At a meeting of the Board of Supervisors of the County of Delaware, convened at the Court House in the Village of Delhi, on the 13th day of November one thousand eight hundred and fifty-five.

James R. Allaben, Clerk, called the Board to order, and the following named persons appeared from the several towns as Supervisors.

Mr. Morse moved that the Board proceed to election of a Chairman by ballott.

Mr. Parker demanded the ayes and noes.

Noes: Messrs. Elwood, Parker, Wilcox, Courtney. 4

Motion declared carried.

Whereupon the Board proceeded to ballot for chairman: and

Richard Morse had 10 votes

Darius Maples had 6 votes.

Robert Parker had 2 votes.

On motion of Mr. Parker, Richard Morse, Esq., was unanimously elected chairman of the Board, he having a majority of all votes cast.

Mr. Morse, upon taking the chair, thanked the Board for the honor conferred upon him, and assumed it, that he should discharge the duties of the chair, according to the best of his ability.

On motion of the Board adjourned until Wednesday morning November 14th at 8 o'clock.

November 14th 1855

On motion of Mr. Mann, the Board proceeded to the election of a clerk by ballot, and

James Allaben had 9 votes

S. B. Champion had 7 votes

James R. Allaben, of Delhi, was declared reelected clerk.

The annual report of the county Judge was here received, and on motion, accepted and placed on file.

Mr, Burhans presented certified list of town accounts of the Town of Roxbury, as audited by the town borad of auditors of that town, amounting to $180.39, which amount on motion was ordered assessed and levied pon the taxable property of that town, and collected for the payment of such accounts.

Mr, Burhans presented a certificate of the commissioners of highways of the Town of Roxbury, by which it appeared that they had allowed William Tyler $5. For highway damages, which amount was ordered assessed and levied upon the taxable property of that town, and collected for the payment of the same.

Mr. Lee presented certified list of town accounts of the town of Middletown, as audited by the town board of auditors of that town amounting to $225.48 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Lee presented certificate of the commissioners of highways of the town of Middletown that $250 would be necessary in that town for roads and bridges, the ensuing year, and also certificate that said town at its last town meeting had voted to raise $225 which two amounts, on motion of Mr. Lee, were ordered assessed and levied on the taxable property of said town, and collected for highway and bridge purposes.

Mr. Mann presented a certified list of town accounts of the town of Meredith, as audited by the auditing board of that town amounting to $184.92 which amount on motion was ordered assessed and levied on the taxable propert of that town and collected for the payment thereof.

Mr. Mann presented a certificate of the commissioner of highways of the town of Meredith that $95 dollars was necessary for highway and bridge purposes in that town which amount on motion was ordered assessed and levied on the taxable property of that town and collected for such purposes.

Mr. Kentfield presented a certified list of town accounts of the town of Masonville as audited by the town board amounting to $171.66 which amount on motion was ordered assessed and levied on the taxable property of that town and collected for the payment thereof.

On motion of Mr. Burhans the clerk of the board was authorized to purchase a suitable book for the keeping of the records of the board.

Mr. Kentfield presented a certificate of the commissioners of highways of the town of Masonville that $200 was necessary for highway and bridge purposes in that town which amount on motion was ordered assessed and levied on the taxable property of that town and collected for those purposes.

Mr. Parker presented a certified list of town accounts of the town of Delhi as audited by the town board amounting to $275.37 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Parker presented certificate of the commissioners of highways of the town of Delhi certifying that $250 was necessary for highway and bridge purposes and certified votes of the town at its last town meeting for $650 for highway and bridge purposes which two accounts on motion were ordered assessed and levied upon the taxable property of that town and collected for the purposes aforesaid.

Mr. Courtney presented a certified list of town accounts of the town of Sidney as audited by the town board amounting to $190.73 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Courtney presented certificate of the commissioners of highways of the town of Sidney certifying $150 certifying $150 to be necessary for highways and bridges which amount on motion was ordered assessed and levied upon the taxable property of the town of Sidney and collected for highways and bridges in that town.

