At an annual meeting of the Board of Supervisors of the County of Delaware held at the Supervisors Rooms in Delhi, Nov. 12th, 1867.

On motion Edwin B. Smith was admitted to act as Substitute for the Supervisor of Hancock.

The Board was then organized and the ballot for James H. Graham was chosen Chairman and Robt. Gemmel, Clerk.

On motion of Mr. Foote, the following resolution was adopted:

No. 1 - In obedience to th Mandamus to us made of the Supreme Court upon present (?) Writ of the (?) of Charles Marvine, President of &c in behalf of the Delaware Bank its successor the Delaware National Bank of Delhi

Resolved that the $75,000 additional assessment inserted in the assessment roll of the Town of Delhi for the year 1865 & assessed against said Delaware Bank & inserted in the tax roll of said Town for said year & the tax of $1599 imposed thereon be & the same are hereby stricken from & out of said assessment & tax roll & annulled & all acts to the contrary are hereby rescinded & (?).

On motion of Mr. Foote, the following resolution was adopted:

Whereas the Judgment rendered in the Supreme Court in favor of the relative in an action of the People upon the relative of Charles Marvine, President & c against the Board of Supervisors of Delaware County answering a (?) Writ of Mandamus against said Board with costs & whereas it appears by said Board that the judgment for said costs will on the 1st day of February next amount to $175.52 it is hereby ordered & resolved that said sum be allowed against & levied in the taxes upon said County & the same is directed to be paid to Wm. Gleason, Atty for the relative in payment of said costs.

The Treasurer then presented a statement of rent tax uncollected for the year 1866 & Military tax unsettled for the year 1866 & Statement of Quid Tax for 1866 which on motion was received & placed on file.

Mr. Dowie presented lists of non performed highway labor for the Town of Andes. On motion ordered taxed on the several individual on motion of Mr. Dayton

Resolved that the several Supervisors be allowed to present to the Clerk the several lists of unperformed highway labor in the several Towns and that the Clerk be instructed to levied the same as charged therein.

On motion

Resolved that the Board refuse to take action in relation to the disputed matter in relation to Highway labor n the Town of Masonville.

Mr. Mead presented a memorial of the assessors of the Town of Walton asking that several persons omitted in 1866 be assessed & taxed as in 1866. Allowed and ordered taxed as prayed in the memorial.

On motion of Mr. J. H. Graham, an account of $10 of Samuel Garret and an account of $14 to Charles Reynolds for overpaid taxes was allowed & charged to the Town of Delhi.

On motion of Mr. John G. Graham

Resolved that on the presentation to the Clerk of the Board of a petition of the assessors of the Town of Meredith for the correction of the roll of said town that the Clerk be directed to correct the roll & levy and tax the individuals as prayed in the memorial.

On motion of Mr. J. G. Graham, a committee of three was appointed to examine and report as to the matter of the correction of the assessment rolls by this Board with authority to take Council if necessary. The Chair announced as such committee Messrs. J. G. Graham, Wattles & Champlin.

Mr. Champlin presented a petition on appeal from an assessment in the Town of Colchester. On motion the same was referred to the special committee above named.

In the matter of the appeal of Wm. O'Connor. On motion ordered that the Clerk be directed to return the papers to the appellant and that the prayer be not granted.

On motion the Board adjourned to 7 p.m.



Seven p.m.

Meeting called to order by Chairman. Roll called and a quorum being present the following resolution was adopted.

F. W. Foote moved that he be allowed to withdraw Act No. 15 of Const. & Justice's acts & place the same with the Sheriff's acct. Motion carried.

The special committee on Court House appointed in 1866 made their report. On motion of Mr. Dowie the report was accepted and placed on file.

The Committee on correcting assessment rolls made their report. There report ordered accepted & placed on file & the committee discharged.

On motion of Mr. Owens, a committee of three was appointed to examine the propriety of correcting the assessment roll of Tompkins and such other alteration as may come before them.

Messrs. Owens, Dibble & Elliott were appointed such committee.

The Commissioners of Excise having made their annual report it was moved & carried that the report be received & placed on file.

Moved & carried that the Board adjourn to meet at Court House at half past eight o'clock, Nov. 14th, 1867.



