At a meeting of the Board of Supervisors of the County of Delaware held at their room of in the Court House in Delhi on the 10th day of November in the year 1846.

Election of Chairman and Clerk



Isaac Burr of Meredith was appointed Chairman and

Amasa J. TenBroeck chosen Clerk.



Presentation of District Attorney's Bill

Several Town accounts were here passed.



The District Attorney, Truman H. Wheeler, here served his bill against the County on the Clerk. On motion ordered Amasa Parker, Esquire Supreme Court Commissioner tax the same tomorrow afternoon at 2 o'clock.



Committee appointed to examine & audit Town Accounts



On motion of Mr. Allaben ordered that a Select Committee be appointed by the Chairman to examine the accounts of the boards of the Town Auditors of the several Towns.

The Chairman appointed the following named persons as such committee, to wit:

Mr. Allaben, Mr. Townsend, Mr. Goodrich



On motion board adjourned until tomorrow morning at 8 o'clock.







November 11th, 1846



Board met pursuant to adjournment. The Chair announced the appointment of the following Standing Committees.



To Equalize the Assessment Rolls

Messrs. Keator, McKinnon, Allaben, Miller, Hutson, Griffin and Peake



To Settle with Treasurer

Messrs. Maples, Bennett & Stott



To Settle with U.S.D.F. Loan Commissioners and Commissioners of Loans of 1808

Messrs. Odell, Edgerton & Townsend



To Settle With Superintendents of Poor

Messrs. Maples, Bennett & Stott, Jr.



To Examine Court House and Jail

Messrs. Edgerton, Hanmer, Hutson



On Motion of Mr. Maples

Resolved That no accounts shall be audited by this board unless presented at its first meeting, except the accounts of the members of said board.



Sanford J. Ferguson's bill as County Superintendent of Common Schools was here presented and passed as claimed with the exception of charges for inspecting teachers which was reduced to 25 cts per teacher.



On motion ordered that the accounts of Mr. E. B. Sheldon County Clerk be put over until the next meeting to be audited.



On motion of Mr. Edgerton the vote allowing Sanford J. Ferguson 25 cts for examining teachers was rescinded and on his further motion it was ordered that he be allowed 50 cts in lieu threof.



The District Attorneys bill was here taxed by Amasa Parker, Esquire, Supreme Court Commissioner, and was audited by the Board at $300.



Board adjourned until tomorrow morning 8 o'clock.



November 12th, 1846



Board met pursuant to adjournment.



The Committee appointed to settle with Treasurer here made their report, by which they33 find the County in debt to the amount of $1411.19. Said report was accepted and is on file.



The Committee appointed to settle with Superintendents of the Poor also made their report, by which it appears that said Superintendents have drawn upon the Treasurer to the amount of $2287.68. Said report was accepted and is on file.



The Equalizing Committee here appeared before the Board that they had raised the following. The following amount per cent on the Real Estate, to wit:

Davenport 6 per ct

Franklin 3 "

Hamden 3 "

Harpersfield 6 "

Meredith 10 "

Kortright 5 "



Mr. Maples moved that the report be accepted. Ayes & Noes were here demanded.

Ayes: Mr. Stott, Mr. Hanmer, Mr. Hutson, Peake, Miller, Griffin, McKinnon, Allaben, Keator, Odell, Bennett, Maples - 12

Noes: Messrs. Goodrich, Edgerton, Harper, Burr, Townsend - 5.

Mr. Morse declining to vote.

So the report was accepted.



The Committee appointed the accounts of the several boards of Town auditors, made their report, which was accepted and is on file.



On motion of Mr. Edgerton

Resolved That an amount equal to the amount of School money furnished by the State, be raised by each Town respectively for the support of Common Schools.



On like motion

Resolvedd That the sum of $2000 be raised and appropriated for the Support of the Poor of the County for the ensuing year.



On motion of Mr. Maples

Resolved That the sum of $350.00 be raised and appropriated for the purpose of finishing and furnishing the fire proof Clerk's Office.