Mr. Champion presented a certified list of town accounts of the town of Harpersfield as audited by the town board of auditors amounting to $220.29 which amount was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. Wilcox presented a certified list of town accounts of the town of Franklin as audited by the town board of auditors amounting to $221.05 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. Wilcox presented a certificate of the commissioners of highways of the town of Franklin certifying $250 to be necessary for highway and bridge purposes in said town which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridges in said town.

Mr.Teneyck presented a certified list of town accounts of the town of Davenport as audited by the town board of auditors amounting to $119.25 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Teneyck presented a certificate of commissioners of highways of the town of Davenport that $300 was necessary for highway and bridge purposes in that town on motion the sum of $250 was ordered assessed and levied upon the taxable property of that town and collected for highway and bridge purposes.

On motion of Mr. Wilcox resolved that $40 be levied and assessed upon the county and collected and paid by the county treasurer to the treasurer of the New York Institution for the Deaf and Dumb to pay for clothing for Frances Seeley and Everett E. Jay, pupils in said institution from this county.

Mr. Maples presented certified list of town accounts of the town of Tompkins as audited by the town board of that town amounting to $362.06 which amount was ordered assessed and levied upon that town and collected to pay said accounts.

Mr. Maples presented a certificate by which it appeared the commissioners of highways in the town of Tompkins recommended $250 to be raised for highway and bridges and that the town voted $250 in addition which tow amounts on motion was ordered assessed and levied upon the taxable property of the town of Tompkins for highway and bridge purposes.

Mr. Elwood presented certified lis of town accounts of the town of Colchester as audited by the town board amounting to $326.87 which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected to pay the town accounts in that town for the current year.

On motion of Mr. Elwood $250 and interest for one year was ordered assessed and levied upon the taxable property of the town of Colchester to pay unpaid town accounts in that town for the preceding year growing out of a deficiency of money raised to pay town accounts in full n the year 1854.

Mr. McFarland presented certified list of town accounts as audited by the town board of auditors of the town of Bovina amounting to $14.81 which amount was ordered assessed and levied upon the taxable property of that town to pay said accounts.

Mr. McFarland presented certificate of commissioners of highways of the town of Bovina recommending $125 to be raised for highway and bridge purposes in that town which amount was ordered assessed and levied upon the taxable property of the town of Bovina for highways and bridges.

On motion of Mr. Burhans

Resolved that the county clerk be and is authorized to procure suitable books for indexes of deeds and a system of getting them up in the best possible manner, and he also shall transcribe in said book to be procured by him the names of grantors and grantees of deeds from 1792 to 1852.

Mr. Burhans here gave notice that tomorrow morning he shall introduce a resolution to revive the distinction between town and county poor in this county.

On motion, Gurden H. Edgerton was allowed to present his report as member of the building committee of jail and the house on the county farm, at the next meeting of the board.

Mr. Hawley presented certified list of town accounts as audited by the board of town auditors of the town of Hamden amounting to $189.56 which amount was ordered assessed and levied upon the taxable property of the town of Hamden and collected to pay said town accounts.

Mr. Hawley presented certificate of the commissioners of highways of the town of Hamden by which they recommend $270 to be raised for highways and bridges and to pay road damages which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for said purposes.

The report of H. Bourne, coroner, was here presented and on motion audited and placed on file.

Mr. Barlow presented certified list of town accounts of the town of Stamford as audited by the town board of auditors amounting to 127.29 which amount was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. North presented certified list of town accounts as audited by the town board of auditors of the town of Walton amounting to $181.93 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected to pay said town accounts.

On motion the board adjourned until half past one o'clock in the afternoon.

The board met pursuant to adjournment.

Mr. Morse presented certified list of town accounts as audited by the town board of audiors of the town of Andes amounting to $225.84 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Morse presented a certificate of the commissioner of highways of the town of Andes certifying $250 to be necessary for highways and bridges in that town which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridge purposes therein.

Mr. Carrier presented certified list of town accounts of the town of Hancock as audited by the town board of auditors of that town amounting to $435.39 which amount was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Carrier presented certificate of the commissioners of highways of the town of Hancock recommending $250 to be raised for highway and bridge purposes in that town, which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridge purposes therein.

On motion of Mr. Courtney the sum of $250 was ordered levied and assessed upon the taxable property of the town of Walton for highway and bridge purposes therein.

