Annual meeting of the Board of Supervisors held in and for the County of Delaware at the Court House in Delhi on the 13th day of November1866. Supervisors present from the several towns as follows:

The Board was called to order by W. P. Lynch, Clerk of the Board of 1865.

On motion of Mr. Foote, Mr. Alex. Storie was nominated temporary chairman.

On motion Mr. Lewis of Hamden, acting as Supervisor form the Town of Hamden, in place of Mr. Salton, the Supervisor of said town.

On motion of Mr. Foote, Board proceeded to ballot for Chairman:

James H. Graham received 11

A. B. Chamberlain received 6

E. J. Burhans received 1

Mr. Graham having received the highest number of votes was declared Chairman.

On motion of Mr. Foote, Board proceeded to ballot for Clerk.

W. P. Lynch received 11 votes

D. T. Arbuckle received 7 votes

W. P. Lynch declared elected.



Motion made that County Treasurer make report of the amount due the several towns for taxes on rents, said report to be made at the next meeting of the Board.

Co. Clerk ordered to report the date of filing of enrollments of reserved militia of the several towns in the office of the said Clerk to this Board as soon as convenient. Board adjourned to 9 a.m. Nov. 14th.



November 14th, 9 a.m.



Mr. James H. Graham, in the Chair. Roll called and quorum present. Minutes read and adopted. The Chairman announced the Committees as follows:

County Treasurer's Report of Landlord taxes uncollected for 1865 was received and laid on the table for examination. Carried.

Mr. Graham having to be absent, Mr. Wattles was called to the Chair.

The report of Co. Clerk in relation to Reserved Militia was read, received and placed on file.

First Meeting 1866

On motion of Mr. Foote, box of Co. Acts. brought in and the accounts sent to the several committees.

The Co. Teas. made report of rejected taxes from Comptroller from Town of Middletown. Also uncollected Military Taxes and quid tax. Mr. Dowie then moved that they be placed on file.

Mr. Dibble moved to amend the assessment roll of the Town of Davenport as per resolution by adding thereto the following real estate omitted by the assessor this year:

Also that Lot No. 4, Fitches Patent, 180 acres left of assessment of 1865 be added to said assessment roll and levied at the same rate as last. 1865 at $360. A petition was presented from the assessors of Town of Stamford asking that the property of Margaret Jones, deceased, consisting of a house and lot in the Village of Hobart and a lot of land containing 64 acres in said Town belonging then and to David Philips which was omitted, to be placed on the roll for 1865 be entered on the tax roll for this year (1866) according to an act passed April 17th, 1865, Chapter 453, Section 1 of said act. On motion of Mr. Foote, the prayer of said petition was granted.

Mr. Foote moved that the report of the Co. Treasurer in regard to uncollected taxes of Non Resident Landlords be referred to a select committee of three to be appointed by the Chair to examine and report to the Board what action should be taken thereon. Accounts No. 1,2,3,4,5,6,11,12,13,14,15,17,18,21,22,25,26,30,31,34,35,44,45,49,54,59,65,69,70,74,76,77,81,83,84,86,87,88 & 93 were referred to committee on County accounts.

Nos. 7, 8, 27, 28, 29, 32, 40, 43, 47, 50, 55, 58, 60, 71, 85 referred to Committee on Sheriff and Clerk's accounts.

Nos. 9, 10, 16, 19, 20, 23, 24, 33, 28, 29, 41, 42, 46, 48, 51, 52, 53, 56, 57, 61, 62, 63,64, 66, 68, 72, 73, 75, 78. 79, 80, 82, 89, 90, 91, 92, 94, 96 were referred to committee on Constable and Justices accounts. Nos. 36 & 37 referred to Committee on Town accounts. Nos. 67, 95 were referred to committee on Printer's Bill.

Mr. Foote moved that all accounts not having a revenue stamp be handed back to the Supervisors of the town from which said accounts may be presented. Motion carried.

Mr. Burhans moved the report of the Commissioners of Excise be read and received and placed on file. Motion carried.

