At a meeting of the Board of Supervisors of the County of Delaware held Nov. 15th, 1859 the following Supervisors were present. (Except Mr. Devereux)

The Board proceeded to elect a Chairman upon which, Samuel Gordon received 11 votes, William Simpson, Jr. received 6 votes.

On motion of Mr. Dayton, Samuel Gordon was then declared unanimously elected.

Mr.Clark then moved to delay further organization until tomorrow at 2 o'clock p.m. which motion was declared carried. The ayes and noes being called for by Mr. Dutton stood as follows:

Ayes: Benjamin, Archibald, Downs, Simpson, Doyle,Clark, Bradford. 7

Noes: Gordon, Noble, Shaw, Dayton, McCune, Kentfield, Dutton, Scudder, Andrews, Bassett. 10

On motion the Board proceeded to elect a Clerk when:

Allen S.Gibbs received 9 votes. Eleazer D. Peake received 6 and Amos Douglas received 1.

On motion Allen S. Gibbs was then declared unanimously elected.

The Board then adjourned till Wednesday morning at 8 o'clock.

Wednesday Morning

The Board met pursuant to the above adjournment.

On motion resolved that the Clerk procure stationery for the use of the Board.

The Board met at 3 o'clock when the Supervisor from the several towns presented the amounts of town accounts as audited by the Boards of Town Auditors together with the Town appropriations for highways & bridges and for the support of the poor, which were ordered to be levied upon the several towns, as follows:

Mr. Downs from the Committee on Court House & Jail, offered the following resolution which was adopted.

Resolved that the Sheriff be authorized to put bars on the windows & door of the jail at the expense not to exceed $15.

On motion of Wm.Clark

Resolved that the Clerk of this Board in estimating the taxes of the several towns of this County as provided in the revised statutes add to the amount of town and county charges the sum of $20,525.88 together with the Treasurer fees which amount is to be paid by the County Treasurer into the State Treasury according to acts passed as per Chap. 180 Laws 1856, Chap. 149 Laws 1859, Chap. 383 Laws 1859.

On motion of Mr. Clark

Resolved that Marshall Shaw be allowed to act as Supervisor of Hamden in place of Alexander Shaw who has leave of absence.

Mr. Shaw then took the constitutional oath and entered upon the duties of his office.

On motion of Mr. Clark

Resolved that the County Clerk be authorized to procure copies of the Second Edition of the Supervisors Book for each Supervisor in the County.

On motion of Mr. Clark

Resolved that Messrs. Archibald, Benjamin & Andrews be appointed a special committee to examine a claim by the Town of Tompkins to have certain monies refunded by the County which are claims to have been overpaid by said Town.

On motion of Mr. Clark

Resolved that School District No. 7 in the Town of Davenport be authorized to lay a tax of $65.56 on the taxable property of said district to pay a certain bill of costs incurred by said district.

The Board then adjourned till Thursday morning at 10 o'clock.

Thursday Morning

Board met pursuant to adjournment.

On motion of Mr. Clark it was

Resolved that a standing committee of three be appointed by the Chairman to examine printers claims. The Chair then appointed Messrs. Devereux, Noble & Dayton as such committee.

By resolution offered by Mr. Clark the following sums were authorized to be raised on the town of Middletown.

For building River bridge account audited by Board of town auditors under act of 1858. Certificate assigned to Lemuel Sines $322.00 interest $16.91, Total $338.91.

For building Gulf bridge under act of 1858 certificate assigned to Cyrus Mead audited and certified by board of town auditors. $83.50 interest $1.44, Total $83.94.

For the support of roads & bridges for the ensuing year pursuant to report of Commissioners of Highways $250.00 pursuant to a resolution adopted at the last annual town meeting of Middletown, the Board of Supervisors hereby authorized the sum of $300.00 to be raised from the Town of Middletown and intheir warrant direct the collector of said town to pay the said sum to William Swart and Isaac Birdsall to be paid by them on the order of the Commissioner of Highways of said town for the building and improvement of the road leading from David Akerly's over Akerly Hill to the store of Swart & Birdsall in the Town of Middletown. $300.00

(Embraced before in town accounts) Total for Highways $972.85

On motion of Wm. Scudder the Board adjourned till 2 o'clock.

2 o'clock the Board met pursuant to adjournment.

Stephen C. Johnson, Esq. appeared to make application in behalf of the Delaware Bank requesting to be stricken from the tax roll and allowed to settle with the Treasurer on the ground that the Bank was not earning 5 per cent on its capital stock. On motion it was Resolved that the application be granted.

Charles Knapp, President of the Deposit Bank, sent in an application similar to the above the hearing of which was deferred in order to permit Barna Radeker, Esq. one of the directors of said Bank to prepare an affidavit concerning the same.

On motion of Wm. Clark

Resolved that the sm of $7.90 be raised on the Town of Middletown and the sum of $3.68 be raised on the County of Delaware and paid to Silas Tompkins to reimburse him for monies paid erroneously in the year 1858.

On motion

Resolved that the sum of $57.64 be raised on the following towns on account of tax rolls falling short of the several amounts directed to be paid over viz: Colchester, $10.40, Masonville, $1.87; Kortright, $4.53, Tompkins, $22.74.