On motion the board adjourned until 7 o'clock in the evening.

Board met pursuant to adjournment.

On motion the bill of B. McCall was laid over untill the 2nd meeting of the board.

A petition from Wm. R. Beckley and other directors & c was here presented asking the privilege of laying out a turnpike road particularly set for in the petition.

On motion of Mr. Champlin the was laid upon the table.

Mr. Maples, chairman of the committee on marshals accounts presented the unanimous report of that committee, which on motion was received and accepted.

On motion the board adjourned until Thursday morning November 15th at 8 o'clock.

November15th

Board met pursuant to adjournment.

Present as yesterday. Minutes of preceding read and approved.

Mr. Burhans moved the following resolution -

Resolved, that on and after the first dy of January 1856 the distinction between town and county poor be revived in this county, and that each town support its own poor except transient poor who shall be supported by the county.

Mr. Parker moved the postponement of the consideration of this resolution untill the next meeting of the board.

Mr. Parker presented the following resolution:

Resolved that there be published in the Delaware Gazette, the county accounts, canvass and Judges report, and in the Bloomville Mirror the town and county accounts, the equalization of the assessment and official canvass, that there be published in the Express the Judges report and the report of the superintendent of the poor, and that there be published in the Deposit Union Democrat the town accounts, equalization of assessment rolls & & report of the superintendent of the poor.

Mr. Burhans moved the following amendment, that the Judges report and the report & report of the superintendent of the poor be given to the Deposit Union Democrat.

Board proceeded to ballot for newspapers to publish the Session Laws.

On the first ballot the Delaware Gazette had 4 votes, Express had 7 votes, Bloomville Mirror had 3 votes, Weekly Visitor had 4 votes.

On the second ballot the Delaware Gazette had 4 votes, Express had 5 votes, Bloomville Mirror had 1 vote, Weekly Visitor had 8 votes.

And the Delaware Express and Weekly Visitor having the greatest number of votes were declared and designated as the Newspapers to publish the Session Laws.

The accounts of Warren L. Peake, Alex Shaw & E. B. Hawley were on motion laid over until the next of the board.

On motion of Mr. Champlin the petition of Wm. C. Beckly & others was allowed to be taken from the files.

On motion of Mr. Elwood resolved tht $425 be levied and assessed upon the taxable property of the County for the New York Lunatic Asylum.

The consideration of B.Brown's account was laid over untill then next meeting of the board.

Mr. Parker from the committee on constables accounts and other claims, presented the unanimous report of that committee which on motion was received and adopted.

Mr. Burhans from the committee on sheriff's accounts presented the report of that committee which on motion was received and adopted.

On motion of Mr. Parker

Resolved that the salary of the County Judge be one thousand dollars per year, payable quarterly. On the first day of April, July, October and January.

It was moved and carried that Nathaniel Hathaway be and hereby is appointed count sealer of weights and measures and that he be and hereby is authorized to procure necessary and suitable cases and places for keeping the same, and to draw upon the treasurer of the county to pay the necessary costs and expenses of the same.

On motion,

Resolved that the Clerk of the Board be directed to pay amount of rejected taxes on the several lots to which they respectively belong as far as the same may be practicable and the balance on the taxable property of the town in which the taxes are reported.

On motion of Mr. Burhans

Resolved that the county Judge elect be at liberty to use the room in the court house for an office now used by the present county Judge, free of charge.

Mr. Peters presented certified list of town accounts of the town of Kortright as audited b the town board of that town, amounting to $284.90 which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected for the payment of said accounts.

Mr. Peters presented a certificate of the commissioners of highways of the town of Kortright certifying that $175 was necessary for highway and bridge purposes in that town, which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected for said purposes.

On motion,

Resolved that the vote designating the newspapers to publish the Session Laws, be, and the same is hereby reconsidered.

The board then proceeded to designated the two newspapers to publish the Session Laws by ballot, and the Delaware Gazette, and Bloomville Mirror, having the greatest number of votes, was declared & designated, as the newspapers to publish the Session Laws, for the year 1856.

The board adjourned until the 16th of November at 8 o'clock a.m.