On motion Ordered that the Board proceed to elect a Treasurer by ballot for the ensuing year. Upon canvassing the ballots it appeared that Harvey R. Millard had a majority of all the votes cast & he was thereupon declared duly elected.



On like motion ordered that the Board proceed to elect 3 Superintendents of the Poor for the ensuing year. And upon the canvass of the ballots it appeared that the following gentlemen had a majority of all the votes cast and were declared duly elected. To wit:



George Thompson of Andes

William Laughran of Roxbury

Lloyd Briggs of Sidney



The Treasurer, Mr. Millard, hre presented his bond in the penal sum of $20,000 sureties. Mr. William Millard, Giles M. Shaw, Almiron Fitch. On motion bond was accepted by the Board and approved by the Chairman.



On motion Ordered that the Board proceed by ballot to determine how the County canvass of this should be published.



On motion Ordered that the above vote be rescinded, and that the County Clerk be directed to furnish each of the County papers with a copy of said County canvass.



On motion Board adjourned until tomorrow morning 8 o'clock.









November 13th, 1846



Board met pursuant to adjournment.



The Committee to settle with Justices and Constables presented a written report which was accepted and is on file.



On motion of Mr. Edgerton



Resolved That the Grand Jury lists s made out by each member of the Board at this meeting be the Grand Jurors for the ensuing year.



A motion was made by Mr. Edgerton that the report of the Equalising Committee be amended, and Andes reduced five per cent and Delhi raised five per cent.

Ayes and Noes called for.

Ayes: Messrs. Morse, Goodrich, Edgerton, Harper, Burr, Odel, Maples, Townsend - Eight

Noes: Messrs Stott, Hanmer, Hutson, Peake, Miller, Griffin, McKinnon, Allaben, Keator, Bennet. Ten. So the motion was lost.



The following resolution was offered and unanimously passed



Resolved that in our opinion the late Superintendents of the Poor of the County of Delaware have faithfully and honorably discharged the duties of said office with credit to themselves, and with satisfaction to the County.

On motion of Mr. Edgerton



Resolved that the sum of $8500.00 be raised to meet the County expenses for the ensuing year.



On motion Ordered that if there is not sufficient money raised to defray the expenses of the County that the Treasurer be authorized to borrow a sufficient sum for that purpose.



A motion was made that the vote on the Blacksmith's bill for shoeing the horses of the Sheriffs posse be rescinded.

Ayes & noes called for.

Ayes: Messrs. Goodrich, Edgerton, Miller, Harper, McKinnion, Odell, Maples, Townsend = 8.

Noes: Messrs. Morse, Stott, Hanmer, Hutson, Peake, Burr, Allaben, Keator, Bennett = 9.

So the motion lost.



On motion Board adjourned until 10 o'clock of December next.







Tuesday December 10th, 1846



Board met pursuant to adjournment and proceeded to sign the Tax Rolls and then adjourned for dinner.

After dinner Board met as usual.



A motion was made by Mr. Allaben that an account in favor of Mr. O. N. Steele, now deceased, for services rendered the Delhi and Middletown Turnpike Company, be audited and charged against the County.

Ayes and noes demanded. Those who voted in the affirmative were Messrs. Morse, Stott, Burr, Allaben. Ayes 4. Those who voted in the negative were Messrs. Hanmer, Goodrich, Hutson, Edgerton, Peake, Miller, Harper, Griffin, Odell, Bennett, Maples, Townsend. Noes 12. So the motion was lost.



The Committee appointed to settle with the Commissioner of Loans of 1808 & theCommissioners of the U.S.D. Fund here made their report, which were accepted and are on file.



On motion Ordered that the County Treasurer receive as a compensation for his services the amount of one half per cent on al moneys received and one half per cent on all moneys paid out by him.



On motion

Resolved that the Treasurer be authorized to obtain a loan of $1000 for a period not exceeding 60 days in order to meet a demand in favor of the Comptroller of the State against the County for that amount due on the first day of January next.



On motion of Mr. Morse Ordered that the County printing be done by the three papers therein provided they shall each of them do the same for half pay.