On motion it was

Resolved that the report of the committee to settle with the Treasurer be accepted.

On motion

Resolved that the report of the County Judge be accepted.

On motion

Resolved that the sum of $20 be raised on the county for the relief of Eliza Simmons at the Institution of the Blind , and that the further sum of $40 be raised on the county for the Institution for the Deaf and Dumb for the relief of Francis Seeley and Stephen W. Fitch.

On motion

Resolved that the Board adjourn until eight o'clock a.m. Friday in order that the different committees may be enabled to make their reports.

Friday Morning

The Board met pursuant to adjournment. The minutes were read and approved.

On motion of Wm. Clark

Resolved that the application of the Deposit Bank be made the special order for Saturday morning at 8 o'clock.

On motion of Wm.Scudder

Resolved that the vote releasing the Delaware Bank from the tax rolls be reconsidered. It was made the special order for Saturday morning at 8 o'clock.

On motion of Mr. Devereux

Resolved that the County Treasurer be requested to present a statement to this Board of the amount necessary to be raised as a contingent fund for the ensuing year.

The Clerk was then directed to serve a notice of the same upon the Treasurer.

The Committee on Equalization made the following report:

Resolved that the Clerk of the Board alter the assessment of the several towns so as to make the equalized assessments as follows:

Andes Seven Dollars & Fifty Cents per acre

Bovina Ten Dollars per acre

Colchester Four Dollars fifty cents per acre

Davenport Fourteen Dollars per acre

Delhi Seventeen Dollars per acre

Franklin Seventeen Dollars per acre

Hamden Ten Dollars per acre

Hancock Six Dollars fifty cents per acre

Harpersfield Fifteen Dollars per acre

Kortright Twelve Dollars and fifty cents per acre

Masonville Nine Dollars fifty cents per acre

Meredith Twelve Dollars per acre

Middletown Seven Dollars and fifty cents per acre

Roxbury Thirteen Dollars per acre

Sidney Fourteen Dollars per acre

Stamford Fifteen Dollars per acre

Tompkins Seven Dollars fifty cents per acre

Walton Ten Dollars per acre

Resolved that the Clerk reduce the Equalization so that the aggregate amount of the equalized value of the real estate of the several towns shall be the same as the aggregate assessed value thereof.

Mr. Doyle moved to amend the report so as to reduce the town of Hancock to Four Dollars and fifty cents per acre the motion was lost.

The ayes and noes being called stood as follows:

Ayes: Messrs. Downs, Doyle, Clark, Devereux. 4

Noes: Messrs.Benjamin, Archibald, Gordon, Simpson, Noble, Shaw, Dayton, McCune, Kentrifield, Dutton, Scudder, Bradford, Andrews, Bassett. 14

Wm. Doyle then moved to reduce Hancock to Five Dollars per acre which was lost.

Wm. Doyle moved to reduce it to six dollars per acre. Motion lost.

The ayes and noes being called stood as follows on the last motion:

Ayes: Messrs. Downs, Doyle, Clark, Devereux, Bassett, Simpson. 6

Noes: Messrs. Benjamin, Archibald, Gordon, Noble, Shaw, Dayton, McCune, Kentfield, Dutton, Scudder, Bradford, Andrews. 12

On motion

Resolved that the report be adopted as made by the committee a vote being called for stood as follows:

Ayes: Messrs. Benjamin, Archibald, Gordon, Simpson, Noble, Shaw, Dayton, McCune, Kentfield, Dutton, Scudder, Bradford, Andrews, Bassett. 14

Noes: Messrs. Downs, Doyle, Clark, Deverusx. 4

The report was declared adopted.

Mr. Clark offered the following preamble and resolution which were adopted.

Whereas it is alleged that an encroachment upon the Public Square in the Village of Delhi which lands are the property of Delaware County now exists, Therefore

Resolved that a committee of three be appointed by the Chairman of the Board of Supervisors to investigate the matter and report at this session of the Board.

The Chairman then appointed Messrs. Clark, Doyle & Noble as a committee to make such investigation and report.

On motion of the Supervisors the following sums were ordered to be charged and assessed to their several towns:

Andes $1.40 Meredith $1.25

Bovina $4.50 Middletown $19.50

Davenport $1.00 Roxbury $2.50

Hamden $1.50 Stamford $1.50

Tompkins $1.40

Also the sum of $4.50 was ordered to be taxed to the Town of Tompkins and $3.50 to Masonville and credited to Franklin. And the sum of $21 to be taxed to Franklin and credited to Walton.

On motion

Resolved that the Town of Bovina be allowed to raise the sum of $250 (embraced with town account) for roads and bridges.

The Board then adjourned till one o'clock p.m.

One o'clock p.m.

The Board organized when Mr.Downs presented a memorial asking that the sum of $300.00 be allowed by the County to be paid towards rebuilding bridges in the Town of Colchester which have been destroyed by the elements.

This memorial was made the special order for Saturday morning at eight o'clock.

Mr. Doyle presented a bill in favor of John Norwood requesting to have $30 allowed against the County for taking care of paupers $20 of the same to be allowed to said Norwood and $10 to be allowed to Reeves & Allison. The bill was allowed.

The sum of $2.88 was allowed to R. W. Elwood for returning collector's bonds.