8 ½ A.M., Nov. 14th, 1867

Board called to order by the Chairman. Roll called & quorum found present. Minutes read and adopted.

Mr. Dibble presented petition of the R. R. Comm. of the Town of Davenport asking for 2100.00 to pay interest on Rail Road Bonds. On motion allowed & ordered charged on the Town of Davenport.

Mr. Wattles presented a like petition of Commissioners of Sidney asking for $7066. On motion allowed & charged on Sidney.

Mr. Mead presented resolution of a Town meeting of Walton in relation to erecting County Building. On motion the same was received & placed on file.

The Superintendents of the Poor presented a statement of the several poor persons supported at the County Poor House for the current year together with the expense & the towns to which chargeable. On motion the same was received & placed on file.

On motion of Mr. Foote the several sums which the different Towns are found indebted to the County Poor Fund be charged on the several towns.

On motion of Mr. Foote the Town of Meredith was allowed the sum of $155.91 against the County to be placed to the credit of the Poor Fund of the Town of Meredith.

On motion the sum of $165.36 was charged on the Town of Tompkins. The same to be placed to the credit of County Poor Fund. The same being for poor belonging to said Town supported at the expense of the County.

The Treasurer presented Comptrollers Statement of Taxes returned as rejected. The same was received and placed on file.

William L. Axtell having presented a petition & claim for expenses in pursuing horse thief.

Mr. Bolt moved that the be allowed $150 against the County. Ayes and Noes called on the motion. Ayes - Messrs. Bolt, G. H. Graham, Owens, Smith & Wattles. 5 Noes - Champlin, Dibble, Dayton, Dowie, McCune, Mead, Newkirk, Rich, Salton & Sines. Noes. 9. Motion lost.

Mr. Mead moved that Mr. Axtell be allowed $75. Ayes and Noes called whereupon the members present voted unanimously. Motion carried. Mr. Dowie called to the Chair.

The box containing claims was then opened & the claims found therein were numbered & referred to the proper committees.

On motion of Mr. Owens

Resolved that the Board visit the County Poor House & Farm at ½ past one this afternoon.

On motion adjourned until 7 p.m.



7 p.m., Nov. 14

Board met pursuant to adjournment. Called to order by Chair. Roll called. Quorum present.

The U.S. Deposit Fund commissioners presented the Book of Mortgages kept by them for the examination of the Board. On motion of Mr. Foote

Resolved that Charles A. Foote, County Treasurer of Delaware County be & he hereby is authorized and instructed to appeal the cases in the Supreme Court instituted by him against Mary Overing & Henry C. Overing to the General Term. The same to be done at the expense of the Town of Stamford.

The box containing Co. Claims was in motion produced & the claims therein were numbered and referred to the proper committee.

On motion of Mr. Owens

Resolved that the Clerk be authorized & directed to amend the assessment roll of Tompkins providing the assessment of that Town. File with the clerk the proper petition or memorial the roll to be corrected according to the prayer of the memorial.

Mr. Foote presented a petition of the Town Board of Stamford asking the County to refund certain taxes illegally paid by said Town. The same was on motion referred to special committee.

Special committee: Messrs. Dowie, Owens & Dibble.

A like petition of Charles Noble & others was presented & referred to the same.

On motion, account No. 78 was withdrawn from the committee on County Claims & referred to the same committee.

On motion the Board was then adjourned until 8 a.m., Nov. 15th.









8 a.m., Nov. 15, 1867

Board met pursuant to adjournment. Roll called. Quorum present. Minutes read and accepted.

The standing committee on County Treasurer's report made report which on being read was received & adopted & committee discharged.

The committee on the U.S. Deposit Fund made report which after being read was received & adopted and the committee discharged.

The committee on Poor House & Supts. report made their report which after being read was adopted & the committee discharged.

On motion of Mr. Foote

Resolved that the sum of $70,781.41 be levied upon the taxable property of the County being the amount of State tax as per Comptroller's Statement.

The box containing claims was then produced & the claims therein nos. & referred to the proper committees.

On motion of Mr. Foote the box was declared closed for the session.

