At a meeting of the Board of Supervisors of the County of Delaware County, convened at the court house in Delhi on the 3rd day of June 1856.

James R. Allaben, Clerk, called the Board to order and the following named persons appeared from the several towns as Supervisors.

At 12 o'clock at noon the Board was called to order.

On motion of Mr. Maples

Resolved that the Chairman about to be elected, shall be Chairman of this meeting only.

On motion of Mr. Courtney

Resolved that the election of Chairman be by ballot. Whereupon the Board proceeded to vote for Chairman.

And on the first ballot Anthony M. Paine had 7 votes, Sheldon A. Givens 3, Milton Bostwick 1, Robert W. Courtney 1 and Robert Humphrey 2. No person having a majority of all the votes cast it was declared that there was no election. And on motion of Mr. Courtney a second ballot was had at which Anthony M. Paine had 8 votes, Sheldon A. Givens had 3 votes, Robert W. Courtney had 1 vote, Robert Humphrey had 2 votes.

No person having a majority of all the votes it was declared that there was no election.

The Board proceeded to a second ballot and Anthony M. Paine had 8 votes, Sheldon A. Givens had 3 votes, Robert W. Courtney had 1 vote, Robert Humphrey had 2 votes, Samuel F. Miller had 1 vote.

And Anthony M. Paine, of Delhi, having a majority ofall the votes cast was declared elected, and assumed the duties of the chair.

On motion of Mr. Courtney the Board adjourned until 2 o'clock p.m.

Board met pursuant to adjournment.

Roll call & a full Board present, except the Supervisor from Walton.

On motion of Mr. Humphrey

Resolved that the Board proceed to the election of a School commissioner for the second assembly district.

On motion of Mr. Givens

Resolved that it shall require a majority of all the votes cast to elect.

The Board then proceeded to ballot for a school commissioner for the second assembly district.

Seventeen votes were cast:

There being no choice the Board proceeded to a third ballot. 17 votes cast.

Whereupon VanBuren Dutton, of Meredith, having a majority of all the votes cast, was declared duly elected School Commissioner for the second assembly district in the County of Delaware.

The Board then proceeded to ballot for a School Commissioner for the first assembly district in said County.

On the first ballot 16 votes were cast.

Whereupon Alfred Redfield, of Delhi, was declared duly elected School Commissioner for the second assembly district in the County of Delaware.

J. R. Allaben here served on the Chairman of the Board an original judgment roll in his favor against the Board of Supervisors, filed Feb. 4th 1856 in Del. Co. Clerks Office. Judgment docketed on same day.

Mr. Humphrey moved the following resolution which on motion passed.

Resolved That there be audited and allowed to James R. Allaben and paid to him a judgment in his favor against the Board of Supervisors, being for $172.52 and interest from the 10th day of July 1852 & $121.82 and interest from the 4th day of February 1856. Judgment roll filed and judgment docketed in Delaware County Clerk's Office February 4th 1856.

On motion the Board adjourned sine die.

At a meeting of the Board of Supervisors of the County of Delaware convened at the Court House in the Village of Delhi, on the 11th day of November, one thousand eight hundred and fifty-six.

James R. Allaben, Clerk, called the Board to order and the following named persons appeared from the several towns as Supervisors:

Mr. Humphrey moved that the Board proceed to the election of a Chairman by ballot.

Whereupon the Board proceeded to ballot for Chairman and

Robert W. Courtney had 8 votes and Charles Maples had 8 votes.

There being no choice the Board proceeded to another ballot with like result, and thus continued to ballot until the eleventh ballot with like result, when the Board adjourned until after dinner.

Board met pursuant to adjournment until the 26th ballot with precisely the same result as in the forenoon when the Board adjourned for tea.

Board met pursuant to adjournment and proceeded to the 27th upon which ballot

Robert W. Courtney had 8 votes and Charles Maples had 8 votes.

On motion of Mr. Miller a committee of confiner was appointed for the purpose of organizing the Board consisting of Messrs. Givens, Bostwick, TenEyck.

