At an annual meeting the Board of Supervisors held at the Court House in Delhi November 14th, 1865. Supervisors present from the several Towns as follows:

Board was called to order by B.F. Gerowe. Clerk of the Board of 1864. On motion of Mr. Shaw, the Board proceeded to ballot for Chairman:

James H. Graham rec'd. 10 ballots

E. I. Burhans rec'd. 3 ballots

Wm. B. Dowie rec'd. 5 ballots

Jas. H. Graham having received a majority of all the votes cast was declared elected Chairman.

Board proceeded to ballot for Clerk:

William P. Lynch received 12 votes.

John W. McCabe received 2 votes.

B. F. Gerowe received 2 votes.

H. F. Davidson received 1 vote.

W. P. Lynch having received a majority of the votes cast was declared elected clerk. On motion the Board then adjourned until 9 a.m. Nov. 15th, 1865.

On motion of Mr. Shaw the rules as laid down in the Supervisors Manual were adopted as the rules regulation the business of said Board.

The County Treasurer presented a statement of quid taxes, non resident creditors tax and landlords tax uncollected for 1864. The same was on motion received & placed on file.

The following claims were taken from the box containing claims & numbers and referred as follows: Nos. 3-5-7-6-8-9-11-12-18-17-21-25-27-52-29-30-28-33-25-36-37-38-39-40-44-45-46-47-49-54-55-57-62-64-63-70-74-75-72-71-79-83-82-87-84-88-89-90-91-96-97-98-100-102-104-107-113-117-118-116 were referred to the committee on County Claims. No. 1-10-13-19-20-23-24-31-48-50-51-53-56-58-59-60-61-69-73-76-78-77-80-86-95-98-101-103-105-108-109-114 were referred to the committee on Justices & Constables accounts. Nos. 4-15-16-65-67-112 were referred to the Committee on Supervisors accounts. Nos. 43-81-85-94-115 were referred to the committee on Sheriff's accounts. Nos.2-32-106 were referred to the Committee on Town Accounts. Nos. 23-34-14 were referred to the committee on Printers bills. Nos. 41-42-66-68-92-93-110-111 were referred to the Superintendents of the Poor.

Mr.Burhans was called to the Chair. Superintendents of the Poor presented statement fo the poor supported at the County Poor House during the past year the expenses of keeping poor, and the towns to which the poor belong respectively and a statement of the expenses of the County Poor House for the year. The statement after being read was received and referred to the committee on Poor House and Superintendents Report.

On Mr. Burhans

"Resolved that the members of this board visit the County Poor House at one o'clock this after noon."

On motion the Board adjourned until 9 a.m. Nov. 16th.



9 a.m. Nov. 16th

Board met pursuant to adjournment. Roll called, minutes read and approved.

Mr. Dibble presented a petition of the Commissioners appointed under and by virtue of an act of the Legislature asking that the sum of $2424.57 be levied on the Town of Davenport to pay interest on subscription to stock of Albany & Susquehanna R. R. On motion the said sum was allowed and charged on Town of Davenport.

Mr. Sines presented a like petition asking that the sum of $800 be charged on the Town of Sidney.

On motion the Supervisor of Davenport was authorized to collect the assessment roll of said town by adding thereto the following names and assessments:

Chas. Houghtaling 256 acres $2200 value

Isiah C. (Bryant - crossed off) Burgett 800 personal

On motion of Mr. Seely the following persons were ordered taxed in addition to the taxes of the present year upon the following valuations at the same rate of taxation as in 1864. The said persons and valuations having been left off the assessment roll of 1864 by mistake viz:

Darius Hubbard 96 acres $1300 value

Samuel Mulford 28 acres 400 value



On motion of Mr. Sines, the Committee on County Claims were authorized to consider a claim in favor of William Dewey of $115.00 as census enumerator of Sidney when the said claim shall be placed in the hands of the said Committee.

The County Treasurer having presented his annual report the same after being read was received and placed on file. The Committee on County Treasurer's report having made report same was received and adopted and the Committee discharged.

The Committee on Poor House and Superintendents report having presented their report the same was received and adopted.

