At a meeting of the Board of Supervisors of the County of Delaware in their room in the Court House in the Town of Delhi on the third Tuesday of June 1857 in pursuance of an act entitled "an act for the apportionment of the members of assembly of this State" passed by the Legislature of this State on the 13th day of April, 1857.

James R. Allaben, Clerk called the Board to order and the following named persons appeared from the several towns as Supervisors:

Mr. Burhans, Supervisor from Roxbury moved that Samuel Gordon, Supervisor from Delhi be elected chairman of the Board for the present meeting only.

Which motion being put was unanimously carried and Mr. Gordon thereupon assumed the duties of the chair.

Mr. Maples, Supervisor from the Town of Tompkins, offered the following resolution.

Resolved That the towns of Colchester, Delhi, Franklin, Hamden, Hancock, Masonville, Sidney, Tompkins & Walton containing population of twenty one thousand six hndred and eighty four (21,684) form and constitute the first assembly district of the County of Delaware.

And that the towns of Andes, Bovina, Davenport, Harpersfield, Kortright, Meredith, Middletown, Roxbury and Stamford containing a population of eighteen thousand and sixty five (18065) form and constitute the second assembly district of the County of Delaware.

Aye and noes being ordered were as follows:

Ayes: Messrs. Dickson, archibald, Shaw, Peters, Sands, Burhans, Andrews, Fisher, Maples, North. 10

Noes: Messrs. Gordon, Miller, Gilchrist, Smith, Allaben. 5

Resolution declared carried.

On motion of Mr. Dickson ordered that two copies of the proceedings of this meeting be signed by the Chairman and Clerk, and one filed in the Office of the Secretary of State and the other in the Office of the Clerk of the County of Delaware.

On motion the Board adjourned sine die.

At a meeting of the Board of Supervisors of the County of Delaware, held at the Court House in Delhi, on the tenth day of November, 1857.

The following named Supervisors were present:

On motion of Mr. Dickson, the Board proceeded to the Election of a Chairman by ballot.

Charles Maples had ten votes, Samuel Gordon had eight votes. Mr. Maples was declared elected Chairman.

On motion of Mr. Dickson, the Board then proceeded to a random ballot for clerk. O. W. Smith had ten votes, James R. Allaben had seven votes.

The Board then proceeded to a final ballot for clerk, which resulted in no choice.

The Board, continued to ballot, till the fifth ballot, for Clerk, and no one being elected, the Board adjourned till the next morning at 8 o'clock a.m.

Wednesday, November 11th 8 a.m.

The Board met pursuant to adjournment, all the Supervisors present.

On motion of Mr. Burhans, the Board proceeded to ballot for Clerk.

O. W. Smith was then declared elected Clerk.

Mr. Allaben moved that a select committee of three be appointed by the chair on wolf bounties, and requested not to be placed on the committee. Messrs. Burhans, Kiersted were appointed such committee.

The Chairman then announced the following standing committees.

Robert Parker, Esq., presented the claim of Daniel McKinnion & Edward G. Heath, Trustees of School District No. 12 Masonville and asked the Board to assess the claim on said District.

H. A. Clark, Esq. on behalf of some inhabitants of the District opposed the claim, and claimed that the Board had no jurisdiction to assess it on the District.

Mr. Gordon moved that the Board do not entertain the matter for want of jurisdiction.

The Ayes and Noes being demanded the motion was lost as follows:

Noes: Dickson, Shaver, C. Miller, S. F. Miller, Shaw, Kiersted, Gilchrist, Sands, Allaben, Burhans, Andrews, Fisher, Maples, North. 14.

When Mr. Smith's name was called he was excused from voting by the Board, he being the Supervisor of Masonville and related to some of the parties.

On motion of Mr. Gilchrist, the matter was postponed till the next meeting of the Board.

S. H. White, on behalf of certain petitioners, presented a petition to the Board, asking for the erection of a new Town from the Towns of Walton & Tompkins, the centre thereof to be near Rock Rift.

On motion of Mr. Allaben, the matter was referred to a committee of three. Messrs. Allaben, Shaw, Fisher were appointed such committee.

Board adjourned to ½ past one o'clock p.m.

½ past one p.m. the Board met pursuant to adjournment. The roll was called and all the Supervisors answered.