November 16th

Board met pursuant to adjournment. Present as yesterday. Minutes of preceding day read and approved.

Mr. Parker presented the following resolution:

Resolved that the superintendents of the poor be authorized to contract with the Trustees of the First Presbyterian Church of Delhi for a seat or pew for one year for the use of the poor in the county house at a price not to exceed six dollars.

The committee on county claims, here presented their report, which was read, and two accounts for wild cat bounty of Joseph Cable contained in report were on motion charged to the town of Walton.

The residue of said report, on motion of Mr. Maples was adopted.

The Superintendents of the Poor made their annual report, and it being read was adopted.

Mr. Mann, chairman from the committee on court house and jail, presented the report of that committee, which recommended that certain alterations be made in both buildings (see report) which on motion was received and adopted.

Leave of absence, on motion, was granted to Mr. Elwood.

On motion of Mr. Courtney

Resolved that Alexander Burhans, H. Burhans, be, and hereby is appointed, a committee to carry out the recommendations of the committee on court house and jail, and that he be, and hereby is empowered to draw on the county treasurer for the necessary amount to defray the expenses.

On motion,

Resolved that Andrew Hawver, John Hitchcock, Wilson P. More, Thomas Marvin & William K. Owens, be and hereby are appointed, inspectors of turnpikes and plank roads in the county of Delaware.

Mr. Maples, chairman of the committee on equalization, presented the report of that committee, by which the committee recommended that the aggregate real and personal property in the:

Town of Bovina be raised 1 per cent.

Town of Sidney be raised 4 per cent.

Town of Masonville be raised 4 per cent.

Town of Colchester be raised 3 per cent.

Town of Hamden be raised 2 per cent. And that there be deducted from the aggregate real and

personal property in the:

Town of Tompkins 5 per cent.

Town of Delhi 4 per cent.

Mr. Peters moved that the report of the committee be accepted and adopted.

Ayes and Noes demanded:

Ayes: Messrs. Burhans, Champlin, Barlow, Carrier, Elwood, Lee, Mann, Morse, Maples, McFarland, North, Parker, Peters, Wilcox. 14

Noes: Messrs. Courtney, Hawley. 2

Motion declared carried.

On motion of Mr. Parker,

Resolved that the clerk of this board, in estimating the taxes of the several towns, of the county, as provided in the revised statutes, add to the amount of county and town, one mill and one quarter on the dollar of the valuation of real and personal estate, which amount is to be paid by the county treasurer, into the state treasury for State Tax.

On motion of Mr. Parker

Resolved that there be assessed and levied upon the real and personal property of this county the sum of five thousand one hundred and forty dollars and ninety four cents, and collected for the support of the common schools.

On motion of Mr. Courtney,

Resolved that the county treasurer be authorized to pay James W. Stevens two hundred dollars out of the contingent fund in his hands to reimburse him for moneys taken from him while acting as collector of the town of Colchester in the spring of 1855.

Mr. Burhans presented the following resolution:

Resolved that in the opinion of this board the Superintendents of the Poor have faithfully discharged the duties of their office and that the expense of keeping the poor the last year has been as little as could be expected under the existing law for supporting the poor in this county, as nearly one third of said expenses have been paid to overseers of the poor of the several towns over which they have no control.

Which resolution on motion of Mr. Maples was adopted.

Resolved that the County Treasurer be, and hereby is authorized and empowered to borrow money sufficient to meet any deficiency in the county funds, on the faith and credit of the county,

On motion of Mr. Parker the warrants of the towns of Davenport, Delhi, Tompkins, Franklin, Sidney, Harpersfield, Kortright, Stamford & Bovina were ordered made returnable on the first day of February next and the residue of the towns on the 15 day of the same month.

The two following resolutions were offered by Mr. Champlin andon his motion adopted:

Resolved That the Middleburgh and Delaware Turnpike Company be authorized to construct a turnpike road specified in its application to this Board, to wit: To be constructed in width four rods. To run from near the point where the West Branch of the Delaware River crosses the Delaware Turnpike to the County line of the County of Schoharie at or near the lands of Marshall Cowley and to take the real estate necessary to be used for that purpose. A majority of all the members voting in the affirmative.