The following claims were presented numbered and referred as follows: Nos. 119-120-123-124-125-127-128-129-130-132 were referred to the Committee on County Claims.

No. 121 was referred to the Committee on Justice's & Constables accounts.

No. 126 was referred to the Committee on Sheriff's and Clerk's accounts.

Nos. 133-134 were referred to the Superintendents of the Poor.

Mr. Knapp, President of The Deposit National Bank presented an affidavit and memorial in behalf of said claiming the assessment on said bank to be erroneous and illegal and asking that the same be corrected. The same after being read was received and placed on file.

A claim in favor of The Deposit Bank of $1339.65for alleged erroneously paid tax was received and referred to the Committee on County Claims.

Mr. Foote presented claims in favor of persons improperly taxedin1864 and the same referred to committee on Town accounts. The County Treasurer presented a statement of taxes rejected and returned by the Comptroller and also a statement of taxes once admitted and now finally rejected. Statements received and place on file.

On motion Board adjourned to 7 o'clock P.M.

Board met pursuant to adjournment at 7 p.m. On request of Mr. James H. Graham, Mr. Dowie took the Chair. Mr. George W. Clark made a few remarks as to the propriety of an appropriation of the purpose of flagging the walks on the Square.

The matter flagging walks on the Court House Square referred to Committee on Court House and Jail.

Mr. Foote, Chairman of the Committee on U. S. D. F. reported. Report received and placed on file.

The Commissioner of U.S.D.F. presented the mortgage books for examination by the Board.

Mr. Shaw, Chairman of Committee on Equalization reported and also presented the following resolution:

Resolved that the Clerk of this Board reduce or increase the Equalization so that the aggregate amount of the equalized value of the real estate of the several towns shall be the same as the aggregate assessed value there.

The report of the Equalization Committee received and adopted and placed on file and also the above resolution which also reported by said Committee was carried and adopted. The Board then examined the mortgages given during the last year to the Com. of U.S.D.F.

9 a.m. Nov. 17th

Board met pursuant to adjournment. Roll called minutes read and approved.

Mr. Foote presented a petition of the assessors of Stamford asking that certain property escaping taxation in1864 be taxed the present year in addition to the current taxes of this year at the same rate of taxation as in 1864. Received and placed on file.

Mr. Rich presented a like petition on behalf of the assessors of Franklin. On motion the same was allowed & ordered taxed as in said memorial prayed.

Mr. Sines presented a like memorial of assessors of Middletown. Memorial received and placed on file and the several persons were ordered taxed as in said memorial prayed.

Mr. Graham presented a memorial of the assessors of the Town of Delhi asking that the assessment roll of Delhi be amended by adding a certain shares and stocks in the First National Bank and to The Delaware Bank of Delhi to said roll.

On motion the petition was laid on the table.

A petition on the part of Brya H. Burgin asking for an extra allowance for moving and repairing County Insane building. On motion the same was received and referred to committee on Poor House and Superintendents Report.

The committee on Court House and Jail made report. On motion the same was received and adopted and the committee discharged.

A claim in favor of the N. Y. Asylum for Idiots was presented and allowed against the County at $20.00. On motion the Supervisor of Kortright was allowed to withdraw account No. 2 for correction. The County Treasurer having presented a statement and report as to military fines and military funds received by him and on motion the same was received and placed on file.

Claims were then taken from the box of accounts. Nos. 136-137-138-139-140-141-142-143-144-145-146-247-148-253-154-156-157-158-160-161-162-163-164-165-167-169-171-172-173-176 were referred to the committee on Clerk's and Sheriffs accounts. Nos. 152-168-170-174 were referred to the Committee on Printer's bills. No. 166-175 were referred to the Superintendents of the Poor. Nos. 177-178-179-180-181-182-183-184-185-186-187-188-189-190-191 (Blank space after these numbers).

The Committee on Poor House and Superintendents Report then made report and on motion the same was received & adopted and the committee discharged.

On motion of Mr. Burhans, Bryan H. Burgin was allowed the sum of $100 as an additional allowance for moving County Insane House when he shall fully comply with the terms of his agreement with the Superintendent of the Poor.

