Record of the Last Will and Testament of James C. Bush
Be it remembered on the 17th day of May in the year of our Lord one thousand nine hundred and ten, Junius C. Bush, one of the Executors named in the Last Will and Testament of James C. Bush, late of the Town of Franklin, in the County of Delaware, deceased, appeared in open court, before the Surrogate of the County of Delaware and made application to have the Last Will and Testament which relates to both Real and Personal Estate, proved: and on such application the Surrogate did ascertain by adequate evidence who were the heirs at law and next of kin of the said testator and Junius C. Bush, Cora A. Burgess, and Augusta C. Bush having severally filed an instrument in writing waiving the issue and service of any citation herein and counseling that said Will be submitted to probate forthwith and on that day the proponent having appeared in support of the probate of said Will and no one appearing to oppose the probate of the same, such proceedings were thereupon had in said court that the said Surrogate took the proofs of said Will hereinafter set forth upon this 17th day of May AD, 1910 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are as follows, that is to say:
Last Will and Testament of James C. Bush. I, James C. Bush, residing at Franklin, Delaware County in the State of New York, do hereby make my Last Will and Testament as follows, hereby revoking any and all other wills by me heretofore made:
First: I direct payment of my just debts and funeral expenses.
Second: I give, devise and bequeath the net income upon all my property, real, personal and seized, to my wife, Augusta C. Bush, for and during her life, and she shall have free use and enjoyment during her life of my homestead and residence at Franklin and upon her decease or if she should not survive me, then all my said property shall be divided equally between my son and daughter herein named and if either be deceased leaving issue, such issue to take the parents share.
Third: I appoint my daughter Cora A. Burgess of East Orange, New Jersey and my son, Junius C. Bush of Scranton, Pennsylvania to be the executors of this will without bonds; hereby giving them or the survivor of them full power to sell mortgage, or lease any and all real property of which I may die seized.
In witness thereof I have herewith set my hand and seal this twenty second day of March in the year one thousand nine hundred and ten.

The foregoing instrument was on the day of it's date, signed, sealed, published and declared by the testators herein named as his Last Will and Testament in our presence. In witness thereof, we have at his request and in his presence, and in the presence of each other, signed our names hereto as attesting witnesses
