The Board proceeded to Elect a Chairman upon which, Gabriel S. Mead was unanimously elected.



On motion the Board then proceeded to ballot for Clerk, which resulted in the reelection of Robert Harkness.

The Town accounts of the several towns, including the reports of Coms. of Highways, were passes severally.



Mr. Siver presented an account of $25 in favor of Archibald Hand vs the County, he having paid that sum to the Deputy Sheriff for arresting Henry Signor, charged with stealing a horse from said Hand.

A motion to allow the account being made. Mr. Allaben demanded the ayes and noes.

Ayes - Messrs. George, Waters, Bunnell, Siver & Griffin. -5-

Noes - Messrs. Brown, Elwood, Paine, Parker, Wood, Miller, Penfield, Kentfield, Jackson, Allaben, Burhans & Maples. -12- Account Rejected.



Mr. Siver also presented an account in favor of John Archer for services in same matter. Rejected by a vote same as above.



On motion of Mr. Maples the following order was allowed by the Board ~

Resolved, that in the opinion of the board, the account of Ezra G. Hoag, Collector of School District No. 5 in the Town of Tompkins, for damages, costs & expenses paid by hm for & on account of a judgment obtained by Arnold S. Day against him as such Collector, amounting to $4.81 ought justly to be paid to him, and a majority of all the members elected to the Board hereby order & require that the said amount be paid to the said Ezra G. Hoag by said School District No. 5 of Tompkins.



On motion of Mr. Allaben

Resolved that the Clerk of the Board of Supervisors be authorized to enter lots assessed as non resident for highway purposes & not formed on the assessment rolls for the current year, for the purpose of collecting the tax levied on such lots for such purposes.



Adjourned to 6 1/2 p.m.



Met pursuant to adjournment at 6 1/2 p.m.



The Committee on the Equalization of Assessment Rolls, reported in substance as follows ~ That there be added to the assessed value of the real estate of the Town of Andes 3 percent, making an increase of about $11,000; to Bovina 3 per cent making an increase of about $7000; to Meredith 5 per cent making about $15,350; to Harpersfield 4 per cent making about $14,000. That three be deducted from the assessed value of the real estate of the Town of Hamden 4 per cent making a deduction of about $14,000; from Hancock 3 per cent making about $11,000; from Middletown 5 per cent making about $19,600 and from the Town of Masonville one per cent making about $2,650.

On motion of Mr. Maples the report was adopted.



The Board then proceeded by resolution to elect five Turnpike Inspectors, which resulted in the unanimous choice of the following named persons, viz ~

David M. Dart of Roxbury, William Parker of Davenport, Stephen M. Betts of Franklin, Thomas Marvine of Walton and Lemuel Sines of Middletown.



On motion of Mr. Parker

Resolved that accounts presented for allowance at the present meeting of the board & rejected for informality, may be allowed at the second or adjourned meeting of said Board.



On motion of Mr. Elwood,

Resolved that there be raised, levied and collected the sum of $250 for highway purposes on the aggregate of the taxable property of the Town of Colchester.

Thursday morning



Mr. Allaben moved that a Resolution be passed, directing the Clerk of this Board to furnish each of the papers published in this Village with a full & complete copy of the proceedings of this Board for publication at their discretion in time for its appearance in the first issue after the adjournment of this Board. The motion having bee seconded, the ayes and noes were demanded by Mr. Allaben.

Mr. Burhans offered the following -



Resolved that the Resolution passed by the Board of Supervisors on the 14th day of November 1851, declaring that in the opinion of this Board, rents reserved in leases in fee, or for one or more lives, or for a term of years exceeding 21 years, are not subject to taxation, under the act entitled "an act to Equalize Taxation" passed May 13th, 1846 for School District purposes and that the Treasurer of the County be advised not to pay the Trustees any such taxes in the event of their non payment in the District in which they were assessed be rescinded and that the Clerk of the Board serve a copy of this resolution of the County Treasurer.







A motion to pass the Resolution being made, the ayes and noes were demanded by Mr. Allaben.

