Book of Wills dated 27 Feb 1882
Be it remembered that at a Surrogate's Court held at the Surrogate's Office in Delhi in and for the County of Delaware on the 27th day of February,
1882, the Last Will and Testament of Jennette Smith, late of the town of Franklin in the county of Delaware, deceased, was duly proved, before Isaac H. Maynard, Esq., Surrogate of said county and was by said Surrogate adjudged valid and established as a Will of real and personal estate, and the same together with the proofs and examinations taken on the probate thereof, are pursuant to an order of the Surrogate here recorded to wit: In the name of God Amen. I Jennette Smith of the town of Franklin in the county of Delaware and state of New York, of the age of seventy three years and being of sound mind and memory do make, publish and declare this my Last Will and Testament in manner following that is to say: First I give and bequeath to my daughters Ruth Dibble and Ellen Hopkins all of my household furniture, wearing apparel, watch and silver spoons to be divided equally between these as they agree, but in case either of my said daughters should die before the distribution, then in that case I the above bequest be paid to the survivors of them. Second, I give and bequeath to my daughter Ruth Dibble the sum of one hundred and fifty dollars. Third: I give and bequeath to my daughter Ellen Hopkins the sum of one hundred dollars. Fourth, I give and bequeath to my son Egbert Smith the one thousand mortagage which I now hold against his farm in the town of Franklin, NY, provided he provides me with a house during my lifetime. Fifth, I give and bequeath to my son Leroy Smith the sum of one hundred and fifty dollars and lastly I give and bequeath all the rest and remainder of my persoal estate, goods and chattles of what nature or kind, to my said son Egbert Smith, whom I hereby appoint sole executor of this my Last Will and Testament, hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this twenty sixth day of April in the year of our Lord one thousand eight hundred and eighty one.
The above insturment consisting of one sheet was at the date thereof signed, published and declared by the said Jennette Smith as and for her
Last Will and Testament in presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses thereto.
