To all People to whom these presents Shall come Know ye that I George Ten Eick of the town of Davenport County of Delaware and State of New York for and in consideration of the sum of Four hundred Dollars to me in hand paid by Ira S. Birdsall of the said town have bargained Sold remised released and Quit claimed and by these presents do bargain Sell remise release and Quit claim Unto the Said Ira S. Birdsall his heirs and assigns all and Singular my right title interest claim and demand of in and to the following mentioned pieces parcels or lots of land Situate in the town of Davenport aforesaid namely lots number fifteen, number Sixteen, number Seventeen in the Charlotte river patent, on the South Side of Said river. To have and to hold the Same to the Said Ira S. Birdsall his heirs and assigns, to his and their only proper use benefit and behoof forever, after the first day of April one thousand Eight hundred and forty three Provided always and these presents are upon the Express condition that if the Said George Ten Eick his heirs Executors or administrators Shall pay or cause to be paid the Said Ira S. Birdsall or to his heirs Executors administrators or assigns the just and full Sum of four hundred Dollars together with the interest annually at any time between the date of these presents and the first day of April in the year one thousand Eight hundred and forty three there and in that case these presents Shall cease and be void, and the Said Birdsall Shall relinquish the claim he has hereby obtained to the above mentioned Several lots unto the Said George Ten Eick but in case the Said payment Shall not be made within the time above mentioned then the Said Ira S. Birdsall Shall without any let hindrance process or further proceedings be legally possed of and fully interested with all my right title and claim in and to the Said Several lots above mentioned.
In testimony whereof I have hereunto Subscribed my name and affixed my Seal this 4th day of January in the year 1838.

Before me came George Ten Eick 2nd to me well known to be the persons named in and who Executed the within Instrument and acknowledged that he Executed the Same voluntarily for the interests and purposes therein mentioned.