Mr. Mead presented the following resolution which was adopted:

Resolved that the sum of one hundred dollars be raised for the purpose of protecting bank of the Little Delaware on the Poor House Farm to be expended under the direction of the Superintendents of the Poor.

Mr. Mead called to the Chair.

The Superintendents of the Poor then presented their annual report which on being read was received &placed on file. And on motion of Mr. Foote the sum of $1200 was ordered levied on the County for County Poor Fund

On motion of Mr. Foote the sum in which the Towns are indebted to the County Poor Fund as per Treasurer's statement be levied on the respective Towns. To the Co Poor Fund, the special committee as to correction of assessment rolls made report. Reports received & adopted and committee discharged.

Mr. Champlin presented the non resident highway labor assessed in the Town of Colchester. On motion ordered assessed in the several lots and the amount made payable to the Treasurer subject to the draft of the Commissioners of Highways of the Town. Mr. Smith presented a like list for Hancock. Same disposition.

Mr. Owens presented a like list for Tompkins. The same disposition. Mr. Dowie presented a like list for Andes. Same disposition.

The Board of Commissioners of Excise presented a petition asking for instruction as to presenting of violations of excise law.

On motion that petition was received & placed on file and a special committee of three was appointed to consider same & report at the next meeting of the Board.

The Chair announced as such committee-Messrs. Bolt, Newkirk & Mead.

The Committee on Constable & Justice's accounts made report which after being read was received and adopted & the accounts allowed as recommended therein.

The committee on Town accounts made report which after being read was received and adopted & the several sums allowed & charged as recommended therein.

The committee on Sheriff & Clerk's accounts made report which after being read was received & adopted and the several sums allowed as recommended.

Acts. No. 30, 35, 51, 96, 98 dog accounts referred back to the Supervisors of the respective Towns.

Act. No. 45-46 transferred from Committee on Town accounts to Committee on County accounts.

No. 77 returned to Claimant for information.

On motion the Board adjourned to 2 p.m.

On the Town of Andes quid tax. O. M. Allaben, Josiah Hotchkiss & A. B. Douglass to be reassessed.

On motion of Mr. Foote

Resolved that the sum of twenty thousand dollars be raised on the taxable property of the County for a contingent fund for the ensuing year.

A bill in favor of the N. Y. Institute for Deaf & Dumb was presented and allowed and charged to the County $30.00.

An account of A M Paine, $6.50 against Hancock was presented & allowed & charged on Hancock.

On motion of Mr. Sines the sum of $843.46 was ordered deducted from the aggregate amount to be raised in Middletown for Town purposes. Said Town having now said amount on hand applicable to payment of Town matters.

On motion of Mr. Smith the sum of $170.10 was charged on the Town of Hancock and made payable to Co. Treasurer being amt of Highway Tax made payable by mistake to Commissioners of Highway in 1866.

The Committee on Equalization made report which after being read was received & adopted & the committee discharged.

Mr. Dowie offered the following resolution which was adopted:

Resolved that the Clerk of this Board reduce or increase equalization that the equalization value of the real estate of the several towns that be the same as the aggregate assessed value thereof.

Mr. Owens presented the following which on motion was adopted:

An act to establish of Tolls of the Hales Eddy Bridge Company:

The Board of Supervisors of the County of Delaware at their annual meeting Nov. 15, 1867 do enact as follows:

Section 1 - The Hales Eddy Bridge Company are hereby authorized & empowered to demand and receive the following tolls as compensation for crossing their bridge, to wit:

For every four wheeled carriage or sleigh drawn by 2 animals .20

For every additional animal .05

For every ox wagon, sled or cart drawn by 2 oxen .15

For every additional animal .05

For every one horse carriage, sleigh or sled .10

For every man & horse .05

For every foot passenger .02

For every cow or other neat cattle .03

For every sheep or swine .02

Subject to the statute in relation thereto.

Section 2 - This act shall take effect immediately.

The committee on Court House & Jail then made report setting forth they have examined the Court House & Jail and find repairs necessary and suggest that the sum of $50 be appropriated for such repairs to be expended under direction of Sheriff. Report adopted & committee discharged.