On motion of Mr. Burhans the sum of $1200.00 was ordered levied and collected upon the taxable property of the county for County Poor Fund for the present year.

On motion the abstracts of the several towns and also all sums to be raised for Poor, Highway and County purposes and all statements of highway labor unperformed were ordered referred to and to be considered by the committee on Town accounts.

On motion the Clerk of the Board was authorized and directed to levy upon the Town of Hamden the several sums for town purpose asked by said town when the property abstracts are statements are placed in his hands.

On motion of Mr. Chamberlain the sum of $14000.00 was ordered levied upon the County for a contingent fund the ensuing year and the Treasurer was authorized to borrow upon the credit of the County any sum necessary to make up the deficiency incase said sum shall not be sufficient to meet the contingent expenses of the County.

On motion of Mr. Chamberlain the sum of $42,502.67was ordered levied and collected upon the taxable property of the County for the amount of State Tax apportioned to the County for the year1865 as per Comptrollers's Statement. On motion the Board was adjourned until 2 p.m.

Board met pursuant to adjournment.

No. 192 referred to committee on County accounts. Mr. Burhans, Chairman of Committee on Constables and Justices accounts presented the report of said committee. Report received and adopted.

Mr. Shaw presented report of Committee on Printer's Bill which on motion was received and adopted. The usual report of the Board of Excise being presented and the same after being read was received and placed on file. Mr.Foote called to the Chair. The memorial or petition of the assessors of the Town of Delhi as the correction of the assessment roll of Delhi was there taken from the table and considered by the Board. Mr. Gleason, on behalf of the Banks and Shareholders therein, presented protests in writing. On motion the protests were ordered recorded in the minutes of the proceedings of this Board. The following are the protests, to wit:

"To the Board of Supervisors of Delaware County:

The first National Bank of Delhi and each and all the stockholders thereof, objects and protests against the proposed insertion of an assessment against the stockholders of said Bank by said Board. For assessing or inserting in the assessment roll of the Town of Delhi. For laying or attempting to impose a tax upon any of the stockholders of said Bank for their ownership or shares therein & on the ground that said Board has no legal authority to now assess said Bank nor any of the stockholders thereof and that all capital stock of said Bank and the shares of each stockholder, consists of United States Bonds & Securities exempt from all assessments & taxation & on the ground that the assessors of the Town of Delhi on mature examination & deliberation, decided and held when they made the assessment for the Town of Delhi & completed the assessment & roll, that said stockholders were not assessable for their stock in said Bank & they ascertained& decided that all the stock of said Bank was in & composed of said Bonds, aforesaid, and held and decided that they were no taxable & their decision was right and at all events conclusion for the present year & further that to tax the stockholders in virtually to tax said exempt United States Securities, and is an evasion and nullification of the statutes under which said bonds were issued and purchased. And to these objections & Protests said Bank by its officers for said Bank and each and every of the stockholders thereof objects and protests as aforesaid.

The Delaware National Bank of Delhi which was formerly the Delaware Bank and which heretofore converted into said 'Delaware National Bank' objects to and protests against any addition to or increase of the amount heretofore assessed against said Delaware Bank Or Delaware National Bank of Delhi & insists that the United States Bonds & Securities, that were held by said Delaware Bank or that are now held by said Delaware National Bank are exempt from taxation whether the assessment and taxation be direct or indirect.

Mr. Shaw moved that the assessment roll of the Town of Delhi be amended in accordance with the prayer of the assessors of the Town by adding the lists of shareholders of the First National Bank together with the amts. of assessments as set down in the petition of the assessors. Ayes and Noes called by Mr. Graham: Ayes: Messrs. Burhans, Chamberlain, Champlin, Dibble, Dowie, Eells, Foote, H. R. Graham, Kerr, Owens, Seeley, Shaw, Sines, Siver, Storie, VanHorne. 17

Noes: James H. Graham. Motion carried.

Mr. Shaw moved that the assessment roll of Delhi be amended as prayed in the memorial of the assessors of the Town by adding to said roll an additional assessment of $75000.00 as personal property to the Delaware National Bank. Ayes and Noes called by Mr.Graham: Ayes: Burhans, Chamberlain, Champlin, Owens, Seely, Shaw, Siver and Van Horne. 8 Noes: Dibble, Dowie, Eells, Foote, Graham H. R. Graham, Kerr, Rich, Sines & Store. 10. Motion lost.