Resolved That William Champlin, Reuben Palmer and Adam Grant are hereby appointed commissioners to lay out a road on the route specified in the application of the Middleburgh and Delaware Turnpike Company as mentioned in the order of the Board authorizing its construction.

A resolution was here offered allowing Mr. Lee one days pay as Supervisor in coming to meet with the Board.

A like resolution was offered for giving him. Same vote as above except Barlow and Peters voted no and Burhans absent.

On motion of Mr. Parker

Resolved that the thanks of the Board, are due Hon.R. Morse for the able, impartial & dignified manner, with which he has presided over the Board, and discharged the duties of Chairman, thereof.

On motion the clerk was allowed $175 for his services.

James R. Allaben, of Delhi, was declared reelected clerk.

The annual report of the county Judge was here received, and on motion, accepted and placed on file.

Mr, Burhans presented certified list of town accounts of the Town of Roxbury, as audited by the town borad of auditors of that town, amounting to $180.39, which amount on motion was ordered assessed and levied pon the taxable property of that town, and collected for the payment of such accounts.

Mr, Burhans presented a certificate of the commissioners of highways of the Town of Roxbury, by which it appeared that they had allowed William Tyler $5. For highway damages, which amount was ordered assessed and levied upon the taxable property of that town, and collected for the payment of the same.

Mr. Lee presented certified list of town accounts of the town of Middletown, as audited by the town board of auditors of that town amounting to $225.48 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Lee presented certificate of the commissioners of highways of the town of Middletown that $250 would be necessary in that town for roads and bridges, the ensuing year, and also certificate that said town at its last town meeting had voted to raise $225 which two amounts, on motion of Mr. Lee, were ordered assessed and levied on the taxable property of said town, and collected for highway and bridge purposes.

Mr. Mann presented a certified list of town accounts of the town of Meredith, as audited by the auditing board of that town amounting to $184.92 which amount on motion was ordered assessed and levied on the taxable propert of that town and collected for the payment thereof.

Mr. Mann presented a certificate of the commissioner of highways of the town of Meredith that $95 dollars was necessary for highway and bridge purposes in that town which amount on motion was ordered assessed and levied on the taxable property of that town and collected for such purposes.

Mr. Kentfield presented a certified list of town accounts of the town of Masonville as audited by the town board amounting to $171.66 which amount on motion was ordered assessed and levied on the taxable property of that town and collected for the payment thereof.

On motion of Mr. Burhans the clerk of the board was authorized to purchase a suitable book for the keeping of the records of the board.

Mr. Kentfield presented a certificate of the commissioners of highways of the town of Masonville that $200 was necessary for highway and bridge purposes in that town which amount on motion was ordered assessed and levied on the taxable property of that town and collected for those purposes.

Mr. Parker presented a certified list of town accounts of the town of Delhi as audited by the town board amounting to $275.37 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Parker presented certificate of the commissioners of highways of the town of Delhi certifying that $250 was necessary for highway and bridge purposes and certified votes of the town at its last town meeting for $650 for highway and bridge purposes which two accounts on motion were ordered assessed and levied upon the taxable property of that town and collected for the purposes aforesaid.

Mr. Courtney presented a certified list of town accounts of the town of Sidney as audited by the town board amounting to $190.73 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of such accounts.

Mr. Courtney presented certificate of the commissioners of highways of the town of Sidney certifying $150 certifying $150 to be necessary for highways and bridges which amount on motion was ordered assessed and levied upon the taxable property of the town of Sidney and collected for highways and bridges in that town.

Mr. Champion presented a certified list of town accounts of the town of Harpersfield as audited by the town board of auditors amounting to $220.29 which amount was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. Wilcox presented a certified list of town accounts of the town of Franklin as audited by the town board of auditors amounting to $221.05 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. Wilcox presented a certificate of the commissioners of highways of the town of Franklin certifying $250 to be necessary for highway and bridge purposes in said town which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridges in said town.

Mr.Teneyck presented a certified list of town accounts of the town of Davenport as audited by the town board of auditors amounting to $119.25 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Teneyck presented a certificate of commissioners of highways of the town of Davenport that $300 was necessary for highway and bridge purposes in that town on motion the sum of $250 was ordered assessed and levied upon the taxable property of that town and collected for highway and bridge purposes.