Committee on County Claims made report which was read. On motion the 2 claims of S. C. Johnston. nos.69-70 was stricken from the report of the committee. The report was then received & adopted. The two claims No. 69-70 was referred to the Committee of the whole. The said bills being taken up and considered. On motion the bills were held over for further consideration at the adjourned meeting of the Board.

A. M. Paine presented bill of $8.45 against Colchester. Allowed & charged on Colchester.

On motion of Mr. Dayton

Resolved that when this Board finally adjourns, they adjourn to meet on the 11th day of Dec. next at 7 p.m.

7 p.m. Nov. 15

Met pursuant to adjournment. Roll called. Quorum present.

On motion of Mr. Newkirk the sum of $1385 was ordered deducted from the aggregate sum of taxes to be paid by the Town of Roxbury there now being in the hands of the Supervisors applicable to payment of taxes the said sum of $1585.

On motion of Mr. Newkirk the amt. of rejected taxes of Roxbury $659 was charged on the Town.

A claim of George Smith for storage of canon amounting to $25.00 was presented & rejected.

Mr. Elliott presented a statement of rent tax illegally assessed in Bovina together with costs & disbursements incurred in the attempt to collect the same and moved that the sum of $293.25 be charged on the County & the sum of $352.20 on the Town and made payable to the County Treasurer. Motion lost.

A claim of William Comstock, late Sheriff of Otsego, of $590 was presented and allowed against the County.

Mr. Sines having asked to be excused & Mr. Dayton & Mr. Dibble having also asked to be excused from further action with the Board at this meeting after this evenings session. They were on motion excused.

The committee on printers bills then made report & the same after being read was received & adopted & the several claims allowed as recommended.

The special committee on Bank claims having made report the same was read & on motion received and the committee discharged.

On motion Mr. Foote was allowed to withdraw the Bank claims of the First National Bank of Hobart.

On motion the action on the claim of George Smith of $25.00 for storage of canon was reconsidered and the claim was then allowed at $25.00 against the County.

Adjourned until 8 a.m. Nov. 16th.



8 A.M., Nov. 16th, 1867



Board met pursuant to adjournment. Roll called, minutes read & adopted.

On motion of Mr. Wattles

Resolved that the several Supervisors of the Town be requested to furnish to this Board for its information the amount of property exempt from taxation in each Town under the law exempting the National Guards from taxation.

Mr. Wattles offered the following preamble and resolution

Whereas in the opinion of this Board the Militia Laws of this State are in many of their provision expensive and burdensome to the taxpayers and people thereof - in expending large sums of money in procuring arms and accouterments and in requiring other expenditures for town armories & c and in exempting large amounts of property from taxation thereby increasing the taxes on other property for Town & State purposes, Therefore

Resolved that we respectfully request the Senator from this District and the Members of Assembly from this County to use their best endeavors to secure such alterations in the Military Laws of this State as shall reduce the expenses of the Military Organization as much as possible and equalize the burden of taxation by repealing the exemption clauses of the Act of 1866 & c & c

Resolved that the Clerk of this Board be instructed to send copies of the foregoing resolution to the Senator from this District and to the Members of Assembly from this County and also to the several Boards of Supervisors of this State.

Mr. Dowie moved to amend the first resolution by adding the words and make proper provisions for the payment of said Militia for services required of them by law. Amendment lost. The resolution was then adopted.

On motion of Mr. Foote

Resolved that the resolutions be published in the County paper.

Mr. Foote moved that the erroneous paid Bank Tax of Franklin be disposed of as follows, $2559.45 be assessed to the Town of Franklin & $538.32 be assessed to the County.

Mr. Rich offered the following as an amendment -

Resolved that the whole amount be assessed on the County for the reason that the assessors were coerced by the Board of Supervisors to make the assessment upon the shareholders of the First National Bank of Franklin. Ayes and Noes called - Ayes: Messrs Rich & Smith. 2 Noes - Messrs Bolt, Champlin, Dowie, Elliot, Foote, J.G. Graham, McCune, Mead, Newkirk, Owens, Salton, Wattles. 12. Amendment lost.