On motion Co. "I" of the 100th Reg. N. Y. S. N. G. was allowed to procure an armory for the use of said company at an expense not exceeding $50.00 per annum.

On motion of Mr. Chamberlain, Co. "G" of the same regiment was allowed to procure an armory at an expense not exceeding $50 per annum.

On motion the several Supervisors were allowed to withdraw all imperfect applications on the part of Military Companies for authority to procure armories.

On motion Company "H" of the 27th Regiment N. Y. S. N. G. was authorized and allowed to procure or rent an armory for the use of said Company at an expense not exceeding $50.00 per annum.

On motion of Mr. Storie the sum of $15,603 of the rents or land lord's tax of Bovina was ordered taxed on the Cathel's lot and the balance of said tax was charged on the Town of Bovina.

On motion of Mr. Chamberlain the quid tax of Hancock was disposed of as follows, viz: The several items marked on the Treasurer's list "to the town" was ordered taxed on the Town and the balance of the tax was ordered reassessed to the said persons.

On motion of Mr. Siver the quid tax of Sidney was disposed of as follows - The item against George Delap, reassessed & the balance was charged on the Town.

On motion of Mr. Chamberlain the quid tax of Colchester was disposed of as follows: 'The following items were ordered reassessed to the same persons; J. M. Hardy $60.65; Henry Mills $6.40; A. J. Thompson $5.48; William H. Varnolid $2.18; White G. Williams $4.41; William I. Wilson $10.92 and the balance was charged on the Town.

On motion of Mr. Owens the quid tax of Tompkins was disposed of as follows, viz: The items marked to be reassessed was order reassessed to same persons and balance of said tax was charged on the Town of Tompkins.

On motion of Mr. Foote the quid tax of Stamford was charged on the town.

On motion of Mr. Seely the quid tax of Harpersfield was charged on the Town.

On motion of Mr. Shaw the item of quid tax against Mrs. Robinson in Hamden was ordered reassessed.

On motion the rent or landlord's tax of the Town of Stamford was ordered reassessed as prayed in the memorial of the assessors of the Town of Stamford.

On motion of Mr. Shaw the rent tax of Hamden was ordered reassessed to the same person.

On motion of Mr. Dowie the rent tax of Andes was charged on the town.

On motion of Mr.Eells the rent tax of the Town of Walton was ordered reassessed to the same persons.

On motion of Mr. Storie the rejected tax of Bovina was charged on the town.

Mr. Dowie then presented lists of highway labor unperformed in Andes and on motion the same was ordered taxed on the several person as assessed.

On motion of Mr. Eells the quid tax of Walton was charged on the Town.

On motion of Mr. Sines the item of rent tax of the Town of Middletown against Robert J. Livingston was ordered reassessed and the balance of the rent tax of said town was charged on the town.

On motion of Mr. VanHorne the quid tax of the Town of Masonville was charged on the town except the item against Jonathan Scott which was ordered reassessed to said Scott.

Mr. Chamberlain called to the Chair.

An account in favor of John Calhoun of $5.00 for obtaining election returns was allowed against the Town of Davenport.

An account in favor of John Calhoun of $5.00 obtaining election returns was allowed against the Town of Kortright. An account of $15.00 in favor of Stephen Whitman assessor was allowed against the Town of Masonville.

The committee on town accounts presented report as to the town abstracts and amounts to be raised for various town purposes the same was received and adopted and the several sums charged on the town as in the report recommended.

The report of the committee on town accounts was then received and adopted and the committee discharged.

On motion of Mr. Burhans the highway labor unperformed in Roxbury was ordered taxed upon the several persons as stated in the list presented and on file.

On motion the highway labor unperformed in Hancock was ordered taxed upon the several individuals as assessed in the lists presented. On motion the same disposition was made of the unperformed highway labor of Delhi. On motion of Mr. Storie the unperformed highway labor of Bovina was ordered taxed on the several persons as assessed. (See lists on file)

On motion the same disposition was made of highway labor unperformed in the Town of Middletown, Meredith, Franklin and Andes. (See lists on file)

On motion of Mr. Dowie,

Resolved that road warrants should not be received as reports of labor unperformed from Path Masters neither should returns be received unless made and sworn to before the 1st day of October in each year.