On motion of Mr. Simpson

Resolved that the sum of $50 be deducted from the appropriation for poor in Davenport.

On motion of Mr.Gordon

Resolved that $50 be raised on the Town of Delhi for the support of Poor for the ensuing year.

On motion of Wm. Andrews

Resolved that the sum of $203.48 be deducted from the Poor allowance in Stamford.

The Board then adjourned till eight o'clock Saturday morning.

8 o'clock Saturday

Board met pursuant to adjournment when the minutes of the preceeding day were read and approved.

The application of the Deposit Bank being the special order Mr. Johnson proceeded to read affidavits of Charles Knapp the president and Barna Radeker a director of the bank stating that said bank was not in receipt of 5 per cent on its capital stock and asking to be stricken from the rolls and allowed to settle with the County Treasurer the motions was denied.

The ayes and nays being called for stood as follows:

Ayes: None

Nays: Messrs. Benjamin, Archibald, Downs, Gordon, Simpson, Noble, Shaw, Dayton, Doyle, McCune, Kentfield, Clark, Dutton, Scudder, Bradford, Andrews, Devereux, Bassett. 18

On motion

Resolved that the report of the Committee on Poor House be accepted.

On motion of Mr. Devereux

Resolved that a committee of three be appointed to examine the Poor House and report what shall be done with regard repairing, rebuilding or otherwise disposing of the Poor House and its lands.

On motion of Mr. Clark

Resolved that the Committee on Poor House act as such committee.

On motion of Mr. Clark

Resolved the sum of Four Dollars charged by P. W. Smith to the towns of Masonville and Sidney be stricken rom the accounts.

On motion

Resolved the report of the committee on town accounts be accepted or amended.

R. Parker, Esq. in behalf of the Delaware Bank offered the following Preamble and Resolution which was ordered to be copied on the minutes of the Clerk.

The President of the Delaware Bank having by his own affidavit proved to the satisfaction of this Board that the Delaware Bank an incorporated company included in the assessment roll of the town of Delhi Delaware County has not been during the preceding year in the receipt of next annual profits or clear income equal to five per cent on the capital stock of said company paid in or secured to be paid in after deducting from the amount of their capital stock the assessed value of the real estate, Therefore

Resolved that said Delaware Bank shall be entitled to commute for its taxes on its capital stock by paying directly to the Treasurer of said County a sum equal to five percent on its next annual profits or clear income and also such further sum as shall have been assessed on said roll of said Town on the real estate of said Bank.

The motion was denied. The ayes and nays stood. Ayes. None. Nays. 18.

At the request of Mr. Johnson the above Preamble & Resolution was allowed to be altered and applied to the Deposit Bank.

The application Mr. Downs being the next in order was put to vote with the following result.

Ayes: Messrs. Archibald, Downs, Gordon, Shaw, Doyle, Clark, Bradford, Benjamin. 8

Nays: Messrs. Simpson, Noble, Dayton, Dutton, McCune, Kentfield, Scudder, Andrews, Devereux, Bassett. 10

On motion of Mr. Devereux

Resolved that the Sheriff of Delaware County be ordered to prohibit all exhibitions that have heretofore been allowed the free use of the Court House and further to prohibit the free use of the Court House for Town meetings or Town caucuses also that he shall prohibit the use of the Court Room and Jury Room for a play house for the boys of the Town of Delhi.

On motion

Resolved that the report of the Committee on Justices and Constables accounts be accepted.

Also Resolved that the report of the Committee on Court House and Jail be accepted and that the sum of Three Thousand Dollars be raised on the Count to defray the expenses of making repairs on the Court House.

On motion of Mr. Downs it was

Resolved that James Ellwood, Gabriel S. Mead and Horatio N. Buckley be appointed a committee to repair the Court House.

On motion

Resolved that the time of the Committee to report on the encroachment upon the public grounds be extended until the next meeting of the Board.

A motion was made to amend the report of the Committee on county claims by striking out $200 allowed to the School Commissioners as expenses. Lost.

The Committee to visit the Poor House made a report highly commending the management of the keeper and requesting that he be retained for another year providing that he would consent to remain at a fair compensation. The report was adopted.

Mr. Downs presented a memorial asking that the sum of $150.00 be raised by the County and given to the Town of Colchester to assist in building bridges. The application was lost. The ayes and nays being called stood.

Resolved that the sum of $1585.56 be raised on the Town of Colchester to defray town expenses & for highway & bridge purposes.

Resolved that the sum of $25 be deducted from each of the School Commissioners accounts for expenses.

Resolved that the account of the Sheriff and his deputies be allowed as audited.

Also that the accounts of the Superintendents of the Poor be allowed.

Resolved that the sum of $20 be allowed to the N. Y. Asylum for Idiots for the relief of Maargaret Comack of Delhi.

Resolved the Clerk in making out the assessments shall in those rolls which have been corrected assess the rejected taxes back upon the lands so rejected. Also that on those rolls which have not been corrected the rejected taxes be assessed back upon the town.

On motion of Mr. Devereux

Resolved that the several bills audited to printers be allowed as audited.

On motion of Mr. Clark

Resolved that one copy of the index to the Laws of New York be disposed to use of the District Attorney and one copy to the use of the Board of Supervisors.

