This Indenture made the seventh day of January in the year of our Lord one thousand eight hundred and forty four Between George Ten Eick 2nd and Mrs Sarah Ten Eick of the town of Davenport in the County of Delaware and State of New York, of the first part and Martin Van Deusen of the town of Harpersfield, county and state aforesaid of the Second part
Witnesseth, that the said parties of the first part for and in consideration of the sum of thirteen hundred dollars to them in hand paid by the said party of the Second part, the receipt whereof is hereby acknowledged, have granted bargained, sold, remised, released, aliened and confirmed and by these presents do grant, bargain, sell, remise, alien and confirm unto the said party of the Second part in his actual possession now being, and to his heirs and assigns forever all that certain piece or parcel of land situated in the town of Davenport in the Charlotte River patent South side of the river and is parts of Lots numbered 16+17 in said patent, and is the portion of land set apart to Henry Ten Eick and Henry Sornberger in the division of lands made by the heirs of George Ten Eick deceased, and is bounded as follows in the north by the centre of the Charlotte River, on the East by lands of Andrew G. Ten Eick, South by the centre of the highway leading from the from the Charlotte turnpike road across the Charlotte River and west by lands of Isaac Pierce Jr. containing according to the Survey of Isaac Burr Esq. Made May the 20th 1826 Sixty one acres be the same more or less, excepting one acre situated on the Southwest corner of said piece of land now owned by John Birdsall. Together with all and singular the hereditainments and appurtenances there unto belonging or in any wise appertaining , and the reversion and reversions, remainder and remainders, rents issues and profits thereof; and all the estate right title intrest claim and demand whatsoever of the said parties of the first part either in law or equity of in and to the above bargained premises with the hereditainments and appurtenances. To have and to hold the said granted and described premises to the said party of the Second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the Second part his heirs and assigns forever. And the said parties of the first part for their heirs Executors and administrators do covenant grant bargain promise and agree to and with the said party of the Second part his heirs and assigns the above bargained premises & every part and parcel thereof in the quiet and peaceable possession of the said party of the Second part his heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part of the said premises will forever Warrant and Defend. In witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written.