The County Judge presented a report of the Lunatics sent to the asylum from this County the past year, which was read and on motion was received and placed on file.

The money for highways and bridges in the several towns was then ordered to be assessed on the several towns.

The Board adjourned till tomorrow 8 o'clock a.m.

Thursday November 12th 8 a.m.

The Board met pursuant to adjournment. The roll was called, all the Supervisors present.

On motion of S. F. Miller $175 was ordered assessed on the town of Franklin for highway damages.

The Board adjourned to ½ past one p.m.

½ past one Board met pursuant to adjournment.

The Equalization committee submitted their report, which was read

Mr. Burhans moved to adjourn till ½ past 8 o'clock tomorrow morning.

The Ayes and Noes were demanded and the motion lost as follows:

On motion of Mr. Burhans the Board adjourned until ½ past 7 p.m.

½ past 7 the Board met pursuant to adjournment.

Mr. Gorden moved to adopt the report of the Equalizing Committee.

The Ayes and Noes were demanded and the reported adopted as follows;

The County Judge's report was then received and on motion placed on file.

On motion of Mr. Gorden $250 was directed to be paid by the Treasurer to build a bridge across the Delaware River at Pepacton.

On motion the bills of S. D. Hulce for raking a mill pond, and attending the Grand Jury were referred to the committee on county claims.

The Board adjourned till 8 o'clock tomorrow.

Friday November 13th 8 a.m.

The Board met pursuant to adjournment.

The Equalizing Committee ofered an amendment to the former report of the committee.

Mr. Burhans offered an amendment tot he amendment of the committee as follows add to the real estate of Bovina 5 per cent, Colchester 33 1/3 per cent, Hancock 12 ½ per cent, Masonville 4 per cent, Tompkins 5 per cent and deduct from Delhi 10 per cent, Kortright 4 per cent, Harpersfield 8 per cent, Stamford 10 per cent, Kortright 4 per cent.

The ayes and noes being called, Mr. Burhans amendment was declared lost as follows:

Ayes: Archibald, Shaver, Shaw, Kiersted, Sands, Burhans, Maples. 7

Noes: Dickson, C. Miller, Gorden, S. F. Miller, Peters, Gilchrist, Smith, Allaben, Andrews, Fisher, North. 11

The committee's amendment was then passed. The following is the report as amended and passed by the Board.

Resolved that the Clerk of this Board alter the equalized assessments of the several towns soas to make the equalized assessment as follows: Andes, seven dollars; Bovina ten dollars; Colchester five dollars; Davenport fifteen dollars; Delhi, sixteen dollars and fifty cents; Hamden ten dollars; Franklin sixteen dollars and a half; Kortright twelve dollars, Hancock seven dollars; Masonville nine dollars & fifty cents; Middletown seven dollars; Meredith twelve dollars; Harpersfield fifteen dollars; Roxbury thirteen dollars; Sidney fourteen dollars; Tompkins eight dollars; Stamford fiften dollars; Walton ten dollars per acre of land.

Resolved that the Clerk reduce the equalization so that the aggregate amount of the equalized value of the real estate of the several towns shall be the same as the aggregate assessed value thereof.

The report of the Committee on the erection of new towns, was read and adopted. The report was adverse to the erection of the proposed new town.

On motion the rejected taxes were ordered to be assessed on the several towns.

The Board adjourned till ½ past 1 p.m.

½ past one, Board met pursuant to adjournment.

The Select Committee on wolf bounties reported to audit to A. D. Freer $60 to be assessed on Middletown and $20 on the County. Report adopted.

The Board adjourned to ½ past 6 p.m.

½ past 6 p.m. the Board met pursuant to adjournment.

The report of the Committee to settle with the Treasurer was presented by Mr. Miller, Chairman, and accepted.

On motion of S.F. Miller the following resolutions were read and passed:

Resolved that the Representatives in the State Legislature for the County of Delaware be requested to secure an amendment of the poor laws so as to require the Town Overseers of the Poor to make a full report to the Board of Town auditors of their respective Towns, of all relief orders granted by them, the names of the persons so relieved and the necessity requiring it.

Resolved that the Clerk of this Board be instructed to forward a copy of the above resolution to the Senator and Member of Assembly.

The Committee on court house & jail reported $40 to repair the same, which was adopted.