The Chair appointed Mr. Dowie, Chamberlain and Mead on Military matters.

Messrs. Foote, Storie and Kerr were appointed committee on the resolution relating to uncollected taxes offered by Mr. Foote.

On motion of Mr. Chamberlain, the Board adjourned until Nov. 15th at 8 a.m.



Nov. 15th, 1866, 8 a.m.

Board met pursuant to adjournment. Roll called, minutes of yesterday read. On motion minutes so amended as to include the resolution offered by Mr. Dowie yesterday which is as follows: Resolved that a committee of three be appointed by the Chair to what should be referred all military matters.

Mr. Dibble presented report of Rail Road Commissioners in and for the Town of Davenport, stating that they be required to be raised on the real and personal estate of the Town of Davenport the sum of $2100 to pay the interest on the bonds of the said Town and also a petition that the said sum be required by the said Board of Supervisors to be levied on the real and personal estate of said town. Report and petition received and placed on file and the relief prayed granted.

Mr. Rich presented a resolution of the Board of Town auditors of the Town of Franklin asking that the taxes collected of stock holders of the 1st National Bank of Franklin in the year 1864 & 1865 be assessed upon the County& Town in the same proportion as the said County and Town had received the avails of said collection for the said years 1864 & 1865 and the same refunded to said stock holders.

Mr. Foote moved that a committee of three be appointed by the Chair to investigate the matters referred to in the Resolution and petition presented by Mr. Rich and that said committee report tomorrow morning. The motion carried. Chair announced as such committee Messrs. Storie, Mead and Dibble.

Mr. Charles A. Foote, County Treasurer, presented an additional report stating that the sums of money therein named had been charged in his report and that should be assessed upon the several tows in said statements or additional report said report received and placed on file.

Accounts Nos. 4 and 6 heretofore referred to committee on county accounts taken from said committee and referred to committee on Constable and Justices accounts. No. 5 taken from committee on county accounts and referred to committee on Sheriff and Clerk's accounts.

Statement of Superintendents of the Poor received read and placed on file & same referred to committee on Poor House & Supt. of Poor report.

Account No. 23 taken from committee on Constable and Justice's accounts and referred to committee on town accounts.

Mr. Lewis presented a petition from assessors of the Town of Hamden asking that the sum of 39.70 be levied upon Warren Ellison of said Town it being the amount of his tax for the year 1865 which was omitted by the assessors of said town. Petition received and placed on file and relief granted.

Account No. 4 taken from Committee on Constable and Justices' accounts and referred to committee on Town accounts.

Mr. Champion presented the non resident highway from the Town of Colchester to be charged back upon the several lots in the Town of Colchester. Said list placed on file and the same ordered assessed back upon the lots.

Mr. Dowie presented then on resident highway tax of the Town of Andes to be assessed to the several lots. Placed on file and same ordered assessed upon the lots.

Mr. Champlin presented the non res. highway tax of the Town of Hancock and the same placed on file and ordered assessed upon the lots.

The same presentation from Town of Tompkins and same ordered assessed upon the lots.

Account No. 17 taken from Committee on County Claims and referred to Superintendents of the Poor.

Accounts were then taken from the box and referred to the several committees as follows: Nos. 97, 98, 102, 103, 104, 105, 106, 107, 108, 110, 111, 114, 116, 117, 119, 120, 121, 122, 125 referred to committee on County Claims.

Nos. 99, 102, 112 referred to committee on Sheriff's and Clerk's accounts.

Nos. 115, 124 were referred to committee on Constable and Justice's accounts.

Nos. 100, 113, 118 referred to committee on printer's bills.

Nos. 109, 118, 123 referred to committee on Town accounts.

Accounts No. 109, 136 sent to committee on County claims.

On motion, Mr. Calhoun was allowed to add to his account as Sheriff the sum of $3.00 and said Calhoun ordered to pay Mr. Kelsey of Hancock the sum of $3.00.

On motion of Mr. Burhans the sum of $50,300.17 it being the amount of State tax as fixed by the Board of Equalization of taxes for the year 1866 was ordered levied upon the real and personal property of the County.