Ayes and Noes called on original motion. Ayes: Messrs. Elliot & Foote. 2 Noes: Messrs Bolt, Champlin, Dowie, J. G. Graham, McCune, Mead, Newkirk, Owens, Rich, Salton, Smith, Wattles. 12. Lost.

On motion the Franklin Bank claim for erroneous paid tax were allowed to be withdrawn.

On motion the Board was then adjourned until the 10th day of Dec. at 7p.m.

Minutes of the last days sessions of 1st meeting read and adopted.

Mr. Johnson was allowed to present and read a petition in regard to his claims now pending before the Board.

On motion the petition was received and placed on file.

Mr. Newkirk presented a petition of the assessors of Roxbury asking that certain property be added to the assessment roll of 1867. Petition received and placed on file. On motion of Mr. Newkirk the assessment were directed to be made as prayed in the prayer of the assessors.

On motion of Mr. Rich

Resolved that the tax arising from such assessment and taxation be made a portion to the County & a portion to the Town in the ratio that the Town & County taxes bear to each other in each year.

On motion of Mr. Elliot the sum of $352.20 rent tax was levied on the Town of Bovina.

On motion of Mr. Foote the resolution fixing amount of State Tax was reconsidered and on motion the amount to be raised for State Tax was fixed at $68966.50.

On motion of Mr. John G. Graham the bill of S C Johnston was taken up to be considered by the Board as a committee of the whole and was made the special order for 10 a.m. tomorrow.

On motion the Board was then adjourned until 9 a.m. Dec. 11th.



9 A.M.

Board met pursuant to adjournment. Roll called. Quorum present. Minutes read and adopted.

Mr. Wattles presented an account in favor of Austin Every $10.00 for Armory which was allowed against the County.

Mr. Newkirk presented a file account in favor of E I Burhans of $25.00 which was allowed against the County.

Mr. Sines presented an act which was referred to the committee on Const. & Justice's accounts.

Mr. Wattles presented an account which was referred to the same committee.

Mr. Champlin offered the following which was adopted

Resolved that the salary of the County Judge of Delaware County from and after the 1st day of January, 1868, be and the same is hereby fixed at the sm of twelve hundred dollars per year.

On motion a committee of three was appointed on Supervisors accounts. The Chair announced as such committee the following: Sines, Elliot Hawk.

On motion a committee of three was appointed to apportion the Grand Jurors among the several Towns. The Chair announced as such committee the following - Messrs. Rich, Owens & Newkirk.

Mr. Newkirk moved that the sum of $85.50 be allowed to O. R. Bouton for expense as School Commissioner in 1866. Ayes and Noes called on the motion. Ayes - Messrs. The several Supervisors presented lists for the respective Towns in pursuance to the foregoing apportionment which was adopted as the lists of Grand Jurors for the ensuing year.

A bill of A. M. Paine of $23.42 for stationery & printing was presented and allowed against the County.

Committee on the petition of the Commissioners of Excise asking for instructions as to prosecution & c made report.

Report received and placed on file.

On motion of Mr. Newkirk the following resolution was adopted:

Resolved that the Commissioners of Excise be at liberty to perform their duties as the law requires in enforcing the Excise Law in such Courts and in such a manner as to them may seem best and that they be sustained and encouraged in so doing but they should not call upon the county for any costs and expenses of any prosecutions by the commenced and should out of the penalties of them collected pay all costs and expenses by them incurred with this restriction it is desirable that they vigorously enforce the law.

Mr. Mead moved to reconsider the vote taken on the claim of O. R. Bouton for expenses as School Commissioner. Ayes and Noes called on the motion: Ayes - Messrs. Dibble, McCune, Mead, Newkirk, Owens, Sines, Wattles. 7. Noes - Messrs. Champlain, Dayton, Dowie, Foote, J. G. Graham, J. H. Graham, Rich, Salton, Hawk. 9. Motion lost.

On motion of Mr. Mead the additional sum of $150.00 was appropriated to the purpose of repairing the banks of the Little Delaware on Poor Farm to be expended under the direction of the Superintendent of the Poor to be paid from contingent fund of the County.

The special Committee on the claims of S C Johnson as Atty for Board of Excise made report recommending that Mr. Johnson be allowed the sum of $300 providing he will release the County from all claims on account of such costs, services & disbursements and on his filing with the Treasurer such receipt & release that he be paid the sum of $300 from the contingent fund. Report received and adopted.