Mr. Bell presented an account against the County in favor of James R. Allaben, of $178.36, that being the amount of Judgment rendered against Contine Connelly & Ira Whitcomb, Overseers of the Poor of the Town of Middletown, in favor of said Allaben.

On motion the account was laid over to the next meeting of the Board.



Mr. Maples, from the Committee to Settle with Treasurer, reported. Report on file.



On motion Board adjourned to 1 1/2 p.m..



Met pursuant to above adjournment at 1 1/2 p.m.



Mr. Allaben, from the Committee to Settle with the Sheriff, reported. That they had examined the accounts of the Sheriff, Under Sheriff & Jailor & believe them reasonable & correct. The accounts were presented as part of the report. Report adopted & placed on file on motion of Mr. Parker.



The Report of Wm. Gleason, Jr., Co. Judge, which was presented to the Board on Wednesday, adopted & placed on file.



Resolved that the list of Grand Jurors prepared by the Supervisors of the several Towns & handed to the Clerk, be the Grand Jurors for the ensuing year.



Mr. Parker from the Committee to Examine Justices and Constables accounts, reported. The accounts as adjusted by said Committee, were passed by the Board.



The Committee to Settle with the Supts. Of the Poor reported that they had examiend the books of the Superintendents and find disbursements therein charged for the current year, to the amount of $2652.80 for all which accounts the Supts. Presented satisfactory vouchers. Report adopted.



On motion adjourned to 6 1/2 p.m.

Board met pursuant to adjournment.



The account of Wm. Murray, Jr., Dist. Atty. allowed at $161.98.





On motion of Mr. Parker,

Resolved that there be raised a state tax of one quarter mill on a dollar on the valuation of the real & personal property in the County.



On motion of Mr. Allaben,

Resolved that all names on the Military Rolls of the several towns in the County liable to pay a commutation of fifty cents be transferred to the corrected assessment rolls of said Towns, and that the same be levied & collected of such persons at the same time in the same manner as other taxes are collected.



Adjourned to 8 1/2 a.m. Friday on motion of Mr. Parker.



Board met 8 1/2 a.m. pursuant to above adjournment.



On motion of Mr. Maples the following order was allowed by said Board.

Resolved, that in the opinion of the Board, the account of Dennis Wolcott, Trustee of School District No. 8 of Delhi & Meredith, for damages, costs & expenses, paid by him for & on account of a judgment against him, Chs. Post & Jotham Scudder, as Trustees, in favor of Robert Oliver, amounting to $39.41, ought justly to be paid to him, and a majority of all the members elected to the board, hereby order and require that the said amount be paid to said Wolcott by said School District No. 8 of Delhi & Meredith.



Mr. Murray, on the part of the inhabitants of said District, objected to the right of the Board to make an order on the matter, claiming that they had no jurisdiction of the subject.



Mr. Edgerton presented an account in favor of David Horton against school Dist. No.12 of Colchester and asked to have the same allowed against said District. The account amounted to $72.20/100 & was for damages, costs & expenses paid by said Horton as Trustee of said District by & on account of a judgment against him as such Trustee in favor of Wm. H. Fuller & Geo. H. Fuller.



Mr. White appeared on the part of the district to oppose the claim.



A motion being made to allow the account against the District, the ayes & noes were demanded, which resulted as follows:

Noes Messrs. George, Paine, Waters, Bunnel, Allaben, Burhans, Siver & Maples. 8 Motion lost.



The vote refusing to allow the account of said Horton, against said School District, was reconsidered on motion of Mr. Allaben.

Mr. Edgerton then withdrew the account. Mr. Allaben offered the following resolution:



Resolved that the distinction between Town & County Poor, in the County of Delaware be revived & that non residents, idiots & insane persons be supported by a County Tax & that all other persons be supported by a Tax on the Town in which they reside.



On motion the Resolution was laid on the table. Mr. Allaben consenting.



On motion, Board adjourned till 1 1/2 p.m.

Board met pursuant above adjournment.