The communication of Mr. Mendell asking that the tax of one dollar assessed upon and paid by him last year under protest, be refunded to him. Was referred to committee on town accounts.

Mr. Rich moved that the chair appoint a committee of three to take the abstracts of the several towns and examine the same and report thereon.. Motion carried. Chair announced as such committee: Messrs. Rich, Chamberlain and Sines.

On motion of Mr. Foote, Chairman announced Messrs. Foote, Champlin & Van Horne as committee to investigate and report the amount of bail required by County Treasurer.

Lean granted to Mr. Dibble to add town accounts to abstract of accounts of Davenport.

Same lean granted to Mr. Storie of Bovina.

Lean granted to Mr. Mead of Walton to add accounts to the abstracts of accounts of the Town of Walton.

Mr. Lewis presented a petition from the Town Board of Hamden asking that the sum of ninety dollars be levied upon the Town of Hamden for the erection of a Hall of Military records it being the amount assigned to said town by the Commissioners designated in Chapter 744 Laws 1865. The petition received and the said sum ordered levied upon said Town.

A like petition presented from the Town of Walton by Mr. Mead praying that the sum of one hundred and forty dollars be assessed on said town for Hall of Military records. Petition received and same placed on file and the same ordered levied.

A like petition presented by Mr. Chamberlain praying that the sum of $140.00 be levied upon the Town of Hancock. Petition received and placed on file. And said amount ordered levied.

Board adjourned to 7 p.m.



The Board met pursuant to adjournment at 7 p.m.

Lean granted to Supervisor of Walton to sent lists of unperformed highway labor to Clerk of the Board.

Motion made and carried that the return of delinquents be referred to committee on Military affairs.

Mr. Foote, Chairman of committee on Co. Treasurer's account, presented his report and same received & adopted.

Mr. Wattles presented petition of Rail Road Commissioners asking that the sum of $3800 be levied upon the Town of Sidney. Prayer of the petition granted and the said sum ordered levied on said Town.

Report of Superintendents of Poor received and referred to Committee on Superintendents Report.

Account No. 142 referred to Committee on Constable's and Justices' accounts.

Nos.126, 127,128, 129, 132, 133, 134, 136, 137 & 138 referred to Committee on Town Accounts.

Nos.130, 131, 139, 140, 141,143, 144 & 145 referred to Committee on County Claims.

No. 135 referred to Committee on Sheriff's and Clerk's.

No.146 referred to Committee on Printer's bills.

The petition of the Meredith assessors laid upon the table until morning.

The communication as to the index to Laws laid upon the table.

Motion made and carried that the Bounty claims presented from the Town of Colchester be referred to committee on Town accounts.

Motion carried that $23.44 unpaid landlord's tax be assessed to Bovina.

Mr. Dayton asked lean to present lists of unperformed highway labor of the Town of Harpersfield and the same assessed back on the individuals unaccompanied with afts. and warrants. The lean granted.

On motion the sum of $21.66 unpaid landlord's tax assessed on rents in Town of Delhi and the sum of $7.67 be reassessed to R. J. Livingston.

The certificate of fence viewers of the Town of Meredith as to sheep killed referred to committee on town accounts.

On motion the sum of $59.80 unpaid landlord's tax of the Town of Hamden be reassessed back on lots.

Mr. Foote, Chairman of Committee on County Treasurer's report on unpaid landlord's tax reported and on motion said report laid upon the table until morning.

Mr. Foote offered the following resolution:

"Resolved that Charles A. Foote, Esq., Treasurer of the County of Delaware, be and he hereby is directed to bring an action & file a bill in the Supreme Court against Henry C. Overing & also to bring a like action file a bill in said County against (Widow) Mary Overing for the balances of taxes assessed against them for rents reserved on certain leases on lands situate in the Towns of Stamford and Bovina in said County and as to what balances the Sheriff has heretofore returned the warrants issued by said Treasurer unsatisfied for the purpose of satisfying such uncollected taxes by the discovery and sequestration of property or by other legal measurers."

