5 Dec 1817 Delaware County, NY William McCune of the Town of Stamford executed his Will
IN THE NAME OF GOD AMEN I William McCune of the Town of Stamford County of Delaware and State of New York being weak in body but of sound and perfect Mind and Memory and Considering the Uncertainty of this Mortal life, Do make and publish this last will and testament in manner and form following (that is to say)
First, I give and bequeath unto my well beloved wife Esther McCune one third of all of my estate both real and personal and as it is her will not to hold
any part of my landed property, I do hereby authorize my Executors to convey the same unto my brother John McCune and if the Executors and my said brother cannot agree upon the price it is my will that it should be submitted to the appraisal of two Judicious [next word illegible] and if they cannot agree do
hereby authorize the said appraisers to chose a third man as an umpire and the opinion and appraisal of them or any two of them shall be final and
conclusive----And further if my said brother should alter his mind or any other circumstances happen that he could not or would not purchase my said
landed property then and in that case I hereby allow and authorize my said Executors to sell and convey it in the same manner to any other persons. Secondly, I give and bequeath unto my daughter Mary Ann the other two thirds of all my estate as aforesaid to be converted into money and let out at interest by good landed security untill she arrives at lawful age provided however that if my said wife Esther should prove pregnant at this time and have another living child then it is my wish that the said two thirds should be equally divided between my children. And further if any said child or children should die before she or they arrive at lawfull age then and in that case it is my will that the said two thirds should revert unto my said wife Esther the same as the first third named above. thirdly My debts which are but few It is my will that they should be paid out of the money now in my possession and also my funeral charges. Lastly I do hereby nominate and
appoint my wife Esther McCune Executrix and Alexander Brush and William Kidzie Executors of this my last will and Testament hereby Revoking all
former wills by me made. In witness where I have herunto set my hand and seal this fifth day of December in the year of our Lord one thousand and
Eight Hundred and Seventeen----William McCune [L.S.]
Signed, sealed and published and Declared by the above named William McCune to be his last will and testament in the presence of us who have hereunto
subscribed our names as witnesses in the presence of the testator.