On motion ordered that a Committee of three be appointed for the purpose of conferring with three printers of the County to ascertain the three papers will publish the State laws at the same price that two would do the same for. The chair appointed



Mr. Edgerton, McKinnon & Morse as such Committee.



On motion of Mr. Maples

Resolved That provided the next board shall concur the Board of Supervisors will not hereafter receive and audit any accounts against the County unless the same be presented at its first meeting.



A motion was here made to adjourn which was lost.



On further motion

Resolved the Clerk of this Board receive $140 for his services.



The Committee appointed to confer with the printers reported separately. Mr. Edgerton reported that he had called on Mr. Paine who stated that he would publish the laws for one third of the amount paid two papers. Mr. McKinnon stated that Mr. Brown would do the same. Mr. Morse stated Mr. McCauley thought it working pretty cheap, but that if it was done, he would fall into the measure.



A motion was here made to adjourn which was lost.



On motion of Mr. Edgerton

Resolved That the Board proceed to elect two printers to publish the laws of the State by ballot.

On canvassing the ballots the following persons elected as such printers, viz:



William S. Hawley & Anthony M. Paine



On motion the Board adjourned until tomorrow morning 8 o'clock.



December 11, 1846



Board met pursuant to adjournment.



The late Superintendents here made their report which was accepted and is on file.



Mr. Edgerton offered the following resolution which was adopted.



Resolved That the Committee for building the fire proof Clerk's Office be authorized to allow in addition to the $950, as such amount as they shall be satisfied on examination of the expenses, shall be just for extra work and loss to the builder on the contract above the $950, after the building is complete, not to exceed $450.00.



On motion of Mr. Stott Ordered That the Committee to Superintend the County Clerk's Office be directed to attend the furnishing, as well as finishing of the same.



On motion of Mr. Keator

Resolved That the Legislature be requested to abolish the Office of County Superintendent of Common Schools of this County.



A motion was made by Mr. Odell that Milo B. Sheldon be authorized to fix the indexes of the records of deeds & mortgages in the Clerk's Office of this County pursuant to law, which was lost.



On motion Board adjourned to meet on the 1st Tuesday in January next, at 10 o'clock a.m.

At a meeting of the Board of Supervisors of the County of Delaware held at their room in the Court House in the Village of Delhi on the fifth day of January 1847, pursuant to adjournment.

The Board having been called to order on Motion Resolved That they proceed to divide the County into 2 Assembly Districts under Section 5 of Article 3 of the Constitution of this State.



Mr. Stott thereupon presented and moved the adoption of the following proposition to divide said county, viz.



"District No. 1 to consist of the following Towns exclusive of aliens and persons of color not taxed - to wit: Colchester, Franklin, Hamden, Hancock, Masonville, Sidney, Tompkins, Walton and Delhi containing an aggregate population of 17650 exclusive of aliens and persons of color not taxed as above."



"District No. 2 to consist of the following Towns, to wit: Andes, Bovina, Harpersfield, Kortright, Meredith, Middletown, Roxbury, Stamford and Davenport, containing an aggregate population of 18531 exclusive of aliens and persons of color not taxed."



Ayes and noes were demanded and on being called by the Clerk the following was the result:



Ayes: Messrs. Morse, Stott, Hanmer, Hutson, Edgerton, Miller Schermerhorn, Burr, McKinnon, Keator, Bennet, Maples, Townsend. 13

Noes: Messrs. Goodrich, Peake, Harper, Odell, Griffin 5.



So the proposition of Mr. Stott was adopted and the County declared to be duly divided in pursuance thereof.



On motion Resolved that this Board proceed by ballot to the election of County Superintendent of Common Schools. Sanford I. Ferguson having resigned. And it appearing that Robert L. Waterbury

had a majority of all the votes cast he was thereupon declared duly elected as such Superintendent.



On motion of Mr. Edgerton

Resolved that his board proceed to ballot for a Superintendent of the Poor in place of Lloyd Briggs who had filed his resignation with the Clerk of the Board.

And it appearing that

John Blanchard

had a majority of all the votes cast, he was thereupon declared duly elected.



Orson M. Allaben's bill as Commissioner of Delhi and Middletown Turnpike Company, was here presented and audited against said company at $37.