On motion of Mr. Wilcox resolved that $40 be levied and assessed upon the county and collected and paid by the county treasurer to the treasurer of the New York Institution for the Deaf and Dumb to pay for clothing for Frances Seeley and Everett E. Jay, pupils in said institution from this county.

Mr. Maples presented certified list of town accounts of the town of Tompkins as audited by the town board of that town amounting to $362.06 which amount was ordered assessed and levied upon that town and collected to pay said accounts.

Mr. Maples presented a certificate by which it appeared the commissioners of highways in the town of Tompkins recommended $250 to be raised for highway and bridges and that the town voted $250 in addition which tow amounts on motion was ordered assessed and levied upon the taxable property of the town of Tompkins for highway and bridge purposes.

Mr. Elwood presented certified lis of town accounts of the town of Colchester as audited by the town board amounting to $326.87 which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected to pay the town accounts in that town for the current year.

On motion of Mr. Elwood $250 and interest for one year was ordered assessed and levied upon the taxable property of the town of Colchester to pay unpaid town accounts in that town for the preceding year growing out of a deficiency of money raised to pay town accounts in full n the year 1854.

Mr. McFarland presented certified list of town accounts as audited by the town board of auditors of the town of Bovina amounting to $14.81 which amount was ordered assessed and levied upon the taxable property of that town to pay said accounts.

Mr. McFarland presented certificate of commissioners of highways of the town of Bovina recommending $125 to be raised for highway and bridge purposes in that town which amount was ordered assessed and levied upon the taxable property of the town of Bovina for highways and bridges.

On motion of Mr. Burhans

Resolved that the county clerk be and is authorized to procure suitable books for indexes of deeds and a system of getting them up in the best possible manner, and he also shall transcribe in said book to be procured by him the names of grantors and grantees of deeds from 1792 to 1852.

Mr. Burhans here gave notice that tomorrow morning he shall introduce a resolution to revive the distinction between town and county poor in this county.

On motion, Gurden H. Edgerton was allowed to present his report as member of the building committee of jail and the house on the county farm, at the next meeting of the board.

Mr. Hawley presented certified list of town accounts as audited by the board of town auditors of the town of Hamden amounting to $189.56 which amount was ordered assessed and levied upon the taxable property of the town of Hamden and collected to pay said town accounts.

Mr. Hawley presented certificate of the commissioners of highways of the town of Hamden by which they recommend $270 to be raised for highways and bridges and to pay road damages which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for said purposes.

The report of H. Bourne, coroner, was here presented and on motion audited and placed on file.

Mr. Barlow presented certified list of town accounts of the town of Stamford as audited by the town board of auditors amounting to 127.29 which amount was ordered assessed and levied upon the taxable property of that town and collected to pay said accounts.

Mr. North presented certified list of town accounts as audited by the town board of auditors of the town of Walton amounting to $181.93 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected to pay said town accounts.

On motion the board adjourned until half past one o'clock in the afternoon.

Mr. Morse presented certified list of town accounts as audited by the town board of audiors of the town of Andes amounting to $225.84 which amount on motion was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Morse presented a certificate of the commissioner of highways of the town of Andes certifying $250 to be necessary for highways and bridges in that town which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridge purposes therein.

Mr. Carrier presented certified list of town accounts of the town of Hancock as audited by the town board of auditors of that town amounting to $435.39 which amount was ordered assessed and levied upon the taxable property of that town and collected for the payment of said accounts.

Mr. Carrier presented certificate of the commissioners of highways of the town of Hancock recommending $250 to be raised for highway and bridge purposes in that town, which amount on motion was ordered assessed and levied upon the taxable property of that town for highway and bridge purposes therein.

On motion of Mr. Courtney the sum of $250 was ordered levied and assessed upon the taxable property of the town of Walton for highway and bridge purposes therein.

On motion the board adjourned until 7 o'clock in the evening.

On motion the bill of B. McCall was laid over untill the 2nd meeting of the board.

A petition from Wm. R. Beckley and other directors & c was here presented asking the privilege of laying out a turnpike road particularly set for in the petition.