Mr. Burhans moved that the sum of $2.00 per acre be added to the price per acre of the Town of Franklin fixed by the Equalization and the Clerk was authorized & directed to equalize upon that basis. Ayes and Noes called by Mr. Burhans.

Ayes: Messrs. Burhans, Chamberlain, Champlin, Owens, Seely, Sines, Siver, Storie, VanHorne and Kerr. 10

Motion carried.

On motion of Mr. Shaw

Resolved that in case the assessors of the Town of Franklin shall amend the assessment roll of said town, as assesses the several shareholders for the stock they hold in the 1st National Bank of Franklin as other personal property is assessed and return the same to the Clerk of the Board on or before the 22nd day of November instant, then the said additional sum of $2.00 per acre is not to be added.

On motion of Mr. Graham the quid tax of Delhi was charged on the Town.

On motion of Mr. Burhans the quid tax the rejected Town of Roxbury was charged on the town. On motion of Mr. James H. Graham the non resident creditors tax of Delhi was charged on the town. An account of $4.50in favor of A. R. Dutton was allowed against the Town of Meredith. The following claims were presented and allowed against the Town of Tompkins: Daniel McKinnon, services in road matter $2.80; A. J. VanHorne services in road matters $2.80; Stillman Smith services in road matters $2.80.

An account in favor of Mr. Stott of $14.00 for services was presented and allowed against the county. An account of $2.00 in favor of Samuel C. Lindsley, surveying road was allowed against Colchester.

Board met pursuant to adjournment. Roll called.

On motion the vote upon the question of amending roll of Delhi by assessing the Delaware Bank the additional sum of $75000. as personal property was reconsidered.

Mr. Shaw moved that the assessment roll of the Town of Delhi by amended as prayed in the memorial of the assessors of the Town of Delhi by adding to said roll an additional assessment of $75000 as personal property to the Delaware Bank. Ayes and Noes called by Mr. Burhans:

Ayes:Burhans, Chamberlain, Champlin, Dibble, Eells, H. R. Graham, Kerr, Owens, Seely, Shaw, Sines, Siver, VanHorne, Dowie.

Noes: J. H. Graham, Rich, Storie.

Motion carried.

On motion of Mr. Dibble the quid tax of the Town of Davenport was charged on the Town of Davenport.

On motion of Mr. Rich an account of $1.46 in favor of A. J. Smith was allowed against the Town of Franklin.

An account of B. F. Gerowe for services & c was allowed at 7.65 assessed the county.

On motion the sum of $50 was appropriated for repairs on Court House and Jail to be expended under the direction of the Sheriff.

On motion the Sheriff of Delaware County was authorized to furnish necessary clothing under his discretion for prisoners confined in the jail and also to procure shackles for prisoners in confinement & to be furnished at the expenses of the County. On motion the sum of two hundred dollars was appropriated for the purpose of building a barn for the use of the Sheriff on the County jail lots to be expended under the direction of the Sheriff.

On motion of Mr. Owens the County Clerk was authorized to procure a new County Seal for the use of the Clerk's Office.

On motion of Mr. Dowie

Resolved that the Supervisors of the several towns within the next ten days furnish the Clerk of this Board with a list of the names of the reserved Militia of their several towns liable to Military duty and that he be ordered to attach such lists to the several rolls with the proper fines affixed thereto.

On motion of Mr. Shaw

Resolved that when this Board adjourned it stand adjourned until the 12th day of December next at 2 o'clock p.m. On motion of Mr. Dibble the item of rent tax against Harriet B. White in the Town of Davenport was ordered assessed on the Northerly quarter of lots No. 66 and the balance of the rent tax of said town was charged on the town.

After reading and approving minutes, Board adjourned until the 12th of December next at 2 p.m.

Board met pursuant to adjournment. Called to order by the Chairman.