Resolved that the Committee on encroachment be allowed to take testimony concerning the same if necessary.

Resolved that the amendment to the report of the Committee on County Claims striking $25 from the bills of each of the School Commissioners be reconsidered and that they be allowed the full amount thereof.

On motion of Mr. Devereux

Resolved that vote appropriating $300.00 for the support of poor in the Town of Tompkins as was recommended by the town auditors be reconsidered and that the sum of $200.00 be allowed instead.

Resolved that $32.54 be allowed to Thomas Harby for bars on door & windows of jail.

Resolved that the session be published in the Delaware Express & Franklin Visitor, that the town and county accounts be printed in the Delaware Gazette, Bloomvlle Mirror and Deposit Union Democart, the Equalization of the Assessment Rolls in the Del. Express & Franklin Visitor. Report of the Superintendents of the Poor in the Star of Delaware and Deposit Union Democrat, and the County Judges Report and notices of the School Commissioners in the Bloomville Mirror and Deposit Union Democrat.

On motion of Mr. Downs

Resolved that the report of the Superintendents of the Poor be accepted and the sum of $2000.00 be raised on the county for the support of the poor.

Resolved that $4.00 be allowed to Dr. A. Fitch and charged to the county.

On motion of Mr. Scudder

Resolved that the vote rejecting the account of Dr. L. G. Sherman be reconsidered and that $5.00 be allowed on said account.

Resolved that $18,000.00 be raised on the County to defray county expenses including $2,000.00 already appropriated to the poor fund.

Tuesday Dec. 13th, 1859 2 o'clock P.M.

The Board met pursuant to adjournment and a quorum being present proceeded to business.

A communication was received from Mr. J. P. Benjamin that he was unable to be present on account of illness and requesting to have A. B. Douglas substituted in his place. Mr. Douglas by a vote of the Board was permitted to act as such substitute and after taking the constitutional oath acted as one of the Board.

W. Murray, Esq. appeared before the Board and requested the highway appropriation for the Town of Bovina of $250.00 be reconsidered and that the sum of $1500.00 be substituted in its place a vote being called for stood as follows:

Resolved that the sum of Three Hundred ($300) Dollars illegally appropriated to build a road over Akerly Hill in the Town of Middletown be rescinded.

On motion of Mr. Clark

Resolved that the Commissioner of Excise report to this Board of Supervisors their present session the names of all persons prosecuted by their direction for violation of the excise law and the different amounts of money including costs, received by them and their attorney's from each person so prosecuted and also each and every amount received by them for such violation where no prosecution has been had. Such report to extend to the last two years.

On motion of Mr. Devereux

Resolved that the account of G. W. Reynolds assigned to Otis Abell for $87.00 be allowed as charged.

On motion of Mr. Shaw

Resolved that whereas the town of Hamden in the County of Delaware by a vote of the electors of said town taken at the annual town meeting held in said town on the 8th day of February 1859.

Resolved that the said town be authorized and empowered to borrow Three Thousand ($3000) Dollars for the purpose of building three bridges in said town to be paid within ten years with interest and -- therefore Resolved that the said Town of Hamden be hereby authorized & empowered to borrow the sum of Three Thousand ($3000) Dollars to build three bridges in said town to be paid as follows to wit: The interest to be paid annually on the first days of February of each year on all sums unpaid, at seven (7) percent of the principal, Five Hundred Dollars on the first day of February 1861 and Five Hundred Dollars on the first days of February each year thereafter until the whole sum of Three Thousand Dollars is paid.

The Board then adjourned till 8 o'clock tomorrow morning.

Dec. 14th

The Board met at eight o'clock when Mr. Douglas offered the following

Resolved that the Clerk proceed immediately and place an equalized column in each of the assessment rolls in accordance with the resolution of the equalizing committee. Carried.

On motion of Mr. Downs

Resolved that a committee of three be appointed to decide upon the number of Grand Jurors to be returned by the Supervisors of each town.

The Chair then appointed Messrs. Downs, Clark and Simpson as such Committee.

The report of Committee to Settle with Loan Commissioners was received and accepted.

Mr. Andrews moved to raise $750.00 on the Town of Bovina in addition to the $250 already raised. Mr. Clark moved to lay the resolution on the table. The ayes and nays being called stood:

On motion of Mr. Douglass

Resolved that the Board proceed to ballot for printers of the Session Laws as required by law.

The Board then proceeded to ballot when the Delaware Express rec'd. 10 votes and the Delaware Gazette rec'd. 8 votes. Whereupon the papers aforesaid were designated to print such laws.

On motion of Mr. Clark

Resolved that the vote on printing the Session Laws for 1860 as passed by the last meeting of the Board be rescinded the same having been passed contrary to law.

Mr.Shaw moved that the entire vote on printing as passed at the last meeting of the Board be reconsidered.

Mr.Clark objected as out of order. The Chair overruled the objection. Mr. Clark appealed & the Chair was sustained. The vote being called on the motion of Mr. Shaw stood.

Ayes: Messrs. Gordon, Noble, Shaw, Dayton, McCune, Kentfield, Dutton, Scudder, Andrews, Bassett. 10

Resolved that the County Treasurer be directed to continue or affect a new insurance on the County buildings, Court House & Jail and pay the same from the general fund.

