THE PEOPLE OF THE STATE OF NEW YORK, To Hyman A. Hamilton and George B. Beard, of Harpersfield, Delaware county, N.Y.; Hosea A. Hamilton, of Oneonta, Otsego co. N.Y.; Adaline Buckingham, of Hudson City, New Jersey; Sarah Elizabeth Odell, of Osborn Hollow, Broome co., N.Y.; Fanny Hamilton, of Binghamton, N.Y.; Melvina Wheeler, Osgood C. Wheeler, of Sacramento city, California.

Your are hereby cited and required personally to be and appear before our Surrogate of our county of Delaware, at his office in the village of Delhi, in said county, on the 6th day of December next, at 10 o'clock in the forenoon, to attend the probate of the last will and testament of real and personal estate of Homer W. Hamilton, deceased, which will then and there be offered for that purpose on the application of Betsey C. Hamilton, an executrix in said will.

Given under the hand a seal of office of our said surrogate at the village of Delhi aforesaid, the 11th day of October, 1869.

You are hereby Cited and Required personally to be and appear before our Surrogate of our County of Delaware, at his office in the village of Delhi, in said Count, on the 6th
Day of December next, at ten o'clock in the forenoon, to attend the Probate Of the last Will and Testament of real and personal estate of Homer W. Hamilton, deceased, which will then and there be offered for that purpose, on the Application of Betsey C. Hamilton, an Executrix in said Will.

Richard McGee of said County being duly sworn says that on the 16th day of November 1869 he served personally the written citation on Hyman A. Hamilton and on the 23rd day of November 1869 he served personally the same on Russell D. Baird father of George D. Baird and general guardian of George B. Beard and on the 14th day of October 1869 her sent a copy by mail to Osgood C. Wheeler Melvina Wheeler and Adaline Buckingham.

Hamilton, that said Service was made by delivering to each a copy thereof and showing to each the annexed original.

TO THE SURROGATE OF THE COUNTY OF DELAWARE:

The petition of Betsey C. Hamilton in said County, respectfully showeth: That Homer W. Hamilton, late of Harpersfield in said County, died on the 21st day of December 1868, having previously, as you Petitioner is informed and believes, duly made and executed his Last Will and Testament: That you Petitioner is an Executrix named in said Will: That said deceased was a citizen of the United States, and at or immediately previous to his death, was an inhabitant of said County, and his Will related to both Real and Personal Estate.

Your Petitioner further shows that the heirs and next of kin of said deceased are:
Hyman A. Hamilton of North Hapersfield, Delaware Co. N.Y., a Brother.
Hosea A. Hamilton, of Oneonta Otsego Co. N.Y.
Adaline Buckingham (a Daughter of Harriet Emeline Buckingham deceased who was a Sister of said deceased) residing at Hudson City, New Jersey.
Sarah Elizabeth Odell residing at Osborn Hollow, Broome Co. N.Y.,
Fanny Hamilton residing at Binghamton, N.Y., - children of Harry R. Hamilton deceased who was a brother of said deceased.
Melvina Wheller, Osgood C. Wheeler residing at Sacramento City, California, who are minor children of Hannah Eliza Wheller, deceased who was a sister of said deceased.
George B. Beard residing at Harpersfield, Delaware Co. N.Y., a minor son of Helen J. Beard deceased, who was a sister of deceased.

That the value of said Estate will not Exceed $6000.

Your Petitioner therefore prays that said last Will and Testament may be proved, and Letters Testementary granted thereon according to law.

Hamilton the Petitioner named in the foregoing Petition, being duly sworn, do depose and say that I have read the foregoing Petition subscribed by me, and know the contents thereof, and that the matters of fact therein stated are true; and the matters therein stated on my information and belief I believe to be true.

This certifies that I have received of B. C. Hamilton, executrix of the Estate of H. W. Hamilton, deceased, of North Harpersfield, New-York, U.S.A., the full amount bequeathed me by said H. W. Hamilton.

I further certify that on the 5th of November 1870, I sent from New York City, a receipt to the same effect, which failed to reach the executrix of the Estate aforesaid.