On motion of Mr. Maples

Resolved That the Clerk be allowed the sum of $8 for his services at this session of the Board.



Onmotion Board adjourned sine die.

On motion Richard Morse, Esquire of Andes was chosen Chairman and the Board proceeded by ballot to fix and determine the salary of the County Judge of Delaware County about to be elected.



After several ballotings on motion

Resolved That the salary be and the same hereby fixed at One Thousand dollars per year. Ayes 9. Noes 5.



Resolved That the Surrogate to be elected have the privilege of using the old Clerk's office at present occupied by the County Clerk, as his office, if he shall see fit and choose to do so.



On motion the Board then adjourned sine die.

Board met pursuant to adjournment. The Chairman announced the appointment of the following Standing Committees.

Mr Morse of Andes here presented an account in favor of Cyrus Burr which was audited against the Delhi and Middletown Turnpike Company.



On motion of Mr. Morse

Resolved That the County canvass be published in the three Delhi papers.



On motion of Mr. McDonald

Resolved that a bill presented by James Dougherty, Matthew McLaughry and James R. Graham, Trustees of School District No. 16 in Kortright for expenses costs and charges in defending a suit brought against them and Matthew R. Merwin as such Trustees and as collector of said District brought by John Brown in a Justice's Court originally and finally decided in the Supreme Court be allowed as presented by them, and that said District pay the same and be that the present Trustees of said District be directed to issue a warrant for the collection of the same according to the Statute in such case made and provided.



An application was here made by the heirs of Cornelius R. Fitch, decd. Peter P. Wright and Henry Odell of the town of Delhi for an increase of the damages sustained by them in consequence of the laying out and ------- of a public highway or road through their lands as assessed by a Jury from the Town of Bovina on an appeal by the supervisor of the town of Delhi from the assessment made by Commissioner of Highways of the first class and two assessors of the said Town of Delhi.



On motion of Mr. Morse

Ordered that the application be referred to Edwin More County Judge of said County of Delaware.



On motion of Launt

Ordered that the damages be assessed on a Road in the Town of Hamden at $50.

An account presented by Dr. Steele for Doctoring Philander Jones a prisoner was on motion of Mable laid on the table.



On motion of Mable

Adjourned till tomorrow morning at 7 1/2 oclock.



Thursday morning, Nov. 11th 1847

Committees were occupied in preparing reports.

On motion of Mr. Edgerton

Resolved That the action taken by this Board in the Hamden Road matter be reconsidered. On like motion laid on the table.



On motion of McKinnon

Resolved that an amount equal to the amount of school money received from the State be raised by each Town respectively for the support of Common Schools in said County.



The Committee appointed to Settle with Treasurer here made their report by which it appears the county is in debted to Harvey R. Millard, Treasurer, fourteen hundred and sixty four dollars and thirty seven cents (1464.37). The said report was accepted & is on file.



F. James Fitch in behalf of the heirs of Cornelius R. Fitch, deceased, Peter P. Wright and Henry Odell here presented to the Board the report of Edwin More County Judge in the Matter of the assessment of damages made pursuant to the order of the Board and asked the Board to levy and collect the same.



On motion of Mr. Mable

Resolved that the report of the County Judge be laid on the table until the next meeting of this Board.



On like motion of Mr. Morse the above motion was reconsidered.



On like motion it was laid on the table till tomorrow at 10 oclock a.m.



The Equalizing Committee here made their report by which report it appears they have raised the following towns the following amounts per cents on the real estate, to wit,



Davenport 5 per cent Middletown 5 per cent

Kortright 10 " Sidney 10 per cent

Meredith 10 "



On motion of Mr. Edgerton

The Report was accepted and is on file.



A motion was here made by Mr. McDonald to reduce Kortright 5 per cent from the report of the Equalizing Committee which was lost.



The Committee appointed to Settle with the Superintendents of the Poor here made their Report. By which it appears that the Superintendents have expended Thirty seven hundred and four Dollars and twenty five cents. Said report was accepted and is on file.



Keeper of the Poor House also presented an inventory of property in and about poor house (which was read by the Clerk and is on file).