The committee retired and after a brief absence returned and through their chairman reported the following resolution

Resolved that this Board of Supervisors be organized by the appointment of Charles Maples, Chairman, James R. Allaben, Clerk, Robert W. Courtney, Chairman of the Equalizing Committee & the Chairman of all other committees equally divided and also the member of all committees except the Chairman to be equally divided among those who voted for Mr. Maples and those who voted for Mr. Courtney.

The resolution on motion of Mr. Miller was unanimously passed.

Wm. Gleason Jr. appeared before the Board in behalf of Ebenezer Mitchell and asked the Board to refund to him from the County a fine imposed under the act entitled "an act to suppress inter------ pauperism and crime" by Henry England, Esq. for $54.05 damages & costs January 26, 1856.

On motion of Mr. Miller this matter was referred to the committee on county claims.

The Superintendents of the Poor here presented their report, which on motion of Mr. Miller, was laid on the table until the adjourned meeting of the Board.

The Committee on Town Accounts here reported, report accepted, and the several amounts for Town Accounts and Highways and Bridges & road damages ordered assessed & levied upon the taxable property of the several towns.

On motion of Mr. Paine

Resolved That the Clerk of this Board in estimating the taxes of the several towns of the county as provided in the revised statutes, add to the amount of county and town one mill on the dollar of the valuation of the real and personal estate, which amount is to be paid by the County Treasurer into the Treasury for State Tax, also three quarters of one mill as aforesaid for the Support of Common Schools in this State.

On motion of Mr.Paine the Board adjd. until Nov. 15th at 8 o'clock a.m.

November 15th

Board met pursuant to adjournment. Roll called & a full Board present.

Mr. Paine, from the Committee on Court House and Jail presented the report of that Committee, which was read & accepted.

Mr. North, Chairman, presented the report of the Committee on County claims, which on motion was accepted and the several amounts audited against the Count as report except the account of the First Baptist Church in Franklin which account was audited against the Town of Franklin.

On motion of Mr. Courtney the Board proceeded to the election of printers to print the Session Laws by ballot. After balloting was found The Delaware Gazette had 9 votes, Delaware Express had 7 votes, Bloomville Mirror had 2 votes.

The Delaware Gazette and Delaware Express having the greatest number of votes were declared designated as such newspapers.

Mr. Givens presented the following resolution:

Resolved That the County accounts and Equalization of Assessments be published in the Weekly Visitor & Delaware Gazette, that the town accounts and Judges Report be published in the Weekly Visitor and Delaware Express; that the report of the Superintendents of the Poor be published in the Visitor and Gazette; and that all necessary notices by the County School Commissioners for their respective districts be published in the Visitor and Bloomville Mirror.

Ayes and Noes demanded.

Ayes: Messrs. McFarland, TenEyck, Miller, Shaw, Givens, Bailey, Courtney, North.

Noes: Messrs. Dickson, Shaver, Landfield, Peters, Humphrey, Bostwick, Smith, Barlow, Maples. 9

The following resolution on motion was adopted.

Resolved That all necessary notices of the School Commissioners for their respective districts be published in the Weekly Visitor and Bloomville Mirror.

Board adjd. until 1 ½ o'clock p.m.

Board met pursuant to adjournment.

Mr. Courtney, Chairman of the Equalizing committee, in behalf of the committee, submitted a report which being read on motion of Mr. Givens was adopted. Whereby 2 per cent was added to the real estate of Walton, 2 per cent to Hancock, 3 percent to Stamford and 2 percent was deducted from Delhi, 2 from Harpersfield and 3 from Colchester.

Mr. Miller, Chairman of the Committee to settle with the County Treasurer in behalf of the committee reported and the report being read was on motion accepted.

Mr. Humphrey presented the two following resolutions which on motion were adopted:

Resolved That, we the Board of Supervisors of the County of Delaware, are opposed to so much of the present school laws of the State of New York as provides for the election of School Commissioners, and we request the Legislature of this State at its next session to repeal that part of said law and reinstate the old law for the election of Town Superintendents.

