1859 INDENTURE - CAMPBELL
This indenture, Made the twenty first day of January in the year of our Lord one thousand eight hundred and fifty nine Between James M. Campbell and Elizabeth his wife of the town of Bovina and County of Delaware State of New York of the first part, and Samuel Campbell of the second part Witnesseth, that the said parties of the first part, in consideration of the sum of Twelve Hundred and fifty Dollars to them duly paid has sold and by these presents does grant and convey to the said party of the second part his heirs and assigns, All that certain or parcel of land situated and being in the town of Harpersfield County of Delaware and State of New York, known and distinguished as part of Lot No. 124, Beginning at the South East corner of Lot No. 123 running thence South 30 degrees East twenty five chains; thence South 60 degrees West eighteen chains to the West bank of the Creek; thence North 35 degrees West two chains thirteen links to a rock; thence South 47 degrees West eight chains and twenty links to the Orchard wall; thence South 63 degrees West three chains seventy five links to a stone wall; thence North 30 degrees West twenty five chains and seventy five links to a stake and stones; thence North 60 degrees East twenty nine chains and sixty two links to the place of beginning, containing seventy three and one half acres of land be the same more of less; except and reserving out of the same, about two acres of land, boundaries as follows: Beginning at the road or highway and running Westerly in the line of lot No. 123 four chains and twenty five links to a stake; thence Southerly one chain; thence Eastwardly seven chains and twenty five links to the said highway; thence on said highway four chains to the place of beginning, containing nearly two acres of land being more or less, With the Appurtenances and all the estate title and interest therein of the said parties of the first part. And the said James M. Campbell and Elizabeth M. his wife does hereby covenant and agree to and with the said party of the second part his heirs and assigns that the premises thus conveyed, the in the quiet and peaceable possession of the said party of the second part his heirs and assigns will forever Warrant and Defend against any person whomsoever lawfully claiming the same or any part thereof, In Witness Whereof, the parties of the first part has hereunto set their hands and seals the day and year first above written, Sealed and signed in the presence of me, an acting Justice of the Peace of the town of Bovina this 24th day of January in the year of our Lord 1859 Robert H. On this twenty ninth day of January in the year one thousand eight hundred and fifty nine before me, the subscriber, appeared James M. Campbell and Eliza his wife to me personally known to be the same persons described in, and who executed the within instrument, who severally acknowledged that they executed the same; and the said Eliza on a private examination by me apart from her said husband, acknowledged that they she executed the same freely, and without any fear or compulsion of her said husband.