The Committee appointed by Chairman to Settle Justices and Constables accounts here reported. Report was accepted and is on file.



On motion of Morse

Resolved That Silas D. Hiltons account mentioned in the report of the committee appointed to Settle Justices and Constables accounts (be allowed in full).



On motion of Mable

Resolved Dog Tax amounting to one dollar be paid to hire William Yeomans out of the -- funds it having bee sworn off.



On motion of Mr. Stott

Adjourned till to morrow morning at 8 oclock.





Friday Morning November 12th



Board met pursuant to adjournment.



On Motion of Mr. Keator

An account presented by Orson M. Allaben was audited against Delhi and Middletown Turnpike Company in favor of Orson M. Allaben.



A Petition was here presented by Robert M. Hanmer from the Commissioners of Highways of the Town of Colchester for the sum of two hundred and fifty dollars to be raised and allowed them by the county for the support of Bridges in said Town and on motion of Mr. Hanmer the same was audited.



Dewitt C. Thomas here presented his accounts for services as Sheriff & Jailor.



On Motion of Keator a committee was appointed by the Chair to examine said accounts consisting of Messrs. Goodrich, Betts, Keator, Morse and McKinnon.



Abm. Thomas 3d, Under Sheriff, here presented his bill against the county and on like motion of McKinnon it was referred to the same committee.



On motion of Mr. Edgerton

Mr. Wm. S. Hawleys bill (as printer) was laid on the table.



Accounts presented against the town of Davenport in favor of Amos H. Brown & Daniel Gilbert were audited on motion of Morse with the right reserved by the Board to reconsider the same at their adjourned meeting in December.



On motion of Mr. Edgerton

Resolved That the Board of Supervisors of the County of Delaware, through their Clerk, Petition the Legislature of the State of New York to provide for the Election of a suitable person to discharge the duties of County Judge and Surrogate in cases where the present County Judge and Surrogate cannot act.



The matter of damages of the Fitch Hill Road here taken up.



Mr. Samuel Gordon appeared as counsel for Town of Delhi. Charles Hathaway and F. James Fitch appeared as counsel for the applicants for damages.



On motion of Mr. Mable

Ordered that the damages be assessed by the Board as assessed by the Commissioner and Assessors.



On like motion of Mr. Morse the above vote was reconsidered.



On like motion of Morse the road matter was laid on the table. Ayes 15. Noes 3.



Charles Hathaway of Counsel in behalf of the applicant for damages requests and calls on the Board to proceed to take the necessary steps for the lay and collection of the damages assessed according to the report of the County Judge to the several proprietors of the lands through which the road passes and the make no further or other request in the premises.



The foregoing requests is recorded by order of the Chairman.



On motion of Keator Board proceeded to ballot for Treasurer.

On the first ballot Harvey R. Millard received a majority of all the votes and was declared elected.



On motion of Keator the Board proceeded to elect three Superintendents of the Poor for the ensuing year.

On like motion of Keator

Resolved that John Blanchard, George Thompson and William Laughran be and are hereby elected.



On motion

Resolved that his Board proceed by ballot to the election of County Superintendent of Common Schools for the ensuing year and it appearing that Barna R. Johnson had a majority of all the votes was declared elected.



Hamden Road matter here taken up.



On motion

Resolved That the previous quote taken be reconsidered and on like motion laid on the table.



James B. Howe here presented his account for furnishing clerk's office and on motion it was referred to a select committee.



On motion

Resolved that the accounts presented by Mr. Goodrich in favor of Daniel Fisher against School District No. 16 in Davenport and Kortright also on account in favor of Martin Turner against School District No. 16 in Davenport and Kortright be allowed as presented.



The Treasurer here presented his bond and the sureties were approved by the Chairman.



On Motion

Resolved That the Board proceed by ballot to the election of printers to print the Session Laws (which several ballotings resulted as follows)

The Gazette and the Express were declared elected.



A motion was here made by Mr. Morse to reconsider the report of the Equalizing Committee which was lost.