Resolved That the Clerk of this Board forward a copy of the above resolution to each member of Assembly from this County and that they re requested to present the same to the Legislature at its next session.

Mr. Givens, from the Committee to settle with the Sheriff, presented a report, which was received and the accounts therein set forth audited against the County and the Town of Masonville as reported.

On motion of Mr. Miller

Resolved That the County Judges of this County be & hereby is directed to collect all -- credited by former Judges & Surrogates.

The report of the County Judge was received and on motion accepted and placed on file.

The Committee on County claims here made a report as far as presented bills are concerned which was read.

Mr. Givens moved to amend by allowing to A. M. Paine & N. Bowne the amount claimed in their bills instead of amount reported, which amendment passed and the report as amended was accepted and adopted.

Mr. Givens, Chairman of the Committee on Constable & Justices Accounts, presented a report which was accepted and the accounts set forth audited as reported.

On motion the Board adjourned one hour.

Board met pursuant to adjournment. Roll called and a full Board present.

The following resolution was presented:

Resolved That there be published in the Delaware Gazette and Delaware Express the Session Laws and Official Canvass; that there be published in the Bloomvlle Mirror, the Town and County accounts and Equalization of Assessment Rolls, that there be published in the Franklin Weekly Visitor, tthe Town and County accounts, Equalization of Assessment Rolls and County Judges Report; that their be published in the Deposit Union Democrat the Town Accounts, County Judges Report and Report of the Superintendents of the Poor & in the Walton Blade the Report of the Superintendents of the Poor.

Ayes and Noes demanded. All votes aye except Mr. Paine, who declined voting.

On motion of Mr. Miller

Resolved That the Superintendents of the Poor of the County of Delaware report at the adjourned meeting of this Board all the expenses incurred on account of the Poor directly and indirectly for the fiscal year ending on the first day of November 1856 designating in such report such expenses as have been paid and such as remain unpaid & out of what monies they have been paid; also that they fully report the whole indebtedness of the County indirectly and directly on account of the poor on the said 1st day of Nov. 1856, whether the same be for borrowed money or otherwise and that they also report the amount necessary in their opinion to be appropriated on account of the poor directly & indirectly for the fiscal year to end on the 1st day of Nov. 1857, exclusive of such sums as may be deemed necessary to pay and extinguish the indebtedness of the County aforesaid. Also to report on inventory of the property on hand belonging to the county. Also report what the farm has produced the last year ending Nov. 1, 1856. Also report the items on which their indebtedness accrued and the clerk of this Board is directed to serve a copy of this resolution on each of the Superintendents

On motion of Mr. Givens

Resolved That the salary of the office of District Attorney of this County be $400 per year for the next three years commencing January 1st, 1857.

On motion of Mr. Givens

Resolved That the sum of $14,000 be levied on the taxable property of the County and collected for contingent expenses for the ensuing year, and $3,000 to be placed to thecredit of the Poor Fund.

Mr. Humphrey presented the following resolution

Resolved That their be appropriated and paid from the contingent fund of the County by the Treasurer to the Commissioners of Highways of the Town of Middletown the sum of $200 to be by them appropriated to the building or repairing bridges in that town.

Ayes and Noes demanded.

Ayes: Messrs. Humphrey, Shaver. 2

Motion declared lost.

On motion of Mr. Givens

Resolved That Mr. Paine, Supervisor from Delhi, be a committee to receive proportions for rebuilding the kitchen to the jail and to report all propositions at the adjourned meeting of the Board.

On motion of Mr. Givens

Resolved That Baldwin Griffin be authorized to purchase and put up a stove and pipe in one of the cells of the jail. And to make such repairs to the Court House as suggested to him by the committee on Court House and Jail and present his bill to the Board next year.

On motion of Mr. Givens the Board adjourned until the 3rd day of December next at 1 p.m.

ADJOURNED MEETING

December 3d, 1856

Board met pursuant to adjournment. Roll called and all found present except Mr. Givens.