Resolved that the Town and County accounts and Equalization of the Assessment Rolls be published in the Franklin Visitor, Bloomville Mirror and Deposit Union Democrat. The report of the Superintendents of the Poor in the Star of Delaware and Delaware Gazette, the County Judges report in the Delaware Express & Franklin Visitor, the School Commissioners notices in the Deposit Union Democrat, Franklin Visitor & Bloomville Mirror.

The bonds of Almeron Cartwright and George Wright as Superintendents of the Poor were received and approved.

Gabriel S. Mead appeared before the Board and tendered his resignation as Inspector of Turnpikes & Plank Roads, which was accepted and Thaddeus S. St. John appointed in his place.

The Board adjourned till 2 o'clock p.m.

The Board met at 2 o'clock when Mr. Archibald requested leave of absence until Friday morning.

The report of Committee on encroachment was made the special order for tomorrow at 8 o'clock a.m.

The report of S. Cooke, Commissioner of Excise was rec'd. and accepted.

An account of $3.00 against the County was presented by Seymour Cooke which was allowed.

The salary of the County Judge was made the special order for 9 o'clock tomorrow.

On motion of Mr. McCune

Resolved that the report of the Commissioner of Excise be published in the Bloomville Mirror.

The Board adjourned till 8 o'clock Thursday morning.

15thThe Board met at 8 o'clock and voted to reconsider the vote raising $750.00 additional on the Town of Bovina making it the special order for Friday morning at 9 o'clcock.

The Board then proceeded to examine the case of encroachment a vote being taken on having the same removed stood.

Ayes: Messrs. Archibald, Gordon, Simpson, Noble, Dayton, Doyle, McCune, Clark, Dutton, Scudder, Bradford, Andrews, Devereux, Bassett.

Nays: Messrs. Douglass, Downs, Shaw, Kentfield.

The Board then received a release of his title to the premises from Mr. Hathaway which was accepted, contracting to remove the encroaching building within two years.

The County Judges salary being the next in order was fixed at $1000.00 per year as heretofore.

On motion of Mr. Andrews

Resolved the District Attorney salary be fixed at $400 per year.

The report of Committee on Poor House was accepted and William Andrews of Walton, Horace Griswold of Delhi and John McDonald of Kortright appointed a committee to examine in relation to repairing, rebuilding or otherwise disposing of the Poor House & appurtenances said committee to report to the next Board of Supervisors.

The following Sheriff's accounts were allowed viz: A. H. Burhans $18.00, F. Griffin, $6.90.

On motion of Mr. Shaw

Resolved that $3.65 be charged to the town of Hamden and allowed to William Lewis for Justice of the Peace.

On motion of Mr. Clark

Resolved that the report of the Superintendents of the Poor be accepted.

Mr. Douglass offered a Preamble and Resolution directing the clerk to notify the comptroller of a deficiency in the U.S.D.Fund in order that he may take such action in the premises as he may deem proper. The resolution was adopted.

The Board then adjourned till Friday morning at 9 o'clock. Minutes approved.

6th Friday Morning. The Board met and taking up Mr. Clark's motin to reconsider the vote raising $750 on Bovina settled the question definitely by laying the $750 additional on the town and causing the roll to be changed so as t include that amount.

The vote stood.

Ayes: Messrs. Downs, Simpson, Shaw, Dayton, Doyle, McCune, Kentfield,Dutton,Scudder,Bradford, Andrews, Devereux, Bassett. 13

Nays: Messrs. Archibald, Gordon, Noble, Clark. 4

Mr. Douglass excused from voting.

Mr. Bradford moved to raise the salary of the Superintendents of the Poor to $2.00 per day on this motion the vote stood. Ayes 11. Nays 7.

The Committee on County Claims asked and obtained a discharged from further duty.

The Board adjourned till 2 o'clock p.m. at which time they met and again adjourned till 8 o'clock Saturday morning to enable the clerk to finish work.

7th Saturday 8 o'clock a.m.

Mr. Andrews moved to allow the clerk $180.00 for his services. Mr. Douglass offered an arrangement giving him $200.00. The amendment was lost, the motion of Mr. Andrews was to vote & carried.

On motion of Mr. Downs

Resolved that Mr. A. B. Douglass be allowed six dollars for attending to organize the first meeting of the Board.

The bills of the different Supervisors were then examined & passed.

Mr. Doyle of Hancock srved notices on the Chairman and Clerk of the Board, that he appeals to the Comptroller from the discussion of the Board fixing the Equalization on his Town.

On motion

Resolved that S. Gordon be appointed t take charge of the matter on behalf of the Board.

A vote of thanks was then given to Mr. Gordon for the able impartial manner with which he had presided over the Board.

Mr. Gordon returned his tanks to the Board for the honor conferred upon him when on motion the Board adjourned sine die. A. S. Gibbs, Clerk

The Superintendents of the Poor of Delaware County present to the Board fo Supervisors the following annual report:

There has been expended for the support of the poor at the County House from November 1st, 1858 to November 1st, 1859 the sum of $2,297.08.

Which sum includes expenses of clothing, provisions and Physician bills at the House, Keeper's salary, wages of hired man and all the incidental expenses to carry on the Poor House.