On Motion of Mr. Edgerton

Resolved two thousand and five hundred dollars be raised for the support of the poor for the ensuing year.



On like motion

Resolved that seven thousand and five hundred dollars be raised for county expenses the ensuing year.



On motion of Edgerton

Resolved that the Treasurer be authorized to borrow money in case of deficiency.



On motion

Resolved that 10 copies of the State Census of 1845 now in the Clerk's Office be sold to the highest bider at 9 a.m. Thursday December 11th, 1847.



On motion adjourned to December 8th 1847.



December 8th, 1847



Board met pursuant to adjournment.



The forenoon was occupied in Signing the Tax Rolls. On motion adjourned for dinner. After dinner Board met pursuant to adjournment.



The Superintendents of the Poor here presented their report which was read by the Clerk (on request) accepted and is on file.



On motion of Mr. Stott

Resolved that the Clerk of this Board received $140 for his services.



On motion of Mr. Morse

Resolved that an account presented by William H. Copley of $10. James McCulloch of $5 and Ebenezer Mitchell of $10 be audited against the Middletown and Delhi Turnpike Company.



Truman H. Wheeler's bill as District Attorney was here served on the Clerk levied by Judge More at $300 and allowed by the Board.



On motion the Fitch Hill Road matter was here taken up. F. James Fitch in behalf of the heirs of Cornelius R. Fitch deceased Peter P. Wright and Henry Odell the owners of the land through which the highway has been laid out and ---- asked the Board of Supervisors to levy and collect the amounts of damages assessed by Judge More on a reference to him at the last Session of the Board on occasion of the laying out of the Highway through the said lands.



Mr. Gordon appeared for the Town of Delhi.



The following Resolution by Mr. Keator was adopted.



"Resolved in consequence of the claimants for damages refusing to accept of the decision of the Jury, that the same be dismissed."



The 10 copies of the State Census were here sold by chairman for $10.60.



On motion

Resolved that the chairman pay the same to the Treasurer.



The Committee to Examine the Sheriff's and Under Sheriff's account here reported. Which report was accepted and on motion amended by adding one shilling per search to the Board Bill Dec. 9th 1847.



On motion of Mr. Morse

Resolved that the list of Grand Jurors as made out by each member of the Board be the Grand Jurors for the ensuing year.



On motion of Mr. Stott

Resolved that the vote taken in auditing the accounts of Daniel Gilbert and Amos H. Brown against the Town of Davenport be rescinded in consequence of the commissioners note having filed their survey in the Town Clerk's Office.



The committee appointed to examine James B. Howes account here reported. Report was accepted and is on file.



On motion of Mr. Mable

Resolved that Samuel Gordon be and he hereby is authorized to receive and accept service of notice for us of papers and notice of motion on the motion of the Heirs of Cornelius R. Fitch decease, Peter P. Wright and Henry Odell for a mandamus directing the Board of Supervisors of the County of Delaware to levy and collect the damages assessed by E. More, Esq. County Judge to the heirs of Cornelius R. Fitch decease, Peter P. Wright and Henry Odell or such other order as the court may grant.



The matter of School District No. 16 in Kortright here taken up. Mr. Gordon presented a memorial from the inhabitants of said district and asked the Board to reconsider their vote taken at a former meeting.



On motion of Mr. Morse

Resolved that this Board take no other on further action in the above matter.



The Committee appointed to Settle with Commissioners of Loans and the Commissioners of the United States Division Fund here made their report which was accepted & is on file.



On motion of Mr. Morse

Resolved that Wm. S. Hawley have the privilege of adding thirty three & one third dollars to his Co. account for printing the Session Laws (which was done).



On motion of Morse

Resolved that the proceedings of this Board be published in the three Delhi papers, provided each will publish for half price.



On motion of Mr. Edgerton

Resolved that a notice to be published requesting the assessors of different towns to assess all days liable to be assessed under the Statute.



On like motion

Resolved that a notice be published that no accounts will be allowed at the adjourn meeting of the Board of Supervisors.



On motion

Resolved that Mr. Launt have the privilege of taking the papers in relation to the Hamden Road off file.



On motion the Board adjourned Sine Die.