Mr. Burhans presented an account in favor of Edward R. Saterlee, against the Co. for taxes paid on property assessed to h im, which he did not own.

On motion to allow the account the ayes and noes were demanded by Mr. Wood.

Mr. Burhans presented an account in favor of Garret Wallace for iron & work in repairing jail. Account rejected by 1 vote of Board.



Board then adjourned to visit Poor House.

Board met at 6 1/2 p.m. Roll called & all present.



The resolution to revive the distinction between Town & County Poor, was taken up on motion of Mr. Burhans.



Mr. Parker moved to postpone the question indefinitely. Ayes and Noes demanded on this motion.

Mr. Parker then moved to postpone the subject to the next annual meeting of the Board in order that the several Towns may have an opportunity to examine & discuss the expediency of the proposed change.

The following Resolution was offered by Mr. Burhans & passed.

"Whereas the practice adopted by the overseers of the Poor of many of the Towns of granting orders for temporary relief (designed it is believed to be applied only in cases of temporary emergency & when the subject of such relief cannot be removed to the County Poor House) has become an abuse, and in its effects greatly & unnecessarily increasing the expenses of the County. Therefore, Resolved, that in the opinion of the Board of Supervisors of the County of Delaware, the Poor Laws of this State ought to be so amended, as to make all orders for the temporary relief of the poor, made by Overseers of the Poor, a charge upon the Town in which such relief is granted & that the Clerk of the Board transmit a copy of this resolution to both branches of the Legislature of this State at the opening of its next session for its action thereon."



The vote refusing to allow the account of Garret Wallace was reconsidered on motion of Mr. Maples. Mr. Parker moved to h ave the account passed at $9.50 that being the full amount. Mr. Waters moved to amend so as to allow the account at $7.00.

Mr. Waters motion for an amendment being withdrawn, the ayes and noes were demanded on Mr. Parkers motion. The motion was lost by the following vote:

Mr. Parker then moved to allow the account at $8.00. Ayes and Noes demanded.

The Board then proceeded to designate by ballot, the papers to publish the Session Laws, which resulted in the choice of the Delaware Gazette & Deposit Courier.



On motion of Mr. Allaben,

Resolved that there be raised, levied & collected, on the Taxable property of the several Towns in the County, the sum of $6000, to defray County expenses.



Also, the sum of two thousand five hundred for the support of the Poor in said County. The Board, by resolution, directed the County Canvass to be published in the Delaware Express & Delaware Gazette.



On motion,

Resolved that the County & Town accounts & proceedings on the Equalization of the Assessment Rolls be published in the Delaware Gazette & Delaware Express.





The committee to Examine Co. Buildings reported. Report on file.



On motion

Resolved that the Clerk of the Board be required to collect all the books, pamphlets & other documents belonging to the Board of Supervisors, & present them to the Board at the next meeting.



Board adjourned to 8 a.m. Saturday.

The vote allowing the account of Burr Lyon was reconsidered & the account laid over to next meeting on motion of Mr. Parker.



On motion of Mr. Parker

Resolved that a Committee of three persons be appointed by this Board to report a suitable place for a new jail & to estimate the probable expense for the erection of the same & report the same at the next meeting of this Board.

Resolved that Daniel Rowland, Horace Griswold & G. H. Edgerton, Esqs. constitute said committee.

On motion Board adjourned to meet at 1 p.m. on the 14th day of December, next.









SECOND MEETING, Dec. 14, 1 p.m.



Board met & roll called, all present, except O. M. Allaben. After transacting some business, Board adjourned to 6 1/2 p.m.

6 1/2 p.m. board met.



Mr. Gordon presented an account in favor of Amos N. Ensign, for services as Constable in arresting Hinckley Woodmancy, charged with obtaining goods under false pretenses, rejected on motion of Mr. Waters.



Board adjourned to 8 1/2 Wednesday morning.



After meeting of the Board the Committee to settle with the Co. Treasurer reported, report accepted & filed.



The annual report of the Superintendents of the Poor was presented and read by Mr. McDonald, one of the Superintendents. Report accepted on motion of Mr. Elwood.