There has been had by the poor at the House during the current year, 2,572 weeks and 4 days board, at an average cost of 89 1/4 cents per week. There has been paid for the transportation of the poor from the following towns, $18.59, as follows:

Which sum is not charged in the Board of the several towns, as it does not constitute any part of the expense at the Hosue, but should be charged to such towns in addition to their board.

There remains to be charged to the county 670 weeks and 3 days board at 89 1/4 cents per week, which amounts to the sum of $ 599.12

To which add the amount charged the several towns 1,697.96

Which makes the expenses for the year as above stated 2,297.08

There was raised last year to pay old debts 2,719.45

Of this amount the Superintendents audited paid bills that accrued

previous to November 1st, 1857 407.72

The Treasurer paid the balance for monies borrowed 2,311.73

$2,719.45

There was raised and placed to the poor fund for current expenses

The sum of $2,000.00

There was due the county from the several Towns for the support

Of their poor at the House 1,440.37

There have been fines received and paid into the poor fund 45.00

Which leaves the poor fund in debt $ 183.47

As there is a larger amount due the count from the several towns than there was lst year, the Superintendents think the sum of $2,000 raised will be sufficient for cuurent expenses and pay the balance the poor fund is in debt.

The whole number of poor supported at the Poor House was 98. Of this number 36 were county poor and 62 were town por. Discharged 40, bound out 8, died 6, remaining in the Poor House, November 1st, 1859 44: idiots, 9; insane, 13; deaf and dumb 1.

There has been raised on the farm:

1,470 sheaves of rye 5,352 sheaves of Oats

275 bushels of Potatoes 21 bushels of Onions

20 bushels of Carrots 30 bushels of Beets

5 bushels of Parsnips 150 bushels Ruta Baga Turnips

About 12 firkins of Butter 300 heads of Cabbage

About 27 Tons of Hay. 2 ½ bushels of beans

REPORT OF THE COMMISSIONER OF EXCISE OF THE COUNTY OF DELAWARE

To the Board of Supervisors of the County of Delaware:

In obediance to a resolution served upon the undersigned, one of the Commissioners of Excise in and for the County of Delaware on the 13th of December, 1859, "that the Commissioners of Excise report to this Board of Supervisors at their present session, the names of all persons prosecuted by their direction for violations of the excise law, and the different amounts of moneys including costs, received by them and their attorneys from each person so prosecuted, and also each and every amount received for such violations where no prosecution has been had; such report to extend to the last tow years"-begs leave to submit the following Report:

That the following actions have been commenced in the name of the Board of Commissioners above named by their late attorney, William Murray, Jr., and the same are still pending, have been settled or are in judgment, or have been disposed of in the manner hereinafter stated, to wit:

Supreme Court

The Board of Commissioners of Excise of the County of Delaware agt Jacob More. The Deft. appeared by his Attorney and interposed a defence, and the action is undetermined and still pending.

The same agt. George Dixon. Judgment obtained $100 damages, costs $38. The Deft. paid to the Plffs. Attorney the costs and twenty dollars ($20) of the damages. The Plff. gave the Deft. a stipulation, if he committed no further violations of the Excise law, the balance fo the judgment should not be collected.

The same agt. Wm. Stratton. The Deft. died soon after the commencement of the suit, and thereupon the action was discontinued by Plff.

The same agt. John Burtch. Judgment obtained for $100 damages. Costs $17.50. Deft. has paid the costs and the Plff. gave same stipulation as mentioned in the action against Dixon.

The same agt. Smith Haner. Judgment obtained for $50 damages. Costs $56.66. Nothing paid or collected.

The same agt. R. Houghtailing. Judgment for $50 damages. Costs. $18.68. The Deft. has paid Plff's. Attorney the costs, and took a like stipulation as mentioned above in the cases of Dixon and Burtch.

The same agt. B. McCall. Judgment for $100 damages. Costs. $19. Nothing has been paid by or collected of the Deft. and he is deemed irresponsible.

The same agt. T. Goodrich. Judgment for $100 damages. Costs $28. Nothing paid or collected.

The same agt. Leman P. Reed. Judgment for $100.00 damages. Costs, $19.27. The Deft. paid Plff's. Attorney the costs and recieved a stipulation from the Plff. of the same characgter as in the case of Dixon and others mentioned.

JUSTICE'S COURT

The same agt. Issac Swart. Judgment for $100.00 damages and costs. The Deft. has paid the Plff's. costs and fifteen dollars damages, which were paid to the town where Deft. resides, to wit: the Town of Davenport. Plff. gave Deft. a stipulation as in the cases of Dixon and others, as above mentioned. The Deft. also paid Plff's. Attorney for his services of $5.00.

JUSTICE'S COURT

The same agt. Benjamin B. Wade. Judgment for $100.00 damages and costs. The Deft. paid Plff's. costs five dollars to Plff's. Attorney for his services and fifteen dollars for damages. Plff. gave a stipulation, as above mentioned to the Deft.

JUSTICE'S COURT

The same agt. John Mead. Judgment for $100.00 damages and costs. Nothing paid or collected.

JUSTICE'S COURT

The same agt. Hiram Hitt. The Deft. paid Plff's costs and five dollars to Plff's. Attorney for his services, and action discontinued.