On motion of Mr.Gorden the report of the Committee on County Claims was adopted and the several amounts audited by the committee were allowed and passed by the Board.

The report of the Committee on Town accounts was presented and accepted and the several amounts audited by the committee was ordered to be assessed on the several Towns as reported.

The report of the Committee on Constables and Justices accounts was presented and accepted and the several amounts audited by them were ordered to be assessed on the several Towns.

Mr.Gorden moved to allow A. J. Smith $6.28 in addition to the amount audited the committee. The motion of Mr. Gorden was lost.

The report of the Committee to settle with the Sheriff was read and accepted.

The Committee to settle with the Superintendents of the Poor presented their report which was adopted.

On motion of Mr. Burhans, the Sheriff was granted leave to present his account and report at the next meeting of this Board.

Mr.Burhans moved a special committee of three to ascertain the amount to be raised by the County for contingent expenses. Messrs. Burhans, S. F. Miller and Allaben were appointed such committee.

On motion of Mr. Gorden the following resolution was passed:

Resolved that the Clerk of the Board in estimating the taxes of the several Towns of this County as provided in the revised statutes add to the amount of County and Town charges three mills on the dollar or the valuation of real and personal estate which amount is to be paid by the County Treasurer into the State Treasury according to the several acts passed in relation to State taxes & school purposes.

Board adjourned to 8 a.m. tomorrow.

Saturday November 14th 8a.m.

Board met pursuant to adjournment.

The Superintendents of the Poor reported that they wanted $3000 raised for the poor fund the ensuing year. The report was read.

On motion of Mr. Gorden it was

Resolved that there be published in The Delaware Gazette and Delaware Express the Session Laws, Town and County accounts, and County Judges Report. That there be published in The Bloomville Mirror the Town & County accounts, and equalization of the assessment rolls, that there be published in the Franklin Visitor the Town and County accounts and equalization of the assessment rolls and report of the Superintendents of the Poor and in the Deposit Union Democrat the Town and County accounts, equalization of the assessment rolls and report of the Superintendents of the Poor.

On motion of Mr. Gorden $2,500 was ordered to be raised for the poor fund.

The Special Committee reported to raise $7000 for contingent expenses the ensuing year, which was adopted.

On motion of Mr. Burhans it was

Resolved that the County Judge & Surrogate be authorized to purchase an iron safe at a cost not exceeding three hundred dollars for the use of his office and to draw on the Treasurer for the money to pay for said safe when purchased.

On motion it was

Resolved that the Commissioners of Schools publish the necessary notices for Teachers drills and Teachers Institutes in Bloomville Mirror and Franklin Visitor.

On motion it was

Resolved that the County Treasurer be and he hereby is authorized to borrow money sufficient to meet and deficiency in the contingent fund of the County, on the faith and credit of the County.

On motion it was

Resolved that the penalty in Joseph H. Tyrells bond as Superintendent of the Poor of this County be $1000.

The Bond of Horatio N. Buckley the Treasurer was then approved and filed in the County Clerk's office.

On motion of Mr. Gorden, Gabriel S. Mead of Walton, Stephen C. Johnson of Delhi, Stephen Hine of Franklin, Lemmuel Sines, Middletown & John Hitchcolk were appointed Plank Road and Turnpike inspectors.

Mr. Shaver offered the following resolution which was laid on the table.

The Supervisor of Colchester would represent that an account passed by the Board of Supervisors of the County in 1855. Was taken from the files of the Clerk of the Board and again presented to the auditing Board of said Town of Colchester and also represents that the record book of the Supervisors of this County containing the proceedings of this County back or previous to the year 1855 is not in the office of the Board of Supervisors but is stated by the late Clerk to be loaned out of the office in a Town remote from here, and would therefore offer the following resolution.

Resolved that we consider the late Supervisors Clerk has been imprudent acted wrong and has made himself liable to be censured by this Board an it is the opinion of this Board of Supervisors he has acted wrong in loaning the books and papers of this office.

On motion of Mr. Gorden the Board adjourned to the 8th day of December next at 12 o'clock M.

December 8th, 1857

The Board met pursuant to adjournment. The roll was called and all the Supervisors answered to their names.

Several bills were reported to the Committee on County Claims. The Committee reported that the bills be laid on the table. Carried.