On motion the salary of the Clerk of this Board was fixed at the sum of $300.00.

Wm. Murray, Jr., County Judge & Surrogate, having made his annual report the same after being read was received and placed on file.

The Board was then adjourned until 7 ½ P.M.



7 ½ P.M., Dec. 11th, 1867

Board met pursuant to adjournment. Report called. Quorum present.

A bill of Henry R. Graham, late Supervisor of $2.96 was presented & allowed against the County.

On motion the Treasurer was instructed to continue the insurance on the Court House & Jail and the Superintendents of the Poor were instructed to continue the insurance on the County House Building.

On motion the Board proceeded to a ballot for the purpose of indicating two of the County newspapers to publish Session Laws upon which ballot the

Delaware Republican received 7 votes

Delaware Express received 6 votes

Delaware Gazette received 5 votes

The Delaware Republican & Delaware Express having received the highest number of votes were declared duly designated for that purpose.

On motion of Mr. Dowie the following resolution was adopted:

Resolved that the editors of the Delaware Gazette, Delaware Express & Delaware Republican be authorized to do all the printing connected with the proceedings of this Board required by law at the legal rate chargeable for doing the same in two papers and that each paper receive one third the proceeds thereof and that the Delaware Courier be authorized to print the Town and County accounts at legal rates.

A bill in favor of John Calhoun for services as janitor for the Board & c was presented and allowed at $18.00.

An account in favor of John Calhoun, Sheriff, for wood purchased for Court House & Jail amounting to $61.25 was presented and ordered paid from the contingent fund.

On motion the sum of $20.00 stricken from the claim of Norwood Bowne for printing County calendars was restored and the Chair allowed in full.

On motion the Board was adjourned until 7 ½ A.M. Dec. 12th.

REPORT OF SUPERINTENDENTS OF POOR

The Superintendents of the Poor of Delaware County present to the Board of Supervisors the following Annual Report:

There has been expended for the support of the Poor, at the County House, from Nov. 1st, 1866 to Nov. 1st, 1867 the sum of $4,399.95

Which sum includes expenses of clothing, provisions and physician's bills at the house; Keeper's salary and all incidental expenses necessary to carry on the poor house farm.

There have been had by the poor at the house during the year, 2,894 weeks and 5 days board at an average cost of $1.52 per week. Of that number of weeks board, there have been had by the poor belonging to the several towns, for the year ending Nov. 1st, 1867, 2,096 weeks and 5 days board at $1.52 per week, amounting to the sum of $3,186.99

The whole number of Poor supported at the Poor House the year ending Nov. 1, 1867, was 92; of which 35 were County Poor and 57 Town Poor; discharged, 37; died, 8; remaining in the Poor House Nov. 1, 1867, 47; insane 6; idiots9.

The stock on the farm Nov. 1, 1867 was: Three stags; one beef cow; ten cows; one 2 year old heifer; four yearlings; two calves; 20 sheep; 4 fatting hogs; 3 shoats; 50 hens and chickens.

There have been raised on the farm 30 tons of hay, 650 bushels ears of corn, 354 bushels oats, 306 bushels potatoes, 7 bushels peas, 12 ½ bushels beans, 53 bushels buckwheat, 12 bushels onion, 20 bushels carrots, 30 bushels turnips, 6 firkins of butter, 42 yards of wool cloth (made from the wool of sheep).

The Superintendents think the sum of $1200 in addition to the amount due from the several towns will be sufficient for the ensuing year to pay the current expenses.

Whereas, the judgment record in the Supreme Court, in favor of the relator, in an action of the People upon the relation of Charles Marvine, President & c, against the Board of Supervisors of Delaware County, awarding a peremptory Writ of Mandamus against the Board, with costs' and whereas, it appears by said record that the judgment for said costs will, on the 1st day of February next, amount to $175.32; It is hereby ordered and resolved, that the said sum be allowed against and levied in the taxes upon said county, and the sum is directed to be paid to Wm. Gleason, Attorney for the relator, in payment of said costs.