JUSTICE'S COURT

The same agt. Joselyn. This action, on advice given by the Overseers of the Poor to Plff's Attorney, was discontinued on payment of Plff's. costs and five dollars to Plff's. Attorney for his services.

JUSTICE'S COURT

The same agt.William Y. Burns. Action settled and discontinued on payment, by Deft. of Plf'f's. costs and five dollars to Plff's. Attorney for his services.

The undersigned would state that the twenty dollars paid to Plff's. Attorney in the case of Dixon, the fifteen dollars in the case of Wade, and five dollars in the case of Burns, have been paid over by the Plff's. Attorney to the County Treasurer of Delaware County, as required by the Statute.

The undersigned further reports that the following actions have been commenced by said Commissioners of Excise through its present Attorney, Stephen C. Johnson, and the same are still pending, or have been disposed of in manner following, to wit:

SUPREME COURT

The Board of Commissioners & c agt John Swart, of Davenport. Action commenced Aug. 15th, 1859, for violation of the 13th and 14th section of the Excise Law. Deft. has no license, has appeared by Attorney and interposed a defence and the action is still pending.

The same agt John Hunter, of Hancock. Action commenced August 17th, 1859 for violation of the 13th section of the Excise Law, and for selling strong and spirituous liquors on Sundays. The Deft. has a license as a tavern keeper, and on payment by him of the Plff's. Attorney costs and disbursements. to wit., the sum of $13.03 and the sum of $6.97 equal to the sum in the whole of $20.00, the action was discontinued and settled.

The same agt John Boyd of Meredith. Action commenced Sept. 7th, 1859, on complaint for violations of the !3th and 14th sections of the Excise Law. The Deft. has no license, has appeared by Attorney, and interposed a defence and the action is still pending.

The same agt William Rowland of Kortright. Action commenced Oct. 22nd, 1859 on complaint for the violation of the 13th section of the Excise Law, and for selling strong and spirituous liquors on Sundays. The Deft. is licensed as a tavern keeper and on payment by him of $12.50 the Plff's. Attorney's costs and disbursements, and confessing judgment for $50.00 the Plff. gave Deft. a stipulation not to collect the judgment unless in case of further violation of said law.

The same agt Hiram Hitt of Colchester. Action commenced Oct. 24th, 1859 on complaint for violations of the !3th and 14th sections of the Excise Law. The Deft. has no license, and on payment by him of the Plff's Attorney costs and disbursements, to wit: the sum of $12.50 and confessing a judgment for $50.00,the Plff. gave Deft.a stipulation, in substance, not to collect said judgment unless in case of further violation by said Deft.

The same agt John Swart of Davenport. Action commenced Nov. 24th,1859 on complaint for violations of the Excise Law, committed by said Deft, subsequent to the violations mentioned in the foregoing action against him. Det. has appeared by Attorney and answered the complaint, and the action is still pending.

The same agt Jonathan P. Flower of Delhi. Action commenced Nov.26th, 1859 on complaint for violations of the 13th section of the Excise Law, and for selling strong and spirituous liquors on Sundays. The Deft. has a license as a tavern keekper. He has not appeared nor answered the complaint; the action is still pending, the time for answering not having expired.

The foregoing actions are all that have been commenced by the Board of Commissioners of Excise above mentioned, that the undersigned has any knowledge of, and contains the names of all the Defendants or persons prosecuted as he is informed and believes true, within the last two years proceeding the day of the servcie of the above mentioned resolution of this Board on the undersigned. That no moneys have been received by the Board of Commissioners of Excise above mentioned nor by its Attorneys for violations of the said Excise Law where no prosecution have been had, to the knowledge and belief of the undersigned.

In conclusion, the undersigned further states that he is the only member of the said Board of Commissioners present, and the short time he has had to make this report, precludes him from making any extended remarks as to the reasons that have governed the Board in the disposition of the actions above mentioned. The undersigned would respectfully submit, however, that the governing principle with himself (and he believes with his colleagues) have been to enforce the provisions of the Excise Act, firmly, but not rashly or violently and where the Board have had satisfactory assurances from the persons prosecuted or otherwise, that they have been mistaken as to the provisions of said Act, or have evinced a disposition in future to observe its provisions; they deemed it best for the public interest not to insist upon the payment of the full amount of the sum recovered, or that might be recovered.

The Board being called to order by Allen S. Gibbs the former Clerk proceeded to ballot for Chairman, upon which James R. Allaben received ten votes and Horace Devereux received seven votes.

James R. Allaben was declared elected & after returning thanks to the Board for the honor conferred upon him took the Chair.

The Board then proceeded to ballot for Clerk whereupon Alex Cummings received 11 votes and B.F. Gerowe received 7 votes.

Alex Cummings was declared elected.

James R. Allaben presented a resolution. Mr. Bassett in the chair containing rules to govern the Board as follows-which was unanimously passed:

Resolved that the Rules laid down in the Supervisors Book as revised and enlarged by Ephraim Goss relating to the powers and duties of Super shall be adopted by this Board as standing rules by which they will hereafter be governed as contained in said book on pages two hundred and fifty eight to two hndred and sixty three inclusive with the following amendments & variations, to wit:

1. On Equalization, seven members.

2. On Justices & Constables claims, three members.

3. On County Claims, three members.

4. On Treasurers accounts, three members.

5. On Poor House and Superintendents report, three members.

6. On Court House and Jail, three members.

7. On Town accounts, three members.

8. On Sheriffs accounts, three members.

9. On United States Deposit Fund, three members.

After rules were adopted, a committee of three was appointed on printing by the Chair pursuant to vote of Board.