On motion of Mr. Champlin the was laid upon the table.

Mr. Maples, chairman of the committee on marshals accounts presented the unanimous report of that committee, which on motion was received and accepted.

On motion the board adjourned until Thursday morning November 15th at 8 o'clock.

Mr. Burhans moved the following resolution -

Resolved, that on and after the first dy of January 1856 the distinction between town and county poor be revived in this county, and that each town support its own poor except transient poor who shall be supported by the county.

Resolved that there be published in the Delaware Gazette, the county accounts, canvass and Judges report, and in the Bloomville Mirror the town and county accounts, the equalization of the assessment and official canvass, that there be published in the Express the Judges report and the report of the superintendent of the poor, and that there be published in the Deposit Union Democrat the town accounts, equalization of assessment rolls & & report of the superintendent of the poor.

Mr. Burhans moved the following amendment, that the Judges report and the report & report of the superintendent of the poor be given to the Deposit Union Democrat.

Board proceeded to ballot for newspapers to publish the Session Laws.

On the first ballot the Delaware Gazette had 4 votes, Express had 7 votes, Bloomville Mirror had 3 votes, Weekly Visitor had 4 votes.

On the second ballot the Delaware Gazette had 4 votes, Express had 5 votes, Bloomville Mirror had 1 vote, Weekly Visitor had 8 votes.

And the Delaware Express and Weekly Visitor having the greatest number of votes were declared and designated as the Newspapers to publish the Session Laws.

The accounts of Warren L. Peake, Alex Shaw & E. B. Hawley were on motion laid over until the next of the board.

On motion of Mr. Champlin the petition of Wm. C. Beckly & others was allowed to be taken from the files.

On motion of Mr. Elwood resolved tht $425 be levied and assessed upon the taxable property of the County for the New York Lunatic Asylum.

The consideration of B.Brown's account was laid over untill then next meeting of the board.

Mr. Parker from the committee on constables accounts and other claims, presented the unanimous report of that committee which on motion was received and adopted.

Mr. Burhans from the committee on sheriff's accounts presented the report of that committee which on motion was received and adopted.

On motion of Mr. Parker

Resolved that the salary of the County Judge be one thousand dollars per year, payable quarterly. On the first day of April, July, October and January.

It was moved and carried that Nathaniel Hathaway be and hereby is appointed count sealer of weights and measures and that he be and hereby is authorized to procure necessary and suitable cases and places for keeping the same, and to draw upon the treasurer of the county to pay the necessary costs and expenses of the same.

On motion,

Resolved that the Clerk of the Board be directed to pay amount of rejected taxes on the several lots to which they respectively belong as far as the same may be practicable and the balance on the taxable property of the town in which the taxes are reported.

On motion of Mr. Burhans

Resolved that the county Judge elect be at liberty to use the room in the court house for an office now used by the present county Judge, free of charge.

Mr. Peters presented certified list of town accounts of the town of Kortright as audited b the town board of that town, amounting to $284.90 which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected for the payment of said accounts.

Mr. Peters presented a certificate of the commissioners of highways of the town of Kortright certifying that $175 was necessary for highway and bridge purposes in that town, which amount on motion was ordered assessed and levied upon the taxable property of that town, and collected for said purposes.

On motion,

Resolved that the vote designating the newspapers to publish the Session Laws, be, and the same is hereby reconsidered.

The board then proceeded to designated the two newspapers to publish the Session Laws by ballot, and the Delaware Gazette, and Bloomville Mirror, having the greatest number of votes, was declared & designated, as the newspapers to publish the Session Laws, for the year 1856.

The board adjourned until the 16th of November at 8 o'clock a.m.

November 16th

Board met pursuant to adjournment. Present as yesterday. Minutes of preceding day read and approved.

Mr. Parker presented the following resolution:

Resolved that the superintendents of the poor be authorized to contract with the Trustees of the First Presbyterian Church of Delhi for a seat or pew for one year for the use of the poor in the county house at a price not to exceed six dollars.

The committee on county claims, here presented their report, which was read, and two accounts for wild cat bounty of Joseph Cable contained in report were on motion charged to the town of Walton.