On motion of Mr. Miller

Resolved That the County Treasurer be authorized to pay on the order of the principal of the New York Institute for the Blind, Twenty Dollars to pay for the clothing for one year of Eliza Simmons now a pupil in said Institution.

On motion of Mr. Bailey

Resolved That the vote auditing the bill of I. S. Foster against Masonville and the County of the bill of Mr. Bixby against the Town of Masonville & the County as reported by the committee be reconsidered and the bills allowed taken from the files.

The Superintendents of the Poor presented their report which was read and on motion the consideration thereof postponed until tomorrow morning & that the same be then considered in committee the whole.

On motion the Board adjourned until tomorrow morning at 8 o'clock a.m.

Dec. 4th

Board met pursuant to adjournment. Roll called & quorum present.

Mr. John W. McDonald appeared before the Board and asked the Board to allow him $25 on a bill rejected in 1855.

Mr. Peters moved that his request be granted. Ayes and Noes demanded.

Bill declared passed.

The report of the Superintendents of the Poor was here taken up.

Mr. Courtney

Resolved That a committee of three be appointed by the Chair to take into consideration the report of the Superintendents of the Poor and to call for any items that they may deem necessary and report to this board as soon as convenient.

Mr. Courtney, Humphrey & North were appointed such committee.

On motion of Mr. Paine the bond of the Superintendents of the Poor elect was fixed at $1000.

The Committee to settle with the United States Deposit Fund commissioners made their report which on motion was accepted.

The books, papers and mortgages in the office of the U.S.D.F. Commissioners were here examined. No directives given in relation thereto except on motion of Mr. Miller it was

Resolved That the commissioners make particular inquiries as to the sufficiency of the Security of Mortgage No. 229, 232 & 243 & if not sufficient to obtain if possible additional security.

Board adjourned one hour for dinner.

Board met pursuant to adjournment. A quorum present.

The special committee to examine the report of the Superintendents of the Poor made this report which was read and accepted. And the report and amended report of the Superintendents of the Poor were accepted.

The following resolution was adopted unanimously

Resolved That we are opposed to and remonstrate against the proposed new County of Unadilla to be erected from the Counties of Delaware, Chenango & Otsego with the County seat at Unadilla, and earnestly request the Legislature of this State not to pass the same as a law and that the clerk of this Board be directed to transmit to the Senate from this District and the members of Assembly from this County a copy of this resolution.

The following several resolutions were passed:

Resolved That the County Treasurer be and he is hereby authorized and empowered to borrow money sufficient to merit any deficiency in the contingent fund of the County on the faith and credit of the County.

Resolved That A. M. Paine be and hereby is authorized to contract for the bilding of a kitchen to the county jail at an expense not exceeding $200 and that the account for building the same be presented to the Board of Supervisors as their next annual meeting.

Resolved That the County Treasurer be directed to keep the Poor fund separate and apart from any other fund and not to allow the same to be overdrawn & be authorized to borrow on the credit of the County any sum not exceeding $1000 and plan the same to the credit of the county.

Resolved That the Sheriff be directed to get the Court House insured in some good and reliable company for the sum of four thousand dollar and to draw upon the Treasurer for the amount necessary to insure the same.

On motion the Board adjourned until December 5th at 8 o'clock a.m.

November 5th 1856

Board met pursuant to adjournment and considered and audited their own accounts for services.

On motion of Mr. Dickson the Clerk of the Board was voted $175 for his services the current year.

Allaben, Clerk of the Board of Supervisors of the County of Delaware, do hereby certify that the preceding is the amount of compensation audited by the Board of Supervisors of said County to the members thereof, severally within the year 1856, and the items and nature of such compensation and that the Board was in session eight days within such year, and the distance traveled by the members respectively is correctly set forth in their several accounts. That no accounts were audited or allowed to any member of the Board or any other person without being verified according to law, except No. 1 and 2 of accounts audited at first meeting and No. 1 at the second meeting.