Mr. Chamberlain moved to mend said resolution by adding thereto "and that the Towns of Bovina and Stamford are to pay all costs and expenses of such legal proceedings". The revolution as amended was carried.

The sum of $82.31 quid tax assessed on Town of Davenport and the sum of $18.66 on Lot No. 4, 180 acres Fitches Patent.

On motion the sum of $12.32 unpaid landlord's tax reassessed on Lot 37 Goldsborough Patent Town of Kortright.

Motion made and carried that the several supervisors see to the quid tax of their respective towns.

Committee of Superintendents of Poor account reported and report received and placed on file.

Mr. Dowie, Chairman of Committee on Equalization, reported, report received and placed on file.

Mr. Dowie offered the following resolution:

"Resolved that the Clerk of this Board reduce or increase the equalization so that the aggregate amount of the equalized value of the real estate of the several towns shall be the same as the aggregate assessed vale thereof".The said resolution was adopted.

Accounts Nos. 147, 151, 153, 154,167, 157 referred to Committee on County claims.

Nos.148, 149, 150, 152, 155 referred to committee on Town accounts. Motion made and carried that Sheriff be allowed to add to his account a claim and same sent to Committee on Sheriff's accounts.

On motion of Mr. Foote, Co. box closed and laid aside.

On motion of Mr. Foote the sum of $2367.48 quid tax was ordered assessed upon the Town of Delhi.

Mr. Rich, Chairman of Committee on Town abstracts, reported. Report received and placed on file and committee discharged. Account of Nathaniel Hathaway referred to Committee on Constables and Justices accounts.

Mr. Kerr moved that the sum of $1148.54 unpaid landlord's tax be assessed on the Town of Kortright.

Mr. Sines presented a notice from the Commissioners of Highways of the Town of Middletown requiring the Board of Supervisors to levy the sum of $350.00 for highway and bridge purposes on said Town of Middletown. The said sum ordered assessed on said Town and also the sum of six hundred dollars for Poor purposes. Account No.s59.54, 44, enumerator's bills disallowed on motion. The sum of $350 for Poor purposes & $250 highway purposes and the sum of $14,580.54 for Bounty purposes was ordered assessed upon the Town of Delhi.

The abstracts of Town accounts of the several towns were taken up and the several sums for Town purposes, Poor and highway purposes and were assessed on the several towns respectively and the unperformed highway labor assessed back to individuals.

Mr. Wattles offered the following resolution:

"Resolved that the School Commissioners are requested by this Board to hld two drills in each year in each of the respective towns for the purpose of examining and Licensing School teachers.." This resolution was adopted.

Mr. Chamberlain offered the following resolution:

"Resolved that we disapprove of the arbitrary rule adopted by our School Commissioners by which they insist that all teachers shall attend the institute or be deprived of certificates we recommend that they grant licenses to all qualified teachers without regard to the facts whether they attend the institutes or only the drills. The motion carried.

On motion one copy of the index laws left with the Board of Supervisors and placed in the case in which the records are filed. Another deposited in the County Law Library in the office of the County Judge. On motion the Committee on reserved rents was discharged.

Account No. 37 sent to Committee on County Accounts.

On motion an appropriation of $200 was ordered to be assessed upon the real and personal property of Delaware County for Poor purposes.

Accounts No. 16 & 9 sent to Committee on Town accounts. Motion made and carried that the Clerk of this Board forward copies of the resolution of Mr. Wattles as to drills and the motion of Mr. Chamberlain as to institutes, to Mr. Cable and to Mr. Bouton the present Commissioners.

Mr. Chamberlain offered the following resolution:

"Resolved that the Supervisors composing this Board be hereby instructed to insist that their collectors collect as near as possible the full amount of taxes assessed to the different individuals on the rolls & that they fully comply with the law in relation to the collection of taxes." Motion carried.

Board adjourned to 2 o'clock p.m.



Nov. 16th, 1866 2 p.m.

Board met pursuant to adjournment. Penalty of County Treasurer fixed at $50,000.