Mr. Waters from the Committee to settle with the Loan Commissioners, reported. Report accepted.



A Resolution was offered by Mr. Siver, requiring Seth H. White to pay $50 per year rent for the room in the Court House occupied by him as a law office. Laid on the table on motion of Mr. Waters.



On motion of Mr. Parker,

Resolved that the Commissioners of the United States Deposit Fund, be directed to examine into the condition of Mortgage Nos 277 & 280 & the security which the lands mortgaged offered for the payment of the moneys intended to be secured & if in their opinion said loans or either of them are not safe, then they be directed to require further security upon the same, or proceed & foreclose the same if such security is not give as the law requires.



The Committee appointed to examine & report the probable expense & c. of erecting a jail reported. Report filed.



Adjourned for one hour on motion of Mr. Maples. 1 1/2 p.m. board met & roll called.



Mr. Waters moved to take up the resolution offered by Mr. Siver, in regard to the room in the Court House occupied by Mr. White.

The ayes and noes were demanded on the original resolution. All the members present voted no, except the Chairman, he not voting.

Mr. Waters moved that Mr. White be required to pay $25 per year rent from the first day of Jany. next & that Mr. White be informed of the same. Ayes & Noes demanded.

The account of Mr. Allabens. Present at the first meeting, was then taken up for consideration. The account was a judgment costs expenses recovered against Ira Whitcomb & Contine Connelly, Overseers of the Poor of the Town of Middletown, amounting at the time of presentment to $178.36. Mr. Allaben asked to have the same assessed, levied & collected as other contingent charges of the County.

On motion to allow the same against the County the ayes and noes were demanded. All members voting in the negative except G. S. Mead, Chairman, not voting & O. M. Allaben, absent.

A like motion was then made to assess, levy & collect the same against the Town of Middletown & ayes & noes demanded. Vote same as above.



On motion of Mr. Parker

Resolved, that the laying before this Board of a certified copy of the docket of the judgment or the record there of, presented by James R. Allaben & in his favor against Ira Whitcomb & Contine Connelly, Overseers of the Poor of the Town of Middletown, to be assessed, levied and collected of the Town of Middletown or County of Delaware be and the same hereby is waived & dispensed with, the original judgment roll having been duly presented.



On motion of Mr. Maples the account of Mr Lyon which was laid over from the first meeting was taken up.

Resolved that a committee of 3 be appointed to examine said account & report this evening. Maples, Parker, Allaben & Burhans were appointed such committee.



On motion of Mr. Parker,

Resolved that in the opinion of this Board, the condition of the present jail of the County is such, that it requires to be rebuilt or repaired.

A committee of 3, consisting of Messrs. Waters, Bunnell & Elwood, were appointed to report a plan for the erection of a jail, similar to the plan proposed by the committee appointed at the first meeting and also a plan to raise the money necessary to erect the same.

The committee appointed to recommend a plan for the erection of a jail & c. reported. Report accepted & filed.



On motion of Mr. Maples,

Resolved that the time for the collectors of the several Towns to make their returns to the County Treasurer, excepting the Towns of Delhi, Franklin, Kortright, Harpersfield, Stamford & Meredith, be extended to the 15th day of Feby. 1853.



On motion of Mr. Allaben

Resolved that the County Treasurer be & he hereby is authorized to examine into the facts & circumstances in relation to the tax imposed on rents reserved in leases in fee or for one or more lives, or for a term of years exceeding 21 years, & returned in paid to his office, in the school district in Meekers Hollow in Roxbury & to issue his warrant & test the legality of such taxation on rents in that one case, if he shall deem it expedient.



On motion of Mr. Allaben

Resolved that the County Treasurer be authorized & he is hereby required to pay to the Supervisors of the several Towns, 3 cents for every name taxed on the military roll of said town who shall appear to have paid by the return of the collectors, out of the military fund.

On motion of Mr. Elwood, adjourned to 8 a.m. Thursday morning.