The First National Bank of Franklin presented a protest against levying any taxes upon the several share holders of said bank for shares or stock they hold in said bank. Messrs. Parker and Gleason were then heard upon the subject on behalf of the said and shareholders.

On motion of Mr. Dowie the matter of the protest was referred to the Committee of the Town. The Chair announced as such committee Messrs. Dowie, Twaddell and Shaw.

Mr. Foote called to the Chair. Mr. Shaw was excused from the action on the above committee and Mr. Sines was substituted. On motion of Mr. Graham

Resolved that when the Board adjourns it adjourned until 9 a.m. Dec.13th.

A Writ of Mandamus in relation to the levying of taxes upon the Delaware Bank having been served upon the Board the subject on motion was referred to a committee of three. The chair announced as such committee, Messrs. Storie, Siver and Champlin. On motion of Mr. Dowie, Marshall Shaw, Supervisor of the Town of Hamden was excused from acting at the Session of the Board and Alexander Shaw was allowed to act as his substitute.

On motion the Board was adjourned until 9 a.m. Dec. 13.



Dec.13th, 9.a.m.



Board met pursuant to adjournment. Called to order by Chair. Roll called minutes read and approved.

Mr. Burhans presented a petition of assessor of Town of Roxbury asking that certain property escaping taxation in said town for the year 1864 be added to the assessment roll of the present year and taxed at the same rate of taxation as in 1864. On motion of Mr. Foote the petition was allowed and the said property was ordered added to the assessment and tax roll of the present year and taxed at same rate of taxation as in 1864 and the amount of the same made payable to the Supervisor of the Town of Roxbury.

On motion of Mr. Foote a committee of three were appointed to apportion grand jurors among the several towns. Messrs, Foote, Burhans & Dibble were appointed as such committee. Mr. Owens presented an application for authority to build a toll bridge across the West Branch of the Delaware River at Hales Eddy, Town of Tompkins. Authority granted and the application placed on file.

On motion Board proceeded to ballot for papers in which to print the Session Laws for the year 1865. The Delaware Gazette received eight ballots and The Delaware Express received ten ballots. These papers were duly designated as the papers in which the Session Laws are to be printed.

Committee on apportionment of Grand Jurors reported same apportionment as last year. Report received and adopted.

Mr. Twaddell made a motion for appointment of Inspection of the Hancock and Cannonsville Plank Road. Motion withdrawn.

Mr. S. G. Wattles account which was presented by Mr. Siver was referred to Committee of whole on Supervisors accounts.

A.M. Paines bill for stationery of $18.74 was received and allowed.

Mr. William Martins bill against County for use of room for Armory for Company K, 100 Reg. N.Y.S.N.G. amounting to fifty dollars was received and allowed as claimed.

On motion of Mr. Foote, Mr. Murray, Jr., Surrogate was allowed the sum of one hundred and fifty dollars for Clerk hire.

The account of Noah D. Hill against County as Census Marshall amounting to the sum of $30.00 was received and on motion allowed as charged. Mr. Murray, Jr., Surrogate, made his annual report and same placed on file.

Mr. James Davie presented a bill of $60.00 against County for comparing the mortgage indices of the County of Delaware. Claim allowed at $50.00.

On motion, a committee of three was appointed to examine Supervisors accounts.

Chair appointed as such committee Messrs. Sines, Eells and Van Horne.

Board adjourned till 3 p.m.

On motion

Resolved that 5 inspectors of Plank and Turnpike Roads be appointed. Messrs. Isiah Houghtaling, Stamford, W. W. Jellett, Tompkins, L. W. Terwilliger, Hancock, James Wright of Delhi and Aron Ford of Davenport were appointed by the Board as such inspectors.

Mr. Storie, Chairman of the committee of the protest of the First National Bank of Franklin reported progress and asked lean (?) again and report in the morning. The Ayes and Noes being called for the following persons voted:

Ayes: Messrs. Twaddell, Champlin, Dibble, Dowie, Eells, J. H. Graham, H. R. Graham, Kerr, Rich, Sines, Storie, VanHorne and Messrs. Foote, Owens, Seely & Shaw voted noe. Chair decided motion carried.