Accounts of John Grant referred to Committee on County claims

Mr. Courtney, Loan Commissioner, reported the loan montages taken during the last year securing moneys belonging to the United States Deposit Fund. Committee on U.S.D.F. reported. Report received and committee discharged.

Mr. Dowie, Chairman of Committee on Printer's bills, presented his report and on motion same received and adopted and placed on file and committee discharged.

Mr. H. R. Graham, Chairman on Committee on Court House and Jail, reported and recommended that the sum of $54.00 be levied on the County for repairs on Court House and Jail & Building. Report received and adopted and the said sum ordered assessed on County.

The bond of the County Treasurer was then approved by the Board of Supervisors & ordered to be filed with the Clerk of Delaware County.

Chairman of Committee of Town accounts presented his report and the same was received and same laid upon the labor.

Account No.992 referred to committee on County accounts.

Account No. 9 referred to committee on Sheriff and Clerk's accounts. No. 139 sent to committee on Printer's bills and No. 131 sent to committee on Sheriff's and Clerk's accounts.

Mr. Storie, Chairman of Special committee on the petition from the town auditors of Franklin as to the refunding of taxes paid by share holders of 1st National Bank of Franklin reported and report received and placed on file and committee discharged.

Accounts Nos. 157, 156 referred to committee of the whole. Committee on County claims presented their report. By motion of Mr. Storie, chairman of said committee, the report received and adopted and on motion the claim no. 99 of Mr. Decker was charged on Towns of Bovina and Middletown. The sum of $3.92 on the Town of Bovina and the sum of $3.92 on the Town of Middletown.

Mr. Owens moved that the sum of $248.38 rejected taxes of the year 1865 be assessed on lots and the sum of $124.19 assessed on town, and also the sum of $117.52 short roll assessed on town.

On motion the sum of $124.69 quid tax assessed back on Town of Andes. The sum of $427.69 quid assessed on Hancock.

On motion of Mr. Sines, the Town of Middletown credited with the sum of $1100.63 and the said sum to be taken from the aggregate assessment of said town.

On motion of Mr. Lewis the sum of $33.32quid tax was assessed back on Town of Hancock and the sum of $8.93 on Lot Mrs. Robinson, Town of Hamden.

On motion of Mr. Graham, the sum of $3.00 attorney's fees assessed on Town of Meredith.

On motion of Mr. Sines the assessment roll of the Town of Middletown be amended by adding thereto the following names property & C:

Ira Morse, Personal$3000.

Alexander McLane,214 acres value $1300, said property to be assessed at same rate as last year.

On motion, Mr. Foote was excused from further attendance at this meeting of the Board.

Mr. Sines excused. Mr. Burhans offered the following resolution which was carried:

Resolved that $2240 be taken from aggregate assessment of Roxbury. Edward J. Burhans paying in the money at the next adjourned meeting of the Board or give satisfactory security to County Treasurer that he will pay it in to him on the return of the collector's warrant.

Mr. Wattles presented the following resolution:

"Resolved that the amount that may be paid in any town for the rent of an armory and charged on county be limited to the sum of $25.00. Ayes and noes called:

Messrs. Burhans, Dayton, Owens, Rich, Storie, VanHorne and Wattles voted aye and Messrs. Champlin, Chamberlain, Dibble, Dowie, James H. Graham, H. R. Graham, Kerr, Mead, Lewis & Sines voted no.

Motion declared lost.

The following resolution made by Mr. Wattles was adopted:

"Resolved that the Supervisors of each town be authorized to procure suitable blanks for the use of the several overseers of the highway in the several towns in making their report to the Supervisors of unperformed highway labor and that said blanks be delivered to the Commissioners of Highway of the several Towns to be by them distributed among the overseers with their road warrants.

The claim of the Deposit Bank and of Mr. Knapp was laid upon the table until evening.

Claims 69 & 70 were withdrawn.

On motion the following resolution was adopted:

"Resolved that this Board adopt as its action in relation to the claim of Charles Knapp, President of the Deposit Bank and the Deposit National Bank the action of the Special Committee in relation to the claim of the First National Bank of Franklin and that for the same reasons we refer the matter back to Mr. Knapp."

