguished by lot number 123 one hundred and twenty three reference to the map and field book
of said township being had may more fully appear Beginning at a stake and stones being the Southeast corner of lot
number 147, one hundred and forty seven and running thense, as the needle pointed in the year 1770. South thirty
degrees East twenty five chains to a stake and stones being the northeast corner of lot No. 149, one hundred and
forty nine thence north sixty degrees East forty one chains to a stake and stones being the northwest corner of
lot No. 99, ninety nine thence north thirty degrees west twenty five chains to a state and stones being the
southwest corner of lot No. 97, ninety seven thense in a direct line to the place of beginning containing one
hundred and two and an half acres of land be the same more or less which said premises was conveyed to the said
James Manning deceased in his lifetime by Mathew Bellany of Catskill and Anna his wife by deed bearing date the
thirteenth day of April 1795, wherefrom the forgoing description in taken. Together with all and singular the
privilages advantages heridiments and appurtances whatsoever unto the said above mentioned and described premises
way apportaining or belonging and the revisions and revised remainder and remainders rents (?) and profits thereof
and also all the estate right title interest served(?) and right of (?) property claim and (?) whatsoever and in
law as in equity of the said parties of the first part of in or to the same and every part and parcel thereof with
the appurtances and of the heir and widow of the said (?) to have and to hold the above granted bargained and
described premises with the appurtances unto the said party of the second part his heirs and assigns to hi and
their own (?) un and behoof forever and the said executor for themselves this heirs executors and administrators
do covenant grant promise and agree to and with the said party of the second part his heirs and assigns that the
said testament the time of his death at the time of the seeking and delivery of there presents was lawfully seized
in his own right of a good absolute and indespensible estate of ? in fee? Simple of and in all and singular the
above granted bargained and described premisses with the appurtances and have good right and laful authority to
grant bargain sell and convey the same in manner and form as written and that the said party of the second part
his heirs and assigns shall and may at all times hereafter peacably and quietly have hold occupy and enjoy the
above granted premises and every part thereof with the appurtances without any let suit trouble molestation
eviction or disturbance of the said parties of the first part their heirs or assigns or of any other person or
persons lawfully claiming, or to claim the same. And theat the same now are free clear discharged and
unincumbered of and from all form and other grants titles charges estates judgements taxes assessments and
incumbances of what nature or kind soever except a certain quit rent to be paid and discharged by the said party
of the second part . And also that the said parties of the first part and the said testators heirs and all and
every person or persons whomever lawfully or eqitably deriving any estate right ? or intent of in or to the herein
before granted premises by from under or in trust for them shall and will at any time or times hereafter upon the
reasonable request and at the proper witt and charges in the law of the said party of the second part his heirs
and assigns make do and execute or cause as process to be made done and executed all and every such ? and other
lawful and reasonable act conveyance and ass? In the law for the better and more effectually ? and confirming the
promises hereby intended to be granted in and to the said party of the second part his heirs and assigns forever
and by the said party of the second part his heirs and assigns or his in their counsel harmed(?) in the law shall
be reasonably ? ? or required. And the said executors for themselves and therin testators thein? The above
described and hereby granted and released premises and every part thereof with the appurtances unto the said party
of the second part his heirs and assigns against the said parties of the first part and their testators heirs and
against all persons whomever lawfully claiming or to claim the same shall and will warant and by them ? forever
defend. In witness whereof the said parties to these presents have hereunto interchangably set their hands and
seals the day and the year first above written.
