LAST WILL and TESTAMENT OF FRANCIS ELLIOT - 1897

The Last Will and Testament of Francis Elliot of the Village of Delhi County of Delaware and State of New York . I, Francis Elliot being of sound mind and memory, aware of the uncertainty of life and the certainty of death, and desirous of making an equitable and proper disposition of my property at my decease, I do make, ordain, publish and declare this to be my last Will and Testament, in manner and form following that is to say:
First. I direct the payment of my just debts, if any, and funeral expenses.
Second. I give devise and bequeath to my daughter Jennie C. Elliot, fifteen hundred dollars in money. Also all my household furniture
Third. I give devise and bequeath to each of my four sons, Robert, James, Walter & George the sum of one thousand dollars each in money.
Fourth. I give devise and bequeath to each of my sons John and Francis Jr. the sum of Five hundred ($500.) each in money.
Fifth. I give devise and bequeath to my granddaughter, Jennie Irene Wilson daughter of my deceased daughter Lizzie Wilson Six hundred dollars in money to become due and payable when she shall arrive at the age of twenty one years with interest from the date of my decease.
Sixth. I give devise and bequeath to my grandson Robert E. Wilson son of my deceased daughter Lizzie Wilson, Six hundred dollars in money to become due & payable when he shall arrive at the age of twenty one with interest from the date of my decease.
Seventh. And in the event of the death of either or both of my said grandchildren before she or he shall arrive at the age of twenty one years, then and in that event I give devise and bequeath the share of such deceased grandchild or grandchildren to my daughter, Jennie C. Elliot.
Eight: I do hereby make constitute and appoint my daughter Jennie C. Elliot to be the testamentary guardian of my said tow grand children, Jennie Irene Wilson & Robert E. Wilson.
Ninth. And all the rest residue & remainder of my estate after the above legacies & bequests are paid, I give devise and bequeath to my sons Francis Elliot Jr. Robert Elliot John Elliot James Elliot Walter Elliot & George Elliot and my daughter Jennie C. Elliot to be equally divided between them share and share alike and to their heirs and assigns.
Tenth. I hereby give unto my executors hereinafter named full power and authority to execute deed or deeds for any real estate or lands of which I may die seized & to sell & convey any & all such lands or real estate of which I may die seized and on such terms & at such prices as they shall deem best for the interest of my estate.
Likewise, I make, constitute, and appoint my daughter Jennie C. Elliot & my friend James Middlemist of the village of Delhi Del. Co. N.Y. to be my executors of this my last Will and Testament, hereby revoking all former Wills by me made.
In Witness Whereof, I have here unto suscribed my name and affix my seal, the 30th day of November in the year of our Lord, one thousand eight hundred and ninety seven.

The foregoing instrument was at the date thereof subscribed by Francis Elliot the testator therein named, in the presence of us and each of us. He at the time of making such subscription acknowledged that he executed the same and declared the said instrument so subscribed by him to be his last Will and Testament. Where upon we, at his request, and in his presence, and in the presence of each other, do here subscribe our names as witnessess thereto.