Motion made and carried that the uncollected military tax of1865 be assessed on the several towns as reported by the County Treasurer. And the report of Co. Treasurer as to uncollected military taxes received and placed on file.

Report of Committee on Town accounts taken from the table. A motion was made that the item of $113.60 in favor of the Town of Colchester against the Town of Hamden is stricken from said report. After remarks of counsel for and against the resolution were heard, the ayes and noes called for and Messrs. Mead, Rich and Lewis voted aye and Messrs. Chamberlain, Champlin, Dayton, Dowie, H.R. Graham, Kerr, Owens, Sines, Storie and VanHorne voted noe. Motion lost.

Report of Committee of Town accounts received and adopted and placed on file.

Mr. Lewis, acting Supervisor from the Town of Hamden, presented the following protest. The acting Supervisor from Hamden before said bill was passed by objected and protested against the Board audit allowing or assessing an account of the Town of Colchester against the Town of Hamden on the ground the Board had no jurisdiction over it or business with it. It not having been allowed or audited by the Superintendents of the Poor or the Board of Auditors of the Town of Hamden and that the Board could not charge the Town of Hamden with it and also for the reason that the items for the bill occurred before any notice was given to the Overseers of the Poor of the Town of Hamden to determine the settlement of the pauper. Mr. Champlin withdrew Bounty claims of Colchester from further consideration by this board. On motion of Mr. Chamberlain the sum of $23.55 was laid on the County for a contingent fund in hands of Co. Treasurer.

Mr. Rich, Chairman of Committee on Sheriff's and Clerk's accounts reported. Report received adopted and placed on file and committee discharged.

Motion made and carried that when the Board adjourned that they adjourn to meet on the11th day of December, 1866 at 7 p.m.

On motion, Mr. Dayton was excused. On motion Mr. Van Horne and Kerr also excused. Board adjourned until 8 o'clock a.m. tomorrow morning.



Board met pursuant to adjournment. Roll called, minutes read and adopted. Motion made and carried that the Clerk of the board forward to each of the collectors of the several towns copies of the resolution heretofore offered by Mr. Chamberlain.

Supervisor of Franklin allowed to withdraw claims and papers of the shareholders of the 1st National Bank of Franklin.

Mr. Graham offered the following resolution:

"Resolved that Charles Paine of Meredith be credited for two days on road warrant of said town."

Mr. Dowie offered the following resolution:

"Resolved that this Board employ counsel to investigate the right of exemptions of uniform militia under old and new law in reference to highway and property taxation and make a report thereof at the next meeting of this Board and that Wm. Murray, Jr. be such counsel. This motion carried.

On motion the Board adjourned to meet on the11th day of December, 1866.

Mr. Dowie moved that the Supervisors hand to the Clerk the names of the Collectors of their respective towns. Motion carried. On motion of Mr. Dowie, Board was adjourned until 8 o'clock, Dec. 12th, 1866.

Mr. Dowie presented a petition for an Armory in the Town of Andes. Petition read and placed on file and the prayer of petition granted.

Chairman announced the following persons as Committee on Printing. Messrs. Storie, Dibble and Owens.

On motion of Mr. Foote, the Treasurer and the Superintendent of the Poor were directed to insure the public buildings.

On motion the warrants were ordered to be amended so as to require the Collector to pay over any excess of tax roll to the Supervisors.

The County Clerk appeared and stated to the Board that the accommodations in the Clerk's Officer were very inadequate, and asked that a committee be appointed to examine the Clerk's Office. Messrs. Wattles, Foote and Chamberlain were appointed as such committee. On their recommendation an appropriation of $75 was made for the purpose of making necessary improvements.

After transacting some minor business the Board adjourned until evening.

In the afternoon the Board visited the Poor House.

Board met pursuant to adjournment at 7 ½ p.m. in evening.

Mr. Burhans was called to the Chair.

Mr. Graham having been called away.