Mr. Storie, Chairman of the Committee on Writ of Mandamus moved that the said committee be discharged. Ayes and Noes called for.

Messrs. Burhans, Twaddell, Champlin, Dibble, Dowie, Kerr, Owens, Seely, Sines, Storie and Van Horne voted aye. Messrs. Eells, Foote, Graham, H. R. Graham, Rich and Shaw voted Noe. Motion carried.

Mr. Dowie, Chairman of Committee on Protests of the First National Bank, Franklin moved that said committee be discharged from further consideration of the matter submitted to it. Ayes and Noes called for: Messrs. Burhans, Twaddell, Champlin, Dibble, Dowie, Owens, Seely, Sines, Siver, Storie, VanHorne voted Aye. Messrs. Eells, Foote, J.W. Graham, H. R. Graham, Rich & Shaw voted Noe. Motion decided. Carried.

Motion made and carried that the consideration of the Writ of Mandamus and the protest of the 1st National Bank of Franklin be referred to the Board as Committee of the whole. Ayes and Noes called for:

Messrs, Burhans, Twaddle, Champlin, Dibble, Dowie, Eells, Foote, J. H. Graham, H. R. Graham, Kerr, Owens, Rich, Seely, Sines, Storie and VanHorne voted aye and Mr. Shaw voted no. Motion decided carried.

Mr. Storie moved that $75,000 assessed to the Delaware Bank of the Town of Delhi be struck from the assessment roll of said town. Ayes and Noes called for: Messrs. Eells, Foote, Rich, Storie & James H. Graham voted aye. Messrs. Burhans, Twaddell, Champlin, Dibble, Dowie, H. R. Graham, Kerr, Owens, Seely, Sines, Siver and VanHorne voted noe. Motion lost.

Motion made and carried that the names of the shareholders remain on the assessment roll of said town as they are now therein found.

Motion made and carried that the Board proceed to sign the tax rolls as soon as convenient.

Mr. VanHorne presented an application for an Armory in Masonville. Application and certificate read and on motion lean granted to have an armory in said town.

Resolved that the several legally and organized companies of the 27th and the 100th Regiments N.Y.S.N.G. be authorized to procure suitable armories at the expense not exceeding fifty dollars each for the safe keeping of the arms and uniforms belonging to the State and now in possession of said containers. Ayes and noes called: Messrs. Burhans, Champlin, Dibble, Dowie, Eells, J. H. Graham, H. R. Graham, Kerr, Owens, Sines, Siver, Storie and VanHorne vote aye. Messrs. Foote, Rich, Seely and Shaw voted noe. Motion decided carried.

On motion of Mr. Foote

Resolved that the County Superintendents of the Poor and the County Treasurer have the public buildings insured at the usual rate of insurance.

Motion made and carried that the Superintendents of the Poor proceed to collect the account assessed the Town of Delhi for the keeping of Mrs. Terry at the Poor House out of the property of Mr. & Mrs. Terry and reimburse the town.

Mr. Charles A. Foote, County Treasurer, presented to the Board his statement to the chief of the Bureau of Military Record, which statement contained the amounts of money raised by tax and loans for war purposes by the County of Delaware and also his certificate of the correctness of the statements which on motion was ordered to be signed by the Chairman and Clerk of the Board.

On motion of Mr. Burhans

Resolved that Messrs. Gordon, Clark & W. Murray, Jr. be employed as attorneys and counsel in the case of the "Delaware Bank vs: The Board of Supervisors of Delaware County". To put in an answer to the Mandamus served on said Board and that they attend to the same in hearing thereof to a final decision.

A claim in favor of Calvin Howard of $7.23 was allowed.

On motion of Mr. Foote

Resolved that W.P. Lynch be allowed the sum of two hundred & seventy five dollars for his services as Clerk of the Board of Supervisors.

On motion of Mr. Storie

Resolved that the salary of the Dist. Atty. be raised to and fixed at the sum of five hundred dollars.

Resolved that the suit heretofore commenced by William Martin and others against the Board of Supervisors be discontinued. The attys. for the plaintiff's consenting each part to pay their own costs.

Mr. Storie moved that the committee on Supervisor's accounts be instructed not to allow any charge for stamps on Supervisors Bonds.