Mr. Gordon appeared & renewed the application fro the allowance of the account of the Trustees of School District No. 2 of Andes, against said District, which was laid over from yesterday.



On motion of Mr. Penfield,

Resolved that in the opinion of this Board, the account of Peter N. Bassett, Colon Robertson & Silas D. Hilton, School District No. 2 of Andes, for damages, costs & expenses paid by them for & on account of 2 certain suits brought against them as such Trustees by Wm. B. Stoddard & also the account of Colon Robertson, Marcus T. Peake & Peter N. Bassett against said School District for damages, costs & expenses paid by them as such Trustees of said District for & on account of two certain suits brought against them as such Trustees, one of said suits in favor of Henry Dowie & one in favor of Wm. B. Stoddard, in all amounting to $50.23 ought justly to be paid to them the said Trustees and a majority of all the members elected to the Board do hereby order and require that the said amt .be paid to said Trustees by said School District No. 2 of Andes.

And it was further

Resolved that in the opinion of the Board, the account of Peter N. Bassett against School Dist. No. 2 of Andes, for damages, costs & expenses paid by him for & on account of a certain suit brought against him as Trustee of said School District & Peter Drummond in favor of Nathaniel E. Burch & for damages, costs & expenses, paid by him for & on account of a suit brought against him as Trustee of said School District No. 2 & Peter Drummond, in favor of Henry Dowie, Jr. by his next friend Barney R. Johnson & also for damages, costs & expenses paid by him for & on account of a suit brought against him as Trustee of said School District & Peter Drummond, in favor of Agnes Dowie by her next friend Barney R. Johnson, in all amounting to $16.25, ought justly to be paid to the said Peter N. Bassett by said School District and a majority of all the members elected to the Board do hereby order & require that the said amount be paid to said Peter N. Bassett by said School District No. 2 of Andes.



The Committee appointed to examine the account of Burr Lyon reported. Report accepted & placed on file.



Mr. Brown moved to reconsider the vote on the Resolution passed Nov. 15th on motion of Mr. Parker, in relation to the distinction between Town & County Poor. The motion was decided to be out of order.



An appeal being taken from the decision of the chair, the following persons voted to sustain the decision. Messrs. George, Elwood, Paine, Parker, Kentfield, Jackson, Allaben, Siver & Maples. -9- To overrule the decision Messrs. Brown, Waters, Wood, Miller, Penfield, Bunnell, Burhans & Griffin. -8- Decision sustained.



Mr. Elwood & Mr. Parker were appointed to repair the Jury Box in the Court House & were authorized to draw from the Treasurer the necessary funds for the same.



The annual report of the Superintendents of the Poor was directed to be published in all of the papers in the Co.



Resolved that the Treasure be authorized to borrow money to supply any deficiency in the amount raised to meet the current expenses for the year.

The undersigned, a committee appointed by the Board of Supervisors of the County of Delaware, on the 13th day of November, 1852, to report a suitable place for and the probable expense of a new jail for said County respectfully report: That in pursuance of said Resolution they have the subject under consideration and have agreed to submit the following statement -

In their opinion an entire new jail need not be erected, but that a suitable addition may be made to the present one, which will answer the desired purpose. The addition is to be made to the north west end of the present building & is to be twenty four feet wide by eighteen feet deep, of sufficient height to make two stories or tier of cells. Each story or tier to have two cells, each cell to be as near as practicable twelve feet square. The outside wall of the cells to consist of square timber compactly placed together & fastened to each other with iron or other suitable fastings. The timber for such outside walls to be ten inches square of hemlock or hard wood as may be deemed best by the Board, though the estimates of the committee are based upon hemlock timbers. On the inside each story or tier is to be divided into two cells by walls to be made of timbers eight inches by ten. The inside of the cells to be lined with heavy sheet iron to be securely spiked on to the square timbers, upon the iron is to be fastened hard wood plank two inches thick to be fastened by iron spikes upon the outer timbres, the floors to be made as follows, first a course of square timber, eight inches square upon this a course of iron similar to that mentioned for the walls & to be similarly fastened to the square timbers, upon that a course of hard wood, two inch plank & to be spiked to the timbers below, the plank for the floor & walls are not to be jointed at all in the cells except where the floors & walls meet, then the floors & wall are to be dovetailed together, in each is to be place a furnace. Each of the cells is to be warmed with hot air from the furnace, no sinks are to be built in the cells in the place of them tubs are to be used. These to be emptied into an outside sink between the rest of the cells & the present building is to be a hall six feet wide with a flight of stairs leading to the upper cells. The outer side of the outer walls is to be clapboarded & painted, the expenses are estimated at $2000. It is deemed that this amount will be ample to make the building as strong as iron can make it. Your committee in this report do not make or recommend any disposition of the present of the cells as that was not referred to them, all which respectfully submitted.