The sum of $155 was ordered assessed on the Town of Stamford to pay highway damages.

Board adjourned till 8 o'clock tomorrow morning.

Wednesday December 9th, 1857 8 a.m.

Board met pursuant to adjournment.

The Superintendent of the Poor presented their report.

Mr. Allaben moved to receive the report. Mr. Miller moved to amend by laying the report on the table.

Mr. Allaben accepted the amendment and the report was tabled.

On motion of Mr. Dixon the Masonville School District matter was made a special order for 2 o'clock this p.m.

On motion it was ordered that the $250 ordered to be raised to build a bridge at Colchester be paid by the Treasurer to the Supervisor of Colchester.

The bill of Jonas M. Smith late Supervisor, was presented for returning collectors bond.

Mr. Burhans moved to reject the bill and demanded the Ayes and Noes. The motion was lost by the following vote:

Ayes: Gorden, Burhans, Andrews. 3

Noes: Dickson, Archibald, Shaver, C. Miller, S. F. Miller, Shaw, Kiersted, Peters, Gilchrist, Smith, Sands, Allaben, Fisher, Maples, North. 15

The bill was then passed.

On motion of Mr. Burhans the Treasurer was allowed to purchase a desk for the papers in his office at a cost not exceeding $25.

On motion of Mr. Gorden, Mr. Porter's bill of $25 was reconsidered and his whole claim passed at $25.

The Board adjourned till 2 o'clock p.m.

2 o'clock p.m. Board met pursuant to adjournment.

The Committee to settle with the U.S. Loan Commissioners presented their report, which was laid on the table on motion.

On motion of Mr. Gilchrist the bills of Drs. McNaught and Covill were reconsidered and the bils of Drs. McNaught, McLaury & Covill were sent to the committee on county claims.

The committee on Sheriff's accounts made a further report which on motion was adopted and the bills audited by the Committee were passed.

The committee on county claims presented their report. Mr. Gilchrist moved to adopt the report.

Mr. Miller moved to amend by laying the bills on the table till they were certified by the Coroner.

Mr. Miller's motion was lost.

The report of the committee was then adopted.

Mr. Parker on behalf of the School District Trustees of District No. 12 in the Town of Masonville asked the Board to assess the amount of their bill on said School District.

Mr. Hughston, on behalf of some of the inhabitants of said District, objects & claims that the papers were no served in time

On motion of Mr. Burhans the Board proceeded to hear the matter.

Mr.Hughston objects on the ground that the matter has never been submitted to the inhabitants of said District and they have never voted to allow the claims.

Also that sufficient notice has not been given. It being served yesterday.

Also that the Board have no jurisdiction of the matter.

Adjourned to ½ past 6 p.m.

½ past 6 p.m. Board met pursuant to adjournment.

The school matter was continued, affidavits and papers were read, which are on file.

Mr. Allaben offered the following resolution:

Resolved that in the opinion of this Board the account of Daniel McKinnon & Edward E. Heath, late rustees of District No. 12 in the Town of Masonville for damages costs and expenses paid by them for and on account of a judgment obtained by Edward L. Bradstreet against them. When such Trustees amounting to $573.01 ought justly to be paid to them, and a majority of all the memebers elected to the Board hereby order that the pine lumber belonging to them by virtue of said judgment be taken by them at the amount of appraisal given by the jury giving said judgment ($150) and that the ballance $423.01 be paid to the said Daniel McKinnon & Edward E. Heath by the said District No. 12 in the Town of Masonville.

The Ayes and Noes being demanded the resolution passed by the following vote:

Ayes: Dickson, Archibald, Shaver, C. Miller, S. F. Miller, Shaw, Kiersted, Gilchrist, Sands, Allaben, Andrews, Fisher, Maples, North. 14

Thursday December 10th

Board met pursuant to adjournment.

The Loan Mortgages were read.

Board adjourned to ½ past one p.m.

½ past one p.m. Board met pursuant to adjournment.

The following resolution was passed:

Resolved That the United States Deposit Fund Loan Commissioners be requested to inquire into the sufficiency of the security of Mortgages Nos. 71 & 243 and if in their judgment such security shall not be deemed sufficient to demand additional security or payment of the same.

Mr.Allaben offered a resolution to revive the distinction between Town & County Poor, which was laid on the table by consent.