Mr. Shaw offered the following resolution

Resolved that the town and county accounts be published in the Delaware Republican, Del. Courier and the Equalization Table, Official Canvas of the County Judge's Report, County Treasurers Report, Report of the Commissioners of Excise, Report of the Superintendents of the Poor, Supervisors Bills and any other matters relating to the proceedings of this Board required by law to be published in the Delaware Republican. Ayes and Noes called by Mr. Siver. Ayes: Messrs. Champlin, Dowie, Eells, Foote, J. H. Graham, H. R. Graham, Owens, Rich, Shaw, Storie. 10. Noes: Messrs. Burhans, Twaddell, Dibble, Kerr, Seely, Sines, Siver and VanHorne. Resolution declared adopted.

On motion Mr. Dowie and Burhans excused from further attendance at the present meeting. Mr. Seely excused from further attendance.

The committee on Supervisors bills reported & report received ad adopted and committee discharged and the several bills were allowed as in the report recommended. A bill of J. S. McNaught, Supervisor $11.12 was presented and allowed. The following bills in favor of the following named persons late supervisors were presented and allowed as follows:

Edwin Twaddell, claimed $9.92, allowed.

Aaron Ford, claimed $4.56, allowed.

A bill in favor of Alexander Shaw for services as special committee upon business with the Commissioners of Emigration of the City of New York was presented and allowed at $15.00. The chairman then returned his thanks to members of the Board for their courteous conduct and for the aid they have rendered him in the discharge of his duties. Thanks also were extended to the Clerk of the board &his assistants.

Annual Report of the Superintendents of the Poor for 1865



The Superintendents of the Poor of Delaware County, present to the Board of Supervisors the following Annual Report:

There has been expended for the support of the poor at the County Poor House, from Nov. 1st, 1864, to Nov. 1st, 1865 $3,590.37

Which sum includes expenses of clothing, provisions, and physician's bill at the house, keeper's salary, and all the incidental expenses necessary to carry on the poor house farm.

There has been had by the poor, at the house during the year, 2528 weeks and 3 days' board, at an average cost of $1.42-100 per week.

Of that number of weeks board there has been had by the poor belonging to the several towns, for the year ending Nov. 1st, 1865, 1917 weeks and 3 days board at $1.42-100 per week, amount to the sum of $2722,75

The whole number of poor supported at the Poor House the year ending Nov. 1st, 1865 was 80; of which 26 were county poor, and 54 town poor. Discharged 29; died 6; remaining in the Poor House Nov. 1st 1865, 45 - Insane 11; idiots, 12.

The stock remaining on the farm, Nov. 1st, 1865 was: One yoke of stags, 9 cows, 2 two year old heifers; 2 yearling heifers, 3 calves, one pair of two year old stags; one two year old bull, 7 lambs, 4 shoats, 3 fat hogs.

There has been raised on the farm 2400 sheaves of rye, 128 bushels oats, 150 bushels buckwheat, 375 bushels ear corn, 5 bushels peas, 51/2 bushels beans, 228 bushels potatoes, 130 bushels turnips, 16 bushels onions.

The Superintendents think the sum of $1200 in addition to the amount due from the several towns, and the amount in the Treasury will be sufficient for the ensuing year, to pay the current expenses.

All of which is respectfully submitted.

I further report that, Dec. 20, 1864, I made an order sending A. Henderson to the Lunatic Asylum, from Andes, by consent of Overseers of the Poor from that Town.

1865, March28, made an order sending Betsy Hawley to the Lunatic Asylum from

Franklin, on the request of the Overseers of the Poor of that Town.

May 3d, made an order sending Mary Hunt to the Lunatic Asylum from Harpersfield, at the request of Overseers of Poor in that Town.

Sept. 24, made an order sending Sarah Sprague to the Asylum, from Hancock, by consent of Overseers of the Poor of that Town.

I also received a notice from the Superintendents of the Asylum, that a Miss Henderson from Andes, had been there over two years, and if continued, it should be at the expenses of the county, of which I notified one of the Superintendents of the Poor, and also one of the Overseers of the Poor of the Town of Andes.