The Superintendents of the Poor made their annual report, and it being read was adopted.

Mr. Mann, chairman from the committee on court house and jail, presented the report of that committee, which recommended that certain alterations be made in both buildings (see report) which on motion was received and adopted.

Leave of absence, on motion, was granted to Mr. Elwood.

On motion of Mr. Courtney

Resolved that Alexander Burhans, H. Burhans, be, and hereby is appointed, a committee to carry out the recommendations of the committee on court house and jail, and that he be, and hereby is empowered to draw on the county treasurer for the necessary amount to defray the expenses.

On motion,

Resolved that Andrew Hawver, John Hitchcock, Wilson P. More, Thomas Marvin & William K. Owens, be and hereby are appointed, inspectors of turnpikes and plank roads in the county of Delaware.

Mr. Maples, chairman of the committee on equalization, presented the report of that committee, by which the committee recommended that the aggregate real and personal property in the:

Town of Bovina be raised 1 per cent.

Town of Sidney be raised 4 per cent.

Town of Masonville be raised 4 per cent.

Town of Colchester be raised 3 per cent.

Town of Hamden be raised 2 per cent. And that there be deducted from the aggregate real and

personal property in the:

Town of Tompkins 5 per cent.

Town of Delhi 4 per cent.

Mr. Peters moved that the report of the committee be accepted and adopted.

On motion of Mr. Parker,

Resolved that the clerk of this board, in estimating the taxes of the several towns, of the county, as provided in the revised statutes, add to the amount of county and town, one mill and one quarter on the dollar of the valuation of real and personal estate, which amount is to be paid by the county treasurer, into the state treasury for State Tax.

On motion of Mr. Parker

Resolved that there be assessed and levied upon the real and personal property of this county the sum of five thousand one hundred and forty dollars and ninety four cents, and collected for the support of the common schools.

On motion of Mr. Courtney,

Resolved that the county treasurer be authorized to pay James W. Stevens two hundred dollars out of the contingent fund in his hands to reimburse him for moneys taken from him while acting as collector of the town of Colchester in the spring of 1855.

Mr. Burhans presented the following resolution:

Resolved that in the opinion of this board the Superintendents of the Poor have faithfully discharged the duties of their office and that the expense of keeping the poor the last year has been as little as could be expected under the existing law for supporting the poor in this county, as nearly one third of said expenses have been paid to overseers of the poor of the several towns over which they have no control.

Which resolution on motion of Mr. Maples was adopted.

Resolved that the County Treasurer be, and hereby is authorized and empowered to borrow money sufficient to meet any deficiency in the county funds, on the faith and credit of the county,

On motion of Mr. Parker the warrants of the towns of Davenport, Delhi, Tompkins, Franklin, Sidney, Harpersfield, Kortright, Stamford & Bovina were ordered made returnable on the first day of February next and the residue of the towns on the 15 day of the same month.

The two following resolutions were offered by Mr. Champlin andon his motion adopted:

Resolved That the Middleburgh and Delaware Turnpike Company be authorized to construct a turnpike road specified in its application to this Board, to wit: To be constructed in width four rods. To run from near the point where the West Branch of the Delaware River crosses the Delaware Turnpike to the County line of the County of Schoharie at or near the lands of Marshall Cowley and to take the real estate necessary to be used for that purpose. A majority of all the members voting in the affirmative.

Resolved That William Champlin, Reuben Palmer and Adam Grant are hereby appointed commissioners to lay out a road on the route specified in the application of the Middleburgh and Delaware Turnpike Company as mentioned in the order of the Board authorizing its construction.

Delaware County, ss: I, James R. Allaben, Clerk of the Board of Supervisors of the county of Delaware, do hereby certify that the preceding is the amount of compensation audited by the Board of Supervisors of said county, to the members thereof severally, (except an account of $5.20 audited Lewis Kentfield, being No. 64 County accounts) within the year 1855, and the items and nature of days within such year, and the distance traveled by the members respectively, is correctly set forth in their several accounts.

That no accounts were audited or allowed to any member of the Board or any other person without being verified according to law, except the account of S. C. Wilcox, Supervisor, and No.12 of accounts audited at second meeting.