On motion of Mr. Allaben the Supts. of Poor report way taken up.

On motion of Mr. Miller the Supts. of the Poor report was adopted.

The supplementary report of the Supts. of Poor was read and on motion adopted and ordered printed.

The resolution in regard to reviving the distinction between Town & County poor was taken up.

Mr. Allaben moved to adopt the resolution which is as follows:

Resolved That the distinction between Town and County poor in the County of Delaware be revived and that the distinction go into effect on the first day of January 1858.

The resolution passed by the following vote:

Ayes: Dickson, Archibald, Shaver, C. Miller, S. F. Miller, Shaw, Peters, Gilchrist, Smith, Sands, Allaben, Burhans, Andrews, Fisher. 14

Noes: Gorden, iersted, Maples, North.

Mr. Gilchrist then took the chair.

Mr. Maples offered the following resolution

Resolved that hereafter but one County Superintendent of the Poor be elected in and for this County.

The resolution passed by the following vote.

Ayes: Dickson, Archibald, Shaver, C. Miller, Gorden, Shaw, Kiersted, Peters, Gilchrist, Smith, Sands, Allaben, Burhans, Fisher, Maples, North. 16

Noes: S. F. Miller, Andrews. 2

Mr. Kiersted offered a resolution in regard to game.

Mr. Allaben offered an additional resolution andon his motion the matter was referred to a select committee of three. Messrs. Allaben, Kiersted & Archibald were appointed such committee.

The committee to settle with the Loan Commissioners had leave to take their report from the table.

Mr. Allaben offered a resolution that the Treasurer be authorized to borrow on the credit of the County a sum not exceeding $1500.00 to pay the poor debt, which was passed.

Mr. Gilchrist in the chair.

On motion of Mr. Maples the sheriff was authorized to insure the County buildings and draw on the County Treasurer for the necessary funds.

The special committee reported the following game law, which was passed:

Section 1st. No person or persons shal catch take or destroy any trout found in the water of tis county between the first day of September in any year and the first day of March thereafter.

Section 2d. No person or persons shall catch with a net any fish in the water of tis county between the first day of December in any year and the first day of April following.

Section 3d. Whoever shall violate any provision of this act shal for each and every offence forfeit the sum of twenty five dollars to be sued for and recovered with costs of suit by any person sho shall prosecute for the same in his own name in any court having jurisdiction of the same said fine to belong to the ppor fund of the Town where the offence is committed.

Section 4. This act shall take effect immediately.

On motion of Mr. Maples the resolution authorizing the Treasurer to borrow money for the poor fund was reconsidered.

On motion of Mr. Maples the resolution was amended by inserting $3,000 in the place of $1,500.

Mr.C. Miller moved to reconsider the report of the equalizing committee.

Mr. Gorden moved to lay the motion on the table.

Mr. Maples called for the previous question and demanded the ayes and noes.

Mr. Allaben claimed the motion out of order.

The Chair decided the motion out of order.

Mr. Maples appealed and demanded the ayes & noes. The chair sustained by the following vote.

Ayes: Dickson, Archibald, Gorden, S. F. Miller, Shaw, Peters, Smith, Sands, Allaben, Andrews, Fisher, North. 12

Noes: Shaver, S. F. Miller, Kiersted, Burhans, Maples. 5

Mr. Maples moved that the assessment rolls be changed so as to comply with the instructions in the Supervisors books.

On motion of Mr.Allaben the motion was laid on the table.

On motion of Mr. Gorden the motion was taken from the table & passed.

Adj. to 8 a.m. tomorrow morning.

8 a.m. Board met pursuant to adjournment.

Mr.Gilchrist moved to raise $2000 for the poor fund in addition to the previous sum raised.

The Chair decided the motion out of order. Mr.Gilchrist appealed and the Chair was sustained by the following vote:

The committee to settle with the Loan Commissioners reported. Report accepted.

On motion the blanks in the collectors warrants were filled up with 15th February next.

The bills of the Supervisors were passed, also the clerk's bill.

The minutes were read & approved.

Mr. Gorden moved a resolution of thanks to the Chairman for the able impartial manner in which he had presided which was passes unanimously.

That no accounts were audited or allowed to any member of the Board or any other person without being verified according to law, except No. 31 of accounts audited the first meeting and No. 26 audited the 2d meeting.