On motion the several lists of persons named as Grand Jurors presented by the Supervisors was declared as the lists of Grand Jurors of the County of Delaware for the years1866 and 1867 and that the Clerk of the Board file a certified copy of said Grand Jury List with the County Clerk of Del. Co. within ten days.

On motion a Committee of three was appointed to take into consideration the quid tax laid upon the Town of Delhi for the present year, Chamberlain, Champlin & Dowie.

Mr. Cartwright made a statement as to the salary of Mr. McNee, the Keeper of the Poor House and requested the Board to raise his salary. On motion the Superintendents were allowed to raise his, the said McNee's salary for the present year in the sum of one hundred dollars and be allowed to contract for four hundred and fifty dollars for the coming year.

Committee on Co. Acs. reported. Report received and placed and placed on file and committee discharged.

Motion made and carried that the Board proceed to sign the rolls.

Committee on Sheriff's Accounts reported. Report of committee received and placed on file.

Judge Murray read his statement in regard to Military exemptions. The same was received and placed on file and the same ordered published in County papers.

The Board then proceeded to sign such rolls as were ready.

Hon. W. Murray, Jr., in pursuance of a former resolution of the Board, made the following statement in relation to military exemptions which was ordered published in all the county papers:

By a resolution of the Board of Supervisors of the County passed Nov. 16th, 1866, submitting to me to examine and report as to what exemption of highway and property tax the uniformed militia of this State are entitled to.

Having therefore fully investigated the same, do report as follows, to wit: that by laws of 1862 Chap. 477@ 146, the officers, musicians and privates, in the uniformed militia were exempt from Jury duty, and the payment of highway tax not exceeding six days in one year, and every person not assessed for highway taxes, shall be entitled to a deduction in the assessment of his real and personal property not exceeding $500.

By the laws of 1865, Chap. 612 @ 146, the above section of the laws of 1862, is so amended as to limit the exemptions to jury duty alone, and it so remains at this time.

It is claimed on the part of the soldier that as to those that enlisted under the Stature of 1862, it amounted to a contract between the State and the soldier, that he should have such exemptions, and that no subsequent legislation could take them from them.

There is a good deal of plausibility in this reasoning, and the Adjutant General of the State wrote an opinion dictating that to be the law, and I had hoped that his opinion was the law, because I deem the fullest amount of exemptions which has ever been awarded them a very inadequate compensation for the labor and expense they are put to in the performance of their duties.

But this very question came up before one of the Supreme Court Judges in the western part of this State, who held that soldiers were like public officers serving the public for the benefit of the public, at a compensation, for unperformed services ,l entirely under the control of the Legislature, to be reduced oral together taken away or increased at the pleasure of the Legislature, for unperformed services.

I think this vew is fully sustained by the decision of the Court of Appeals (1 Selden. 285) as to the public officers, which is decisive of this question.

I am therefore forced to the conclusion that the enlisted soldier now in the militia service has no exemptions except jury duty.

Mr. Salton presented a protest against the completion of the roll of the Town of Hamden. The following is the protest:

" David Salton, the Supervisor of the Town of Hamden, objects to and protests against the completion of the roll of that Town and the opening warrants for the collection thereof with the amount of $113.60 in favor of the Town of Colchester in it, on the ground said account is illegal. No such claim (?) against the town of Hamden. That it is not property verified. That this Board has no jurisdiction over it & no power or authority to adjust or allow it. It not having been allowed by the Board of Superintendents of the County of Delaware or by the Board of Auditors of the Town of Hamden. That the amount should be stricken from said roll."

Dec. 13th, 1866

Mr. Sines, VanHorne and Dayton appointed Committee on Supervisors accounts.

Mr. Wattles then took the chair. Mr. James H. Graham presented and announced to the Board a claim of Mr. Kiff for expenses in procuring and recovering a stolen horse. Mr. Gleason read the petition and accounts. The accounts of Mr. Kiff was allowed and charged to the County and the same placed on file. Said bill amounting to the sum of $126.23.

The Board allowed Mr. H. M. Cable about $37 additional for expenses as School Commissioner.