Mr. Devereux moved that the Board adjourn to Wednesday morning, Nov. 14. Carried.

Nov. 14. Board met pursuant to adjournment, the minutes of the preceding day read and approved.

The Chair then proceeded to appoint the Standing Committees, viz:

The Chair here presented bill for support of Margaret Cormack at the N.Y. Idiot Institution of $20.00 & also a bill for support of pupils in N.Y. Institution for Deaf & Dumb for $60.00 and referred each to the committee on County claims.

On motion of Mr. Devereux

Resolved that the rejected taxes be laid on the several lots which were taxed as far as the same can be ascertained otherwise the same to be laid on the towns in which the lands are situated.

On motion of Mr. Devereux the account of $200.00 for the chemical analysis of the stomach & c of Jams Herrington supposed to have been poisoned was referred to the Committee on County claims.

The Chair here presented and referred to the Committee on County Claims an account of A. S. Gibbs, late Clerk of the Board, for expenses & c of $1.40.

On motion of Mr.Devereux

Resolved that the amount of bail required of the Treasurer elect by Fifty Thousand Dollars.

Mr. Street presented an account of the Commissioner of Highways of the Town of middletown for disbursements incurred and prospective of $493.00

On motion of Mr. Davis, $250.00 was allowed on the preceding claim to be levied and collected on the taxable property of the Town of Middletown.

Mr. Davis presented the report of the Commissioner of Highways of Kortright which certified that $250.00 be raised in that Town for highway and bridges.

On motion of Mr. Noble

Resolved that $250.00 be levied and assessed on the taxable property of the Town of Kortright for highways and bridges.

Mr. Davis presented the town accounts of Kortright amounting to $252 00/100 which on motion of Mr.Devereux was allowed, Mr. Davis the claims of Mr. McCune, late Supervisor of $3.28 and John O.Thompson for excess of excise money of $30.00 referred to the Committee on County Claims, also an account of Jeremiah Cease,Constable,of $7.62 referred to the committee on Justices and Constables accounts.

Mr. Dayton presented the accounts of the Town of Harpersfield amounting to $127.19 ½ which on motion of Mr. Bolt was allowed.

Mr. Dayton also presented the account of N. P. Dayton, late Supervisor, amounting to $5.68 referred to the committee on county claims.

Also an account of Michael Odell, Constable, of $1.42 referred to the committee on Justices and Constables accounts. Also two certificates of the fence viewers of the value of sheep killed by dogs. One amounting to $20.00 value of sheep killed, $19.50 the other of $10.00 which certificates on motion of Mr.Simpson was made the special order for the 15th at two o'clcock p.m.

Mr. Street presented an account of Anson Dumond, constable of $3.44, referred to committee on Justices and Constables accts.

Mr. Elwood presented account of T. T. Signor, constable, of $13.50, referred to committee on Justices and Constables accounts. Also a bill for services of coroners jury in case of Levi Raynor which was referred to committee on county the bill amounting to $108.00.

Also three certificates on non payment of highway labor on non resident lands in Colchester.

On motion of Mr. Devereux

Resolved that the same be levied and collected on the several lots on which it was passed.

Mr. Bassett presented the town accounts of the Town of Walton amounting to $1214.85 including $250.00 to Commissioners of Highways and $300.00 to Poor Fund, which on motion of Mr. Bassett was allowed.

Mr. Wheeler presented the town accounts of the Town of Hancock amounting to $1178.92 including $400.00 for highway and bridge purposes and $150 for support of Poor which on motion of Mr. Devereux was allowed.

Mr. Wheeler also presented an account of $13.50 of John Lord for taking A. Christ to Deaf & Dumb Asylum referred to committee on County claims.

Also an account of E. F. Wheeler, Justice of $5.55. Referred to committee on Justices' accts.

Also an account of Samuel Doyle, late Supervisor of $8.72. Referred to committee on County claims.

Also an acct. of Wm. Crefson, Deputy Sheriff, of $14.32. Referred to committee on Sheriff's accounts.

Mr. Harley presented the town accounts of the Town of Roxbury amounting to $296.91. On motion of Mr. Davis the same was allowed.

Mr. Harley also presented the certificate of the Commissioners of Highways for raising $60.00 for highways & bridge purposes. On motion of Mr. Elliott

Resolved that the same be assessed to the Town of Roxbury.

Also account of Ezekiel Preston, Clerk of the Board of Excise of $30.98 for services and disbursements. Referred to committee on County claims.

Mr. Brownell also presented town accounts of the Town of Stamford amounting to $194.82, which on motion of Mr. Elliott was allowed.

Mr. Brownell also presented the report of the commissioners of Highways of requiring $250.00 to be raised for highway and bridges purposes. On motion of Mr. Noble

Resolved that the same be assessed and levied on the Town of Stamford.

Mr. Hawver presented the town accounts of the Town of Andes amounting to $308.35 and $250.00 for highway and bridge purposes. On motion of Mr. Davis