Whereas the County Jail is in such a dilapidated condition as to render it unfit for the confinement of prisoners, therefore RESOLVED



1st that it is necessary that an addition to the same be erected & that G. H. Edgerton & D. H. Pardee are hereby appointed Commissioners for the purpose of superintending the erection of the same.

2nd RESOLVED that the said Commissioners are hereby authorized to erect an additional to the jail according to the plans submitted to the Board of Supervisors on the 15th Dec. 1852 by G. H. Edgerton, D. Rowland & Horace Griswold, except that the said Commissioners shall have authority to so enlarge the said plans as to make the cells 12 feet by 14 & 9 feet in height if they shall deem such enlargement necessary.

3rd RESOLVED that the said Commissioners are hereby authorized for the purpose of defraying the expense of erecting such building to loan the sum of $2000 in such sums & at such times as may be necessary & give their note or bond for the said sum of money conditional for the payment of the same in annual installments of $500 & interest on the first day of Feby. In each year & said note or bond so given by said Commissioners shall be deemed to be a debt against the County.

4th RESOLVED that the said Commissioners are further authorized to remove the cells in the present jail & furnish the same into suitable rooms for a dwelling if such alterations can be made for the additional sum of $250 together with any surplus that may be of the $2000 provided for the addition & they are authorize to loan the same on the same conditions as the before mentioned $2000.

There has been drawn from the Treasurer, for which we have

issued checks, from Nov. 1st 851 to Nov. 1st, 1852 $2,712.54

Which was expended as follows, to wit:

For provision and clothing for support of the Poor at the County House 1,524.28

For repairing the house & out buildings 50.30

Physician's bill at the Poor House 70.36

Physicians bills in the several towns for out door Poor 119.16

Overseers of the Poor in the several Towns for services 90.37

For relief given by the Overseers of the Poor in the several Towns

and sent to us in the shape of accounts and audited to them and checks given 286.53

Constable fees 22.99

Justices fees 10.31

Counsel fees 5.00

Keeper's salary 350.00

Hired man 123.00

Transportation checks 60.24

Making the whole amount as above for which we have issued checks $2,712.54



The amount of money placed to the credit of the Poor Fund for the year

commencing Nov. 1st, 1851 was $2,500.00

The am't of Excise money rec'd by the Treasurer, and placed to the

credit of the poor fund, was 455.00

There was also the sum of $22.55 from the estate of Mary Ann Golden,

a pauper in the County House, paid to the Treasurer, and added to the

poor fund on the 16th day of June last; and also $13.00 from P. Evans,

a pauper, same date, by John McDonald, one of the Supt's of the Poor, making 35.55

Making the whole amount placed to the credit of the poor fund during the year

ending Nov. 1st 1852 2,990.55

Whole amount of poor money, as above 2,990.55

Whole amount of checks 2,712.54

Leaving a balance in the Treasury of 278.01

The Overseers of the several Towns have drawn from the Co. Treasury

by way of temporary relief orders, (this is an expenditure over which we

have no control) the sum of 749.89

The Overseers of the several towns have also drawn from the Treasurer,

for temporary relief, as state above 286.53

Making in all drawn from the Treasurer by the Overseers of the Poor

for temporary relief $1,036.42



The number of Paupers remaining in the Poor House Nov. 1st 1851 was 65