Board adjourned until 8 a.m. Thursday.

Thursday - Messrs. Sines, VanHorne and Dayton were appointed a committee on Supervisor's bills.

Mr. Wattles then took the chair and Mr. J. H. Graham presented a claim of Mr. Peter Kiff for expenses incurred in recovering his stolen horse and arresting the thief. The amount -$126.23- was ordered paid.

Mr. Burhans moved that $50 additional be allowed to Mr. O. R. Bouton for expenses as School Commissioner. After considerable discussion the propositions was voted down.

Mr. Norwood Bowne asked the Board to allow him $23 additional for printing the Court Calendars, which was accordingly done.

The salary of the Clerk of the Board was fixed at$275.

After an ineffectual attempt t reconsider the case of Colchester against Hamden, the following resolution was offered, and after some remarks by Mr. Wm. Murray, Jr. and others, passed:

"Resolved: That a committee of five, outside of the members of this Board, be appointed to take into consideration the matter of the Court House in this county, and report at the next annual meeting of the Board of Supervisors of the County, whether this Court House can be enlarged and substantially repaired and improved so as to make it a suitable Court House for said County, and what the cost of such repairs and enlargement would probably be, and if such enlargement, repairs and improvement cannot be made, so as to make this a suitable Court House, the propriety of building a new one, and the probable cost there."

The Supervisors' accounts, and a number of others, were then received and passed.

The Board then proceeded to ballot for papers to publish the Session Laws. The Delaware Republican received nine votes, and the Delaware Gazette seven, and were declared so designated.

The committee on printing reported, recommending that the Delaware Express be ordered to publish all the matter required by law to be published, receiving legal rates for all except Town and County accounts-for which one half the legal rates are to be paid. That the Delaware Republican be ordered to publish the Town and County accounts for one half the sum allowed by law for such service, and that the Delaware Courier be ordered to publish the same for the full legal rates. Report received and adopted.

On motion it was ordered that jurors should henceforth receive $2.00 per day.

The Board then adjourned sine die.

Lean granted to the Sheriff to withdraw a bill presented yesterday.

On motion Mr. Bowne was allowed the additional sum of $23.00 for printing calendars.

W. P. Lynch, Clerk of the Board of Supervisors, allowed the sum of $275.00 salary.

Mr. Storie moved to reconsider the resolution of the Board whereby the Town of Hamden was charged with the sum of 113 in favor of the Town of Colchester for the support of paupers.

Annual Report of the Superintendents of the Poor

The Superintendents of the Poor of Delaware County present to the Board of Supervisors the following Annual Report:



There has been expended for support of the Poor at the County Poor

House from Nov. 1, 1865 to Nov. 1, 1866 the sum of $4149.40

Which sum includes expenses of clothing, provisions and physicians

fill at the house, Keeper's salary, and all incidental expenses

necessary to carry on the poor house farm.

There have been had by the poor at the house during the year,

2610 weeks' board at an average cost of $1.59 per week.

Of that number of weeks' board there have been had by the

poor belonging to the several towns for the year ending

Nov. 1, 1866, 2000 weeks and 5 days board at $1.59 per week,

amounting to the sum of $3181.14

The whole number of Poor supported at the Poor House the year ending Nov. 1, 1866 was 109, of which 57 were County Poor and 52 Town Poor; discharged 56; died 6; remaining in the Poor House, Nov. 1, 1866, 53; insane 8; idiots 14.

The stock remaining on the farm Nov. 1, 1866, was: One pair of stags; ten cows; two 2 year old heifers; two yearling heifers; one yearling bull; four calves; 12 sheep; four fatting hogs; three shoats.

There have been raised on the farm 20 tons of hay; 2000 sheaves of rye; about 400 bushels oats; 475 bushels potatoes; 450 bushels ears of corn; 23 bushels onions; 132 bushels buckwheat; 11 firkins butter.

The Superintendents think the sum of $1,200 in addition to the amount due from the several towns and the amount in the Treasury, will be sufficient (the rest is covered up and unreadable).
