SANFORD - MULTER INDENTURE - 11 January 1889
This Indenture Made this eleventh day of January in the year of our Lord one thousand eight hundred and eighty nine. Between: Henry Sanford as executor of the last Will and testament of Emeline Multer late of Longmont Colorado deceased party of the first part and John K. Odell of the Town of Davenport County of Delaware and State of New York of the second part. Witnesseth: That the said party of the first part by virtue of the power and authority to him given by the said last Will and testament admitted to probate at a Surrogates Court held in and for the County of Delaware and recorded in book K page 147 of Wills, and for and in consideration of the sum of Twelve Hundred ($1200.00) Dollars to him paid by the said party of the second part the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and by these presents doth grant bargain sell and convey unto the said party of the second part and to his heirs and assigns forever. All That tract or parcel of land situate in the town of Davenport County of Delaware and State of New York and bounded and described as follows viz: On the north by lands of David Van Dusen on the east by the highway in the south by the lands of the Widow Van Zandt and in the west by lands of John Smith and a grave yard Containing four (4) acres of land more or less, being the same lands conveyed by Fred E. Palmer to P L Dorwin on the 31st day of March 1874. and by the said P L Dorwin to said Emeline Multer deceased on the 28th day of April 1874 by deed recorded in Delaware County Clerks Office in Liber 103 of Deeds at page 345 to which reference is here made for a description. Also that other certain piece or parcel of land situate lying and being in the town of Davenport aforesaid described as part of lot No 17 in the Charlotte River patent and bounded as follows viz: Beginning at the highway leading from the old Charlotte Turnpike to the Charlotte river on the northerly line of lands now occupied by Perry Butts. Thence easterly along the line of lands of the said Perry Butts Daniel Rowe and George Hillis to the northwest corner of lands now occupied by Joseph Dorwin. Thence Northerly about twelve and three fourths rods to a stake and stones. Thence Westerly in a straight line about twenty eight rods to a marked maple tree and from thence in the same course to the said highway to the place of beginning supposed to contain about three acres of land be the same more or less. The party of the second part is to do and perform the covenants in relation to making and supporting all the fence between the premises thus conveyed and the lands of Robert J. Van Dusen as are contained in the deed from said Robert J. Van Dusen to the said Emeline Multer dated the 18th day June 1881 and recorded in the Delaware County Clerks Office in Liber 103 of Deeds at page 344 and to which deed reference is here made. This conveyance is given and accepted subject to a lease by the terms of which possession of the same is in the lessee untill the first day of April 1889. Together with all and singular the hereditanments and appurtenances hereto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof. And all the estate right title intrest property possession claim and demand whatsoever which the said testatrix had in her lifetime and at the time of her decease and which the said party of the first hath by virtue of the said last Will and testament or otherwise of in and to the above described premises and every part and parcel thereof with the appurtenances To have and to hold forever. And the said party of the first part for himself and for his heirs executors and administrators doth covenant promise and agree to and with the said party of the second part his heirs and assigns that he has not made done committed executed or suffered any act or acts thing or things whatsoever whereby or by means whereof the above mentioned and described premises or any part or parcel thereof now or at any time hereafter shall or may be impeached charged or incumbered in any way or manner whatsoever. In witness whereof the party of the first part hath hereunto set his hand and seal the day and year first above written.

eighty nine before me the subscriber personally appeared Henry Sanford to me known
to be the executor of the last will of Emeline Multer deceased and to be the same
person described in and who executed the foregoing instrument and he acknowledged
